A comparison of the Botswana and South African labour dispute: resolution systems

- Description: The purpose of this study was to compare the dispute resolution systems of Botswana and South Africa. As far as the South Africa dispute resolution system is concerned extensive literature on the system was carried out to describe its functioning. As for the Botswana dispute resolution system there was not much written about it in the literature, so in order to find out more about this system semi-structured interviews with labour relations experts which include mediators, arbitrators, lecturers, labour lawyers, trade unionists, employers and government officials held. The framework of comparison was developed to compare the elements of dispute resolution systems against each other and secondly to compare each system against the criteria of performance to the system. The two labour relations systems were compared in terms of elements of the system and the performance of the two systems. In the comparisons of the elements of the systems it was found out that in both systems the nature of disputes was collective and individual disputes both of which can be referred to the initial process of mediation or conciliation. However, in Botswana collective disputes can only be referred to arbitration if they remain unresolved in mediation while in South Africa only collective disputes on essential services go to arbitration while others lead to a strike or lockout if unresolved at conciliation. As for coverage both systems have incorporated public service sector employees in the systems after being excluded from the system for a very long time. The only difference is that in Botswana the Police force is not included while in South Africa they are included in the system. Differences in the avenues of disputes in the two countries were noted, in Botswana the rights/individual disputes go to either arbitration or Industrial Court if unresolved at mediation, inter-est/collective disputes can only go to arbitration while in South Africa the route of disputes is specified in the legislation. As for the human resources of the two countries it was found that the South African system has more qualified, trained and sufficiently experienced staff than the Botswana system. As for the processes it was found that for South Africa the initial process is conciliation while in Botswana it is mediation but these two processes were similar in many ways, from mediation/conciliation the next step in both systems is arbitration and just like the conciliation/mediation, arbitration in both countries was found to be similar except that in South Africa it is a public hearing. The two systems were also compared in terms of their performances and the research has established that between the two systems the South African system proved to be more superior on three of the criteria; efficiency, accessibility and legitimacy than the Botswana system. Therefore, the research proposes a number of recommendations for Botswana to implement namely; establishment of a legislated mixed process of mediation-arbitration, making the dispute resolution system independent from government, recruitment of high qualified and experienced staff for mediation and arbitration, accreditation to private agencies, effective case management system and proper routing of disputes.

The study outlines a water service marketing challenge and methods of research followed to deal with it (Chapter One) and the nature of the laws and institutions governing water service provision in South Africa (Chapter Two). The task of providing water services is delegated to Water Service Providers (municipalities). The key variables of the water service mix from the consumers perspective include; quality of the water, rate of flow from tap, interruption of water flow, sewerage disposal, assurance of supply, and water service tariffs (Chapter Three). The study covers the areas of Amathole, Kouga and Nelson Mandela Bay Municipalities' (Chapter Five). The method of marketing analysis applied is conjoint analysis, alternatively known as choice experiment analysis. An overview of the method is provided and its application to three samples of one hundred residents at each of the study sites is described in Chapter Four. The responses of the three hundred residents provide the basis for the results. Respondents were requested to make a series of choices between alternative water service mixes consisting of six variables differentiated by three levels (Chapter Three). In making these choices they implicitly compared and weighed up the relative worth of the selected variables against each other. The findings of the analysis were diverse (Chapter Six); two of the three estimated models did not yield significant results. An interpretation of these results showed that the respondents of the Kouga municipality were willing to pay R65.05 more (per 10 xii Kilolitres of water) than their current monthly tariff for a marginal improvement in water quality, R57.29 more (per 10 Kilolitres of water) per month for a marginal improvement in sewerage disposal and R21.90 (per 10 Kilolitres) per month for marginal improvements in assurance of water supply. Findings showed that willingness to pay for reduced interruptions and improved flow rates was lower and not as highly valued as the abovementioned variables. Most of these findings were consistent with similar international and national studies showing their reliability. Although there has been significant improvement in extending the reach of the network since 1994, the standards of water service provision in South African municipalities do not appear to have improved. The results of this study mirror a number of concerns that have been expressed about the standards of service, particularly sanitation (in publications like the Green Drop Report). Municipal service delivery in these areas would appear to be constrained by a number of issues including a lack of public involvement, legislation, limited financial resources and institutional capabilities. However, it is a service that is too vitally important to be allowed to deteriorate. Marketing analyses can make a valuable contribution to allocating and managing the scarce resources to best satisfy the consumers of water services (Chapter Seven). When consumer orientation is formally introduced as the main objective into the thinking of the service provider, it becomes untenable to offer poor service delivery. But that is exactly what many municipalities appear to be doing. There is a need to get back to the basics – where the consumer is king. This analysis concludes that consumers want, above all else, assurance of water supply, a high quality of water, and safe environmentally sensitive disposal of waste water. It is recommended that municipalities not lose sight of the fact that price is an important part of the marketing mix. From the paying consumers perspective, when the government incorporate too many other considerations into pricing of water services they are, in effect, disengaging price from the marketing mix by not being sensitive to consumer needs. This approach shows a weak marketing strategy, and may result in dissatisfied consumers who may become unwilling to pay for their water services – an outcome that the researcher would discourage.

With the advent of the new South Africa in 1994, the government initiated poverty alleviation projects for youth development. These projects offered black youth an opportunity to participate in their own development. The current study aimed at critically analyzing the contribution of a „Poverty Alleviation‟ programme for youth development. The study was conducted at Cala in the Sakhisizwe local municipality in the Chris Hani District of the Eastern Cape. The study utilized qualitative and quantitative research methods and took the form of exploratory research. The study revealed factors that appear to contribute to the ineffectiveness of youth development projects. The identified factors include the lack of participation of project members, lack of a sense of ownership and commitment, insufficient skills and non-use of policy and guiding documents by project members during the implementation stage. Stakeholder participation and sharing of expertise was identified as another important factor in determining the contribution of poverty alleviation projects to youth development. Lastly, the study shows that monitoring and evaluation of the project functions are necessary to ensure that a project like this achieves the desired outcome. A key recommendation made is that project members must be involved and participate fully in all project phases to enhance a sense of ownership and commitment to fellow project members.

- Description: The South African economy has seen an increase in small businesses since 1994. This increase has been caused by an increase in unemployment rate and government interventions to promote small businesses. The government has through the National Treasury introduced various tax legislations to simplify and facilitate the tax processes that small businesses have to comply with. The discussion contained in this treatise seeks to critically analyse the tax implications for small and micro businesses. One of the small business tax legislations, Small Business Corporations, is discussed in chapter 2. The Small Business Corporation legislation provides for two key concessions to qualifying small businesses. The first concession is the progressive tax rates that are lower than normal tax rates at taxable income level below R300 000. The second concession is the special capital allowances that the qualifying small business is entitled to. The tax amnesty for small businesses was introduced in July 2006 to provide an opportunity to small businesses which were not up to date with their tax affairs, to regularise their tax affairs. Small businesses had to meet certain requirements and pay an amnesty levy ranging from 2 to 5 percent of their taxable income. The tax amnesty on small businesses was not as effective as intended, however a slight increase in the South African taxpayer base was achieved. The voluntary disclosure programme has recently been introduced in November 2010, to provide an opportunity for all businesses to voluntarily disclose their previous defaults without being subjected to criminal prosecution and penalties. The government further attempted to simplify the tax compliance process by introducing turnover tax legislation. The turnover tax provides for a single tax system that does away with the need to account for normal tax, capital gains tax, secondary tax on companies and value added tax. The turnover tax system is optional to qualifying small businesses. The turnover tax is calculated by simply applying a tax rate to taxable turnover. Small businesses need carefully consider whether turnover tax will be beneficial to them. It is not advisable for small businesses that are making losses to adopt turnover tax. Another small business tax legislation that promises to be effective is the venture capital incentive. This legislation provides for deduction of expenditure actually incurred in the acquisition of shares by qualifying businesses. It appears that, given the challenges that small businesses still face, the government still has a lot more to do to simplify the tax process for small businesses.

A household survey of livelihood strategies in Helenvale township, Nelson Mandela Bay Municipality

- Description: A household survey of Helenvale Township in Port Elizabeth was conducted in order to gain an understanding of the strategies and activities that people in this poor community employ to sustain their livelihoods. The household profile, which entailed a survey of the household size, education levels and employment status was conducted. Dwelling units in terms of ownership, type, size, quality and building materials were also assessed. The income and expenditure of the Helenvale residents and community assets, as well as access to basic services were also assessed. The study found that the household size varied between 5 and 7 members. A more or less even distribution of the gender of household heads was noted, with 48 percent and 50 percent female male respectively. Among the HHs surveyed, no member had a higher qualification than Matric and quite a number were illiterate. Unemployment which stands at 54 percent was identified as the most serious problem plaguing Helenvale. A high level of home ownership (84 percent) was noted; of which 79 percent are formal dwellings and typically two-room structures of poor quality. Helenvale residents are largely dependent on child support grants as the major source of income. Casual jobs and disability grants are the other important sources of income identified. Human assets in the form of labour power are the most important assets that the community possesses. Physical assets are negligible, while financial ones are non-existent among all the respondents. Television and electric kettles are the most commonly owned appliances in the households. - Description: A household survey of Helenvale Township in Port Elizabeth was conducted in order to gain an understanding of the strategies and activities that people in this poor community employ to sustain their livelihoods. The household profile, which entailed a survey of the household size, education levels and employment status was conducted. Dwelling units in terms of ownership, type, size, quality and building materials were also assessed. The income and expenditure of the Helenvale residents and community assets, as well as access to basic services were also assessed. The study found that the household size varied between 5 and 7 members. A more or less even distribution of the gender of household heads was noted, with 48 percent and 50 percent female male respectively. Among the HHs surveyed, no member had a higher qualification than Matric and quite a number were illiterate. Unemployment which stands at 54 percent was identified as the most serious problem plaguing Helenvale. A high level of home ownership (84 percent) was noted; of which 79 percent are formal dwellings and typically two-room structures of poor quality. Helenvale residents are largely dependent on child support grants as the major source of income. Casual jobs and disability grants are the other important sources of income identified. Human assets in the form of labour power are the most important assets that the community possesses. Physical assets are negligible, while financial ones are non-existent among all the respondents. Television and electric kettles are the most commonly owned appliances in the households. Most automotive Original Equipment Manufacturers (OEMs) have made some attempt at KM initiatives, and these attempts have been well-documented. However, among the automotive component suppliers, limited evidence exists of attempts at KM (Piderit, 2007). No standard KM application framework could be established in the literature for industry practitioners in automotive component manufacturers within the Eastern Cape. The aim of this research study is therefore to develop a framework for the application of KM in automotive component manufacturers within the Eastern Cape. Another Japanese car manufacturer, Honda, which has also been practising the principles of lean avidly during the last few decades, has also made huge strides towards becoming a dominant force in the car market. These Japanese companies‟ adoption of lean has seen many of their mass producing United States (US) and European counterparts struggle for survival. Maynard (2003:10) predicted that by the end of the decade, at least one of the „Big Three‟ auto makers in the US – Chrysler, Ford, and General Motors (GM) – would be forced to undertake significant restructuring to continue in operation. At the time of this writing all indications are that this prediction will come true. GM is in the process of major shareholding restructuring in an attempt to keep the company afloat, having run up insurmountable debts in the face of the current global economic downturn. Adopting the lean methodology has become a matter of necessity. The continued use of mass production methods alone is no longer viable; companies need to also employ lean methods intelligently in order to remain competitive. This study is regarded as a crucial endeavour to assist operations managers of manufacturing concerns in developing lean implementation strategies which will maximise the benefits to the organization.

This is a case study on a skills development project that has been implemented with the aim of alleviating poverty through equipping people with productive skills. The study was conducted in Lephalale, Limpopo province. It was conducted during July and August 2011. The study focuses on skills development as a poverty alleviation strategy because developing skills is essential for building human capacity. The study evaluates the effectiveness of skills development within a community that is characterised by lack of education and skills. Many rural communities fail to apprehend education and skills as a result of their location and poverty. They are isolated from cities and towns and this has an impact on their surrounding conditions including the level of skills and education. The study found that the skills development project in Lephalale played a vital role of developing skills through training community members with the skills necessary to obtain jobs and be able to create self-employment. Creating self-employment is one way to address the challenges of unemployment and the lack of income. There research found that there are various job opportunities being created in the area, however the local community cannot participate due to lack of skills required in the labour market. The study revealed the majority of the people who joined the skills development project did not complete grade 12 and have never worked.

- Description: The conventional approach to increasing economic growth - increasing inputs, such as labour and capital, is not always possible. The wider, fundamental sources of economic growth need to be considered too. Foreign aid is a temporary lifeline and does not spur economic growth. Conversely, financial assistance negatively affects growth and can hamper development prospects. Economic freedom and economically freer countries have been associated with higher growth rates, higher per capita incomes, greater volumes of trade, prosperity and overall wellbeing. By improving their economic freedom, deregulating the economy and allowing economic freedom to prosper, countries can experience sustained GDP growth. Previous studies have shown that economic freedom and economic growth are exponentially related - and that by initially becoming freer, countires can increase their growth rates at higher rates. The main objective of the SADC is to achieve development and economic growth, to alleviate poverty and enhance the standard and quality of life for the peoples of Southern Africa. The SADC is attempting to achieve economic integration through macroeconomic convergence. A number of macroeconomic variables have been set to act as primary indicators. These include inflation, fiscal balance, public debt and the current account balance. By introducing the concept that economic freedom can lead to higher growth rates and being able to identify economic freedom, it makes it possible to investigate how the SADC can achieve its set goals by becoming freer. By investigating individual components that constitute the overall freedom index, it becomes possible to establish the relationship that exists between this viriable and economic growth. This will illustrate where deregulation and freedom are most effective and where policy decisions need to be highlighted. The 2008 economic crisis revealed that countries that decreased their economic freedom have fared worse than countries allowing freedom to prosper. Government fiscal stimulus has had no positive impact on growth rates; the negative effects of reducing economic freedom will onlky be fully seen in future years. However, the majority of the SADC countries showed a relatively strong fiscal stance during the recession. This study established whether that a positive relationship between economic freedom and economic growth in the SADC. Secondly, the direction of causality that economic freedom leads to economic growth. The findings reveal that economic freedom fosters economic growth in general, and for the SADC in particular. Empirical evidence has been found for the SADC; and the implications of becoming freer are more fully explained.

The depletion of known fossil fuel reserves and the volatility of international fuel prices require that society looks beyond the current coal-dominated electricity generation methods. Wind energy is an internationally well-established technology with large markets in major countries around the world, such as the USA and Germany. South Africa has the potential to generate large amounts of electricity from the wind because of the strength of the country’s wind resource. The long coast line and open areas are ideal for the exploitation of wind energy. A wind farm project has been proposed for development near the town of Jeffrey’s Bay, in the Eastern Cape. The proposed project involves the construction and installation of a 15MW wind farm, consisting of 6-10 turbines standing 120m tall, over an area of 20ha.There are indirect costs and benefits (externalities) associated with a wind farm project and it is important that projects such as these are evaluated from a social standpoint. The aim of this study was to determine the compensation required by residents for siting a wind farm in their area. This compensation was then used as a component of an overall evaluation of the project.

However, recent service delivery reports in the Daily Dispatch and its sister publication Go & Express as well as service delivery protests across the country (including BCM) indicate all is not well. Many hypothesises have been raised as to why municipalities continue to under-perform. However, beyond these hypothesises is customer care management, and its constituents of customer service, complaint management and call centre activities. Customer care in the public sector has long been seen as the work of front-line staff. Others believe it is irrelevant in the public service due to the non-competitive nature of public service. Batho-Pele principles, since its inception in the public sector in South Africa, have been drummed up to put people first. Weary citizens see it differently and this has not escaped Buffalo City Municipality (BCM). BCM, one of the pioneers in the South African local government to have initiated customer care, admits there is institutional inefficiency. The primary objective of this study is to evaluate the effectiveness of customer care management at BCM. In doing so; the study has narrowed the study to: describing the practice of customer care and customer care management in the public sector ( BCM included), establishing the components that constitute an integrated customer care management programme at BCM, investigating and describing the conceptual understanding of customer care and customer care management at BCM, and exploring and describing the role vision and values statements play in rendering a successful customer care programme at local government level with BCM as the focal point.

- Description: South Africa’s economy is in a phase of transformation. As part of this process, the South African government has identified the development of economic activities amongst previously disadvantaged black communities. However, this noble intent is challenged by a lack of entrepreneurial skills, which are seen as important elements in the economic development effort and necessary to achieve transformation goals and objectives (Smith, 2004). Since the apartheid era, South Africa has seen the emergence of two distinct economic sectors: a first world economy, consisting mostly of white owned and formal businesses, and a third world economy, consisting of mostly black owned and informal businesses. Economic activities of emerging entrepreneurs have been restricted to mostly the black townships and rural areas, whereas first world entrepreneurs have been actively involved in mainstream economic activities. The separation of emerging and first world entrepreneurs has resulted in a wide gap in entrepreneurial and technical skills and knowledge between the two. This imbalance has maintained a situation in which the minority of the population controls more than 80 per cent of the wealth of the country. Upon gaining independence in 1994, the new South African government embarked on the Reconstruction and Development Programme (RDP) to redress the imbalances of the past (GEM, 2001; GEM, 2002). The government has since also adopted the Growth Employment and Redistribution (GEAR) macroeconomic strategy to grow the economy, create employment and redistribute wealth. To accelerate the implementation of GEAR, the government has passed a number of Acts, namely: The National Small Business Promotion Act (102/1996), Skills Development Act (97/1998), Affirmative Procurement Act (5/2000), Mineral and Petroleum Resources Act (28/2002) and, most recently, the Mining Charter (2003), Petroleum Charter (2003), Financial services Charter (2003), and the Information Communications Technology (ICT) Charter (2004). Small business has been seen by government as a vehicle to create employment, promote economic growth and redistribute wealth; as such the promotion of entrepreneurship has been identified as a critical aspect of GEAR. However, despite supportive legislation and programmes, South Africa’s entrepreneurship rating remains below average, as evidenced by the findings of the Global Entrepreneurial Monitor reports (GEM, 2001; GEM, 2002). The wide gap in skills and knowledge between emerging and first world entrepreneurs in South Africa is a contributing factor to the country’s poor rating – and it is expected to widen as the new knowledge economy unfolds, if corrective measures are not taken by the government or private sector.

As part of this process, the South African government has identified the development of economic activities amongst previously disadvantaged black communities. However, this noble intent is challenged by a lack of entrepreneurial skills, which are seen as important elements in the economic development effort and necessary to achieve transformation goals and objectives (Smith, 2004). Since the apartheid era, South Africa has seen the emergence of two distinct economic sectors: a first world economy, consisting mostly of white owned and formal businesses, and a third world economy, consisting of mostly black owned and informal businesses. Economic activities of emerging entrepreneurs have been restricted to mostly the black townships and rural areas, whereas first world entrepreneurs have been actively involved in mainstream economic activities. According to research, approximately 30% of businesses fail due to matters related to succession planning (Grote, 2003). Further research indicated that approximately 50% of family businesses do not have adequate succession plans in place. Hence, family businesses are exposed to significant risk in sustainability due to insufficient succession planning. An effective approach to succession planning in a family business increases the chance of success of a family business in both the short and long term. The purpose of this study was to develop a better understanding of approaches to succession planning in two family businesses in East London, South Africa. This purpose was to improve the commercial viability of family businesses and improve the body of knowledge from an academic perspective. To this end, a detailed literature study was conducted on family businesses and succession planning. A qualitative case study research paradigm was implemented to ascertain the nature of the approaches adopted by the two businesses. An interview process was conducted with the incumbent founders (fathers) and successors (sons) of the family business. This process suggested that each business requires a unique approach to succession plan which may include aspects of formal and informal processes. It is necessary to understand the nature of the family business, its interrelated relationships and context to adequately determine the success of a succession approach. It is for this reason that families aspiring long term sustainability should invest in effective succession planning approaches that integrate the nuances of the individual family business.

Since 1994, the country has experienced a huge influx of immigrants from other parts of the continent some escaping from dire living conditions in their home countries and looking for better life opportunities while many others were forced to migrate from their own countries as a result of political unrest and lack of stability and security. Among these later example is the Somali community who are the subject matter of this study. Many of these mainly African immigrants including Somalis got involved themselves in the informal sector of the South Africa. This has increased the competition in this sector and caused clashes between South Africans and immigrants who were also involved in the sector. This study examines the involvement of the Somali immigrants in South Africa’s informal sector. The study is exploratory in nature and tried to find the surrounding factors that impacted on the involvement of Somalis in the informal economy of Motherwell. The study has found that Somalis who arrived in Motherwell are generally young unmarried men who were attracted to the area mainly because there were affordable business opportunities in the township. Somalis financed their businesses through various resources including their savings from working while working inside and outside South Africa and from the contributions by their families and friends. Despite facing high levels of crime where many Somalis were killed and their property looted, they are still determined to stay in the township. This can be shown by their high level of savings and their intention to invest in the township. Although this research does not aim to be comparative in nature, personal and business characteristics of Somalis as well as South Africans who are also involved in the sector vii were compared. Because of this comparison, it has became clear that though price is an important factor in the business competition between the two groups, it is not the only factor, neither the most important, that creates friction and the shift of loyalty of customers from one side to another. Quality of service, the number of the people working in the business, responsibility towards the area the business serves, the strictness or the leniency towards customers who want to buy but are short of money and many other factors created a friendly atmosphere between the businesses run by the Somalis and their customers. The study showed that some of the Somali as well South African business owners were of this view. Although the vast majority of the Somalis have a minimum level of education, they still contribute positively to the economy of the township and the greater Nelson Mandela Bay. This is done through renting business premises, paying both direct and indirect taxes and taking the business services to remote areas of Motherwell. The study suggests that there is a need to sooth the relationship between the two groups particularly between Somalis and South Africans who are involved in grocery businesses through meetings, seminars, and other get-together activities. This can be done by South African Police Service, Somali Association of South Africa in Korsten, community elders from both sides and other concerned government institutions as well as the academic institutions particularly Nelson Mandela Metropolitan University. The business skills of both groups need to be uplifted in order to maximise their profitability and contribution to the people in the area.

The study was based on the projects identified by the community of Amajuba district in Dannhauser area in KwaZulu Natal. The Dannhauser Municipality in partnership with the Department of Agriculture and Environmental affairs have played a vital role in this regard by supporting the establishment of the Thuthukani project in 2004. In an attempt to assess the impact of the poverty alleviation projects, this study investigated the role played by the Thuthukani project in local economic development of the Dannhauser community in the Dannhauser Municipality. Regulatory compliance is one of the significant industry drivers for pharmaceutical companies. Regulations are enacted by government authorities to ensure public health and safety. The focus of regulation is on quality assurance and control in all areas such as receiving, manufacturing, storing, packaging, despatching and delivering. Apart from the required quality and safety checks, the regulations also mandate extensive record keeping of procedures, processes and systems. This treatise will investigate the maintenance management system of a pharmaceutical company and compare it to best practices. The true name of the pharmaceutical company that will be researched will not be disclosed for confidentiality reasons, instead it will be called My Pharmaceuticals. The company is based in Port Elizabeth. The research consists of a preliminary study to identify the problem areas in the maintenance management system within the company. A literature review of best practices in maintenance management systems combined with an investigation into the best pharmaceutical practices in maintenance management systems and regulatory controls are investigated and a model will be proposed to improve the current situation at the company.
