- For many years businesses have been capitalising on the benefits that employees employed on a temporary basis through temporary employment services (labour brokers) has had to offer in terms of labour flexibility. Following the passing of the amended Labour Relations Act of South Africa in early 2015, much attention has been given to section 198 as this section aims to further regulate the use temporary employment. The main objective of this paper consists in studying the impact that the recent amendments to section 198 of the Labour Relations Act have had on labour flexibility in the Nelson Mandela Bay automotive component manufacturing industry. The paper examines how businesses have historically benefitted from the use of temporary labour, how these benefits are slowly being removed, and how businesses are responding to mitigate the risks associated with this legislative change whilst becoming compliant. As the topic being researched is still very recent, with certain legal aspects remaining to be fully tested in the courts, it is hoped that that this study will provide sufficient information to assist all the stakeholders of businesses to make more informative decisions in the future.
