- This paper examines the workplace implications of the legalisation of private cannabis use in South Africa following the landmark Constitutional Court judgment in Minister of Justice and Constitutional Development v Prince.1 The judgment has necessitated a re-evaluation of workplace policies regarding cannabis consumption, which brings to the fore the tension between workplace safety and individual rights. Through a detailed analysis of relevant case law, this treatise distils emerging principles for disciplinary action and emphasises the necessity for equitable workplace policies that uphold employees’ rights to privacy and dignity. It also addresses the regulatory gaps that persist and proposes a set of best practices in policy development which are aligned with the Occupational Health and Safety Act.2
