- Description: One of the invariable consequences of divorce is that the patrimonial assets of the marriage have to be divided up between the two parties. At a primary level, the way in which this will occur will be determined by a number of factors: the matrimonial property regime under which the parties had been married; the relevant provisions of the Divorce Act (Act 70 of 1979) that deal with the question of the patrimonial consequences of divorce; as well as any agreement on this often ticklish matter that can be reached by the parties prior to the divorce action. Approximately fourteen years ago, section 7 of the Divorce Act was amended to allow a divorced spouse to share in the pension interests of the other spouse. There is some polemic, though, as to the interpretation of this provision: in particular, it is not clear whether this pension benefit will automatically form part of the assets that are susceptible to division, or whether a prayer to this effect must specifically be sought. After a consideration of the current legal position regarding the sharing of pension benefits generally, this note will examine this specific debate.

- Description: Selling traditional craft products made from fibrous plants is an important source of income for economically vulnerable rural women. In the Eastern Cape Province of South Africa, Cyperus textilis and Juncus kraussii have been used for centuries to make products of functional and cultural importance, such as sleeping mats and baskets. In the former Transkei village clusters of Mpozolo and Ntubeni, female crafters harvest the raw material and make and sell the products in their communities and in nearby towns. Interviews with 40 of them revealed what the trade contributes to their livelihoods and what enhances or limits their success. The findings show that crafting contributes vital income to vulnerable households, on average 26 ± 4 per cent of annual household cash income, over 40 per cent for the poorest households and 5–15 per cent for wealthier households. Lack of access to non-traditional markets was identified as the main constraint on the trade.

- Description: Fuelwood is the primary energy for most households throughout the developing world. With increasing urbanization and declining local availability of fuelwood, a growing proportion of households obtain their fuelwood by purchasing it. These fuelwood markets are the key nexus in supply and demand scenarios and can be potentially significant points for intervention to address energy security amongst the urban poor. This paper reports on the fuelwood demand and marketing in a small town in South Africa. Despite the availability of more modern fuels and state subsidization of electricity, fuelwood was still used by half the households. Annual demand was 1.2 t per household. Over half of the households bought their fuelwood requirements because local stocks were limited. Those households that did collect their own fuelwood were significantly poorer than households that purchased fuelwood, as well as households that did not use fuelwood at all. Fuelwood markets operated through 45-60 vendors who transported fuelwood from further afield. Income from the fuelwood trade was low, but was strongly linked to hours worked. Thus, vendors working a full week did earn a meaningful income, especially in the context of high unemployment in the area. Fuelwood vendors also provided casual employment opportunities for unskilled labour. Most vendors harvested fuelwood from commonage lands, with most of the wood being from alien species. Local stocks of wood are declining in the face of constant transformation of commonage to residential areas, and a national water and biodiversity conservation programme to eradicate alien plants. This decline poses a threat to the financial viability of fuelwood markets. Yet, an opportunity exists to incorporate the vendors into the alien plant clearing programme, since they already perform such a function.

The CO release was monitored by following the modifications of the UV-visible features of MbFe(II) in phosphate buffer solution and the redox features of reduced Hemin, HmFe(II), confined at the surface of a vitreous carbon electrode. In the latter case, the interaction between the hemin-modified electrode and the released CO was seen through the observation of an increase of the reduction current related to the FeIII/FeII redox process of the immobilized porphyrin. While the ruthenium-based complex, ([Ru(CO)3Cl2]2), depended on the presence of Fe(II) species to release CO, it was found that the chromium-based complex released spontaneously CO. This was facilitated by illuminating and/or simple stirring of the solution containing the complex.

- Description: This article examines the practical adequacy of the recent defining of a normative framework for the South African National Curriculum Statement that focuses on the relationship between human rights, social justice and a healthy environment. This politically framed and socially critical normative framework has developed in response to socio-political and socio-ecological histories in postapartheid curriculum transformation processes. The article critically considers the process of working with a normative framework in the defining of environmental education teaching and learning interactions, and seeks not only to explore the policy discourse critically, but also to explore what it is about the world that makes it work in different ways. Drawing on Sayer’s perspectives on the possibilities of enabling ‘situated universalism’ as a form of normative theory, and case-based data from a teacher professional development programme in the Makana District (where the authors live and work), the article probes the relationship between the establishment of a ‘universalising’ normative framework to guide national curriculum, and situated engagements with this framework in/as democratic process. In this process it questions whether educators should adopt the ‘norms’ as presented by society and simply universalize and implement them as prescribed by curriculum statements, or whether educators should adopt the strategies of postmodernists and reduce normative frameworks to relations of power situated in particular contexts.

- Description: Agroforestry tree domestication emerged as a farmer-driven, market-led process in the early 1990s and became an international initiative. A participatory approach now supplements the more traditional aspects of tree improvement, and is seen as an important strategy towards the Millennium Development Goals of eradicating poverty and hunger, promoting social equity and environmental sustainability. Considerable progress has been made towards the domestication of indigenous fruits and nuts in many villages in Cameroon and Nigeria. Vegetatively-propagated cultivars based on a sound knowledge of ‘ideotypes’ derived from an understanding of the tree-to-tree variation in many commercially important traits are being developed by farmers. These are being integrated into polycultural farming systems, especially the cocoa agroforests. Markets for Agroforestry Tree Products (AFTPs) are crucial for the adoption of agroforestry on a scale to have meaningful economic, social and environmental impacts. Important lessons have been learned in southern Africa from detailed studies of the commercialization of AFTPs. These provide support for the wider acceptance of the role of domesticating indigenous trees in the promotion of enhanced livelihoods for poor farmers in the tropics. Policy guidelines have been developed in support of this sustainable rural development as an alternative strategy to those proposed in many other major development and conservation fora.

- Description: The paper reviews education activities in a successful anti-cholera campaign amongst rural communities in eastern southern Africa. It is centred on probing how a modern institutional governmentality was relatively blind to an historical legacy of Nguni hand-washing practices and came to exclude use of simple tests for coliform contamination in rural health education activities. The study examines institutional processes, probing discontinuities between the health education message and the complex social ecology of cholera. In so doing, it uncovers how a post-apartheid institutional rhetoric of participation, empowerment and social transformation is playing out in communicative interventions to instil healthier practices amongst the rural poor. Institutional perspectives such as this are rooted in an institutional legacy of appropriation and control. Despite the current rhetoric of participation, instrumental orientations are being sustained as the radical critique of struggle for freedom and change gives way, through comfortable submission and intellectual conformity, to an instrumental conservatism in many post-apartheid institutional settings today. The study notes and probes a surprising resonance between the ecology of the disease and an intergenerational social capital of indigenous hand-washing practices. The evidence suggests that these patterns of hand-washing practice would have served to contain the disease in earlier times and points to this social capital as a focus for co-engaged action on environment and health concerns. The findings suggest that an opposing of institutional and indigenous knowledge is not a simple matter and that moving beyond a legacy of cultural exclusion and marginalisation remains a challenge as the first decade of post-apartheid democratic governance comes to a close.

- Description: This paper outlines the general characteristics of customary sea tenure (CST) in Oceania and identifies areas in which these characteristics overlap with modern rights-based fisheries management systems such as ITQs and CDQs. It also examines the effectiveness of CST regimes at regulating marine resource use and access by focusing on a particular case from the Solomon Islands. The institutional robustness or vulnerability of CST is assessed by examining various performance criteria for two communities in the Roviana Lagoon, Western Solomons. These criteria include people’s (1) settlement patterns in relation to their property, (2) cultural consensus, (3) cultural attitudes with regard to governance and management, and (4) fishing efforts and yields. The results show that a number of historical processes have shaped CST systems into heterogeneous and dynamic institutions, and that CST regimes can vary even on small geographical scales. Understanding the circumstances in which CST regimes are more likely to be successful has facilitated the design and implementation of co-management fishery prescriptions (MPAs) for protecting particular species and habitats in the region. More generally, the paper proposes that by discerning the effectiveness of local governance institutions at regulating resource use and access – taking into consideration that these are embedded in particular historical and political contexts – we can better predict whether or not an introduced fishery management system will work. This knowledge can also assist in designing hybrid management schemes that cross-fertilize community-based management, modern rights-based fishery management (e.g., ITQs and CDQs), and other government regulations. This integration is particularly relevant when these policies are to be implemented in coastal communities that have or have had traditional rights-based fishery management systems of their own and/or are more socio-culturally homogeneous. Given the long history of failed fishery management, it is now of vital importance to design innovative fishery management prescriptions that integrate natural and social science research more comprehensively.

- Description: The photophysical and photochemical properties and quenching (by 1,4-benzoquinone) of metallophthalocyanine sulfonates of aluminium (AlPcSmix), zinc (ZnPcSmix), silicon (SiPcSmix), germanium (GePcSmix) and tin (SnPcSmix) are presented. The quantum yield values of fluorescence (ΦF), triplet state (ΦT), singlet oxygen (ΦΔ) and photodegradation (Φd) were determined and the observed trends in their variation among the complexes discussed in terms of aggregation and the heavy atom effect. 1,4-benzoquinone effectively quenched the fluorescence of the complexes. Quenching analyses gave positive deviations from Stern-Volmer behavior, suggesting the existence of static quenching in addition to dynamic quenching. The static and dynamic components of the quenching were separated using a modified Stern-Volmer equation and the “sphere of action quenching model”. The quenching constant was found to be a function of the radius of the central metal ion.

- Description: Electrocatalytic oxidation and detection of hydrazine in pH 7.0 conditions were studied by using gold electrode modified with self-assembled monolayer (SAM) films of iron phthalocyanine (FePc) complex axially ligated to a preformed 4-mercaptopyridine SAMs. The anodic oxidation of hydrazine in neutral pH conditions with FePc-linked-mercaptopyridine-SAM-modified gold electrode occurred at low overpotential (0.35 V versus Ag|AgCl) and the treatment of the voltammetric data showed that it was a pure diffusion-controlled reaction with the involvement of one electron in the rate-determining step. The mechanism for the interaction of hydrazine with the FePc-SAM is proposed to involve the Fe(III)Pc/Fe(II)Pc redox process. Using cyclic voltammetry (CV) and Osteryoung square wave voltammetry (OSWV), hydrazine was detected over a linear concentration range of 1.3 × 10−5 to 9.2 × 10−5 mol/L with low limits of detection (ca. 5 and 11 μM for OSWV and CV, respectively). At concentrations higher than 1.2 × 10−4 mol/L the anodic peak potential shifted to 0.40 V (versus Ag|AgCl), and this was interpreted to be due to kinetic limitations resulting from the saturation of hydrazine and its oxidation products onto the redox-active monolayer film. This type of metallophthalocyanine-SAM-based electrode is a highly promising electrochemical sensor given its ease of fabrication, good catalytic activity, stability, sensitivity and simplicity.

- Description: There is a growing commercialization of non-timber forest products (NTFPs) as a means of livelihood by rural communities throughout the developing world. This often occurs in the absence of any clear understanding of or guidelines regarding sustainable yields and ecological impacts, which may undermine the success of NTFP enterprises, especially from arid regions. This paper reports on the use of size class profiles and three quantitative indices to examine population profiles of five potentially useful tree species used as NTFPs in the semiarid lowveld of South Africa. We also contrast the population densities of the five tree species in 2003 with data from 1992. Low stem densities and population profiles indicated that three of the five species would preclude the establishment of NTFP enterprises based on their products. The other two species seem to have sufficient densities for some harvesting to take place, within an adaptive management framework. However, the longitudinal data indicated that the density of both these species had significantly declined over an eleven-year period, highlighting the need for appropriate management institutions. Additionally, the proportion of mature stems cut, and the degree of cutting per stem, had increased for all five species over the eleven years. The three quantitative indices of population stability were not correlated with one another, and hence provided a useful suite of measures sensitive to different aspects of size class profiles and their interpretation.

- Description: Cobalt tetrasulfophthalocyanine (CoTSPc) was used to catalyze the oxidation of 2-chlorophenol (2-CP) and 2,4,5-trichlorophenol (TCP) using hydrogen peroxide (H2O2) as the oxidant. This CoTSPc catalyzed hydrogen peroxide oxidation of chlorophenols resulted in the formation of different types of oxidation products depending on the solvent conditions. In water/methanol conditions (where CoTSPc is mainly monomeric, and unionized forms of the phenols), phenol and hydroquinone were the main oxidation products, while in phosphate buffer solutions (pH 7 and 10 for TCP and 2-CP, respectively, where CoTSPc is mainly aggregated, and ionized forms of the phenols), benzoquinone was the main product. In contrast to CoTSPc, other MTSPc complexes studied (AlTSPc, CuTSPc and NiTSPc) exhibited no detectable catalytic effect on the oxidation of chlorophenols under the experimental conditions employed, thus proving the effect of the central metal ions on efficient catalysis of chlorophenol. Reaction pathways are proposed based on the relative time of oxidation products formation.

The results show that melatonin produces radicals upon laser irradation while the lamp photolysis studies show that melatonin is able to scavenge singlet oxygen produced by naphthalene. While melatonin is a free radical scavenger under biological conditions, it acts as a generator of singlet oxygen and or radicals (as ΦΔ is 1.41) when irradiated with laser light, implying that it has the potential to be used in photodynamic therapy in the destruction of tumors.

- Description: This paper emerges out of a panel discussion during a PhD week and subsequent 8th International Environmental Education Invitation Seminar held at Rhodes University in 2004 and 2005 respectively. It illuminates some insights into our struggles (as novice African researchers) in trying to respond to contextual realities as we research education and social change in African contexts, seeking insight into what counts as legitimate research in this context. The paper considers our struggles at conceptual, methodological, analytical and data generation levels, and in a politics of research. This is done by means of examples drawn from five current doctoral research projects being undertaken in east and southern African regions, using a review framework that represents fairly common dimensions of PhD research. We conclude that research, when defined rigidly within research disciplines/paradigms (as have been defined in some – primarily Western – research trajectories) may fail to take into account African social and contextual realities when applied uncritically. We argue that there is need for researchers in Africa to consider a multiplicity of approaches if research is to be meaningful in, and responsive to, social and contextual realities. In particular, we argue for taking account of socio historical and socio-cultural contexts in creating African epistemology in and through research.

Modelling the sustainable harvest of Sclerocarya birrea subsp. caffra fruits in the South African lowveld

- Description: Levels of commercialization, size class profile and fruit production of Sclerocarya birrea (marula) trees were studied in the Bushbuckridge region of South Africa. A stage-based population matrix model was used to estimate the sustainable yield for S. birrea fruit. The trees begin to bear fruit at an average size of 42.8 cm in circumference and this relates to an approximate age of 19 years. For a stable size class profile, the population growth rate, λ, was 1.1828758. The observed size class profile did not conform to the stable stage size class profile, obtained from the model. Thus, it was not possible to predict the state of the observed population. Using the model, it was estimated that 92% of fruit could be removed without impacting the current population profile. The management of other more destructive forms of S. birrea resource use (such as bark or firewood harvesting), however, do need to be monitored to limit negative impacts on the population that may reduce fruit availability for regeneration or cropping.
