A comparative analysis of the development of performers' rights in the United Kingdom and South Africa

- Description: Although performers have been rife for centuries, no legal regime was required for their protection owing to the fact that the nature of their performances was transitory. It was not until the invention of the phonogram in 1877, that the need to provide performers with the means to protect the unauthorised uses of their performances became an issue. The subsequent development of performers' rights has been fuelled by the rapid technological developments of the modern age which has prompted the international community to respond through various international instruments. Performers initially sought protection in terms of the Berne Convention in 1886, but it was not until the Rome Convention in 1961 that performers were first accorded international recognition. This was followed by the TRIPs Agreement in 1994 and the WPPT in 1996. This work involves an investigation into the historical development of performers' rights in the United Kingdom and South Africa. This is followed by a comparative analysis of the current state of performers' rights as between the United Kingdom and South Africa with a view to proposing recommendations for improving the level of protection accorded performers in South Africa. Arguments in favour of a regime of performers' rights as well as possible counter-arguments have been advanced. The general development of performers' rights as a related or neighbouring right to copyright is focussed on. The development of performers' rights in the United Kingdom is discussed with reference to the first English legislative form of protection, namely the Dramatic and Musical Performers' Protection Act, 1925. This Act only provided performers with criminal remedies, a view that prevailed through several subsequent enactments designed to protect performers as a result of ratification of the Rome Convention. It was not until 1988 when the decision in Rickless v United Artists Corp prompted the legislature to grant performers with enforceable civil remedies through the enactment of the Copyright, Designs and Patents Act, 1988. Several European Union Council Directives aimed at harmonising the law relating to performers' rights throughout the Union were issued, mainly in response to the TRIPS Agreement. In order to comply with these Directives, the United Kingdom passed Regulations to bring about the necessary amendments to the Copyright, Designs and Patents Act. Performers in the United Kingdom were granted moral rights in 2006 as a result of the United Kingdom's ratification of the WPPT. The development of performers' rights in South Africa has been slow when compared to that of the United Kingdom. It was not until 1967 that performers were first legally recognised in South Africa. Although South Africa has yet to ratify the Rome Convention, it was stated in South African Broadcasting Corporation v Pollecutt that the Act was clearly passed with a view to complying with the Convention. South Africa's ratification of the TRIPs Agreement brought about amendments to the Act, particularly regarding the duration of protection which was increased from 20 to 50 years. Although South Africa played an active role in the conclusion of the WPPT, it has yet to ratify it. However, amendments were made to the Act in line with this Treaty, such as the incorporation of “expressions of folklore” within the ambit of protection, and the granting of a right to receive royalties whenever a performer's performances are broadcast. This is commonly known as needletime. South Africa's reluctance to grant performers with moral rights as provided for by the Treaty is noteworthy. The introduction of needletime into South African law has resulted in a fierce debate between collecting societies (who represent authors and performers) and the NAB (who represent users of performances). Mainly as a result of this dispute, performers in South Africa have, to date, not received any royalties due to them. The protection of traditional knowledge has also received attention of late with the Intellectual Property Laws Amendment Bill, 2010 which aims to bring traditional knowledge inter alia within the ambit of the Performers' Protection Act. The current state of performers' rights in the United Kingdom and South Africa are compared in order to identify ways in which the level of protection accorded performers in South Africa could be improved. The Copyright, Designs and Patents Act is compared with the Performers' Protection Act through emphasis being placed on the definition of a “performer”; the definition of a “performance”; the nature of performers' rights; exceptions to infringement; the term of protection; the retrospectivity of the legislation; and the enforcement measures in place. Upon analysis, it was found that the Performers' Protection Act can be amended in several ways in order to increase the level of protection accorded performers in South Africa.

- Description: This thesis investigates the presentation of AmaXhosa traditional dancing and music on the stages of the National Arts Festival (NAF), Main Programme, of South Africa in 2009. Four productions featuring AmaXhosa traditional dancing and music, as well as a fine art exhibition, are analysed to determine how the AmaXhosa culture is being portrayed, what is considered authentic and how these productions may affect the memory of the AmaXhosa nation. In an attempt to understand the position of these productions within the NAF the South African cultural context as well as the NAF is examined. The post-apartheid, post-rainbow nation, South African cultural context is discussed and how the NAF could contribute towards creating a more unified South African identity. Incorporated and inscribed memory categories are related to how one could determine authenticity in traditional indigenous productions. A cautionary note on incorporated memory is linked to efficacy, while a loss of incorporated memory within the AmaXhosa society may result in ritual acts being orientated towards entertainment. If the private culture is consistently displayed in the public realm then it is inevitable that the ways in which the AmaXhosa recollect their history will be altered. The contribution of the transitional spaces of theatres and proscenium arch stages to the choreography and incorporated memory of the performers relates to the collective recollection of the AmaXhosa. Bearing this in mind, this thesis suggests that the NAF is playing a dual role in the evolution of the AmaXhosa. It is both positively contributing to the economic upliftment of a sector of the population and exposing people to this rich and multilayered culture. However, it is also impacting the efficacy of the private culture and fracturing the traditional knowledge of the AmaXhosa by assisting in the inscription of their performance forms. , This thesis consists of three parts (1 pdf document and two video mp4 files)

- Description: This study seeks to investigate the underlying ideologies and practices behind the perception that women who are in command positions are unable to command and control, especially those who are in the operational environment. The study was executed in the Eastern Cape Province (Eastern Cape), in Buffalo City Metropolitan Municipality (BCM). The research participants (respondents) were constituted by 33 police officers from diverse police stations within the BCM. The participants were divided according to gender, i.e. 24 females and 9 males. With regards to objectives of the study, the aim was to investigate the following issues: i) to understand factors that make women not to be accepted in their positions as SAPS' operational commanders, by their male subordinateslcolleagues and community members. ii) To understand factors that make women not to be accepted in their positions as SAPS' operational commanders, by their male subordinates/colleagues and community members, and iii) to explore strategies to utilize in making SAPS' women operational commanders, survive while managing their day-te-day respective units/components effectively and efficiently. Regarding research design, this study mainly used a qualitative research method combined with a bit of a quantitative approach. And then the data collection method involved making use of semi structured interviews to all the respondents. The results of this study show that there is still a huge difference in the number of women who are commanders compared to their male counterparts, especially in those environments that were previously regarded as male dominated. Further, despite the necessary training being provided by the SAPS to women officers, the necessary support in particular from management is still a challenge. Lastly, the argument of this study is that there is still not a fair representation of women in command positions within the SAPS, especially, in the previously male dominated environments.

- Description: Queer Transgressions: The choreographing of a male homosexual presence with reference to selected choreographers explores queer identity and in particular representations of a male homosexual presence in dance. Within the methodological framework of dance studies and queer theory I explore the ―self fashioning‖ of my male homosexual presence in dance. This is achieved by critically deconstructing my choreographic process when making choreography. Therefore this thesis is informed by both academic research and my self-reflexive experience of choreography and dance performance. The deconstruction of my autobiography and choreographic process is discussed with reference to both international and South African queer choreographers. This means that by accounting for my own experiences and approaches toward representing a male homosexual presence in dance, I explore the history and engagements of other queer choreographers also creating such representations. I therefore examine the works of selected choreographers and chart the development of the representation of a male homosexual presence in dance. By exploring the choreographic process of other queer choreographers I identify choreographic tactics that queer choreographers are using when making work. From this point of departure I shift the focus away from international queer choreographers and provide insight into the choreographic processes of South African queer choreographers. By accounting for the works and choreographic processes of South African choreographers, I provide a context in which my choreographic explorations on the subject matter can take place. This choreographic exploration manifests itself through a self-reflexive/autobiographic account on the research and practice of my choreographic process. During my choreographic exploration I set the challenge to both engage with and explore further, established ―queering tactics. - Description: The aim of the present study explores barriers to women educators’ upward mobility in the Department of Education, using the Butterworth Education District as the area of study. Women as human beings, too, have a valid case regarding recognition of their legitimate aspirations because in striving for them, they are exercising their rights similar to their male counterpart. It must also be understood that the same legislative prescripts apply to both male and female educators and the necessary intellectual and physical capacity plus skills commitment and perseverance are understood to be important criteria for promotions. The question of perception of barriers to upward mobility of women in the education department and the wider public sector in South Africa is topical and continues to engender research and policy guidelines. However, conclusive findings and solutions are far from being realised. Empirical research and other scholarly writings posit that despite a suite of legislation and policy guidelines introduced in South Africa since 1994, women continue to encounter barriers in their effort to move up their career ladder. It is argued women are under-represented in management positions in comparison to men all over the world. Unequal representation of women in public sectors, nationally, provincially and locally has illustrated the need for gender equity and mainstreaming in senior management. In research done for the Department of Education in South Africa it was also found that although the teaching environment is made up of both men and women, men in management are acceptable, but women in management experience problems not only from male employees, but from female employees as well.

- Description: The research seeks to evaluate how the South African government has conceptualised gender through the use of the concepts of WID and GAD. This research has been conducted through the analysis of the Draft Strategic Framework on Gender and Women's Empowerment a document of the Department of Trade and Industry that was formulated to address and redress the issues of gender equality. It has some sound suggestions that seek to identify strategies to improve women empowerment through financial independence. As a result they have used various approaches in order to provide strategies that are mindful of the „needs‟ of the women. Accordingly they have formulated a policy that understands who these women are and have made recommendations of strategies that different groups of women can identify with. They have included the marginalised rural and disabled women and even gone as far as catering for younger women still at school. However there has been concern at the impact that the exclusion of men has contributed, therefore it is important to find ways in which to make men more involved.

- Description: The research seeks to evaluate how the South African government has conceptualised gender through the use of the concepts of WID and GAD. This research has been conducted through the analysis of the Draft Strategic Framework on Gender and Women's Empowerment a document of the Department of Trade and Industry that was formulated to address and redress the issues of gender equality. It has some sound suggestions that seek to identify strategies to improve women empowerment through financial independence. As a result they have used various approaches in order to provide strategies that are mindful of the „needs‟ of the women. Accordingly they have formulated a policy that understands who these women are and have made recommendations of strategies that different groups of women can identify with. They have included the marginalised rural and disabled women and even gone as far as catering for younger women still at school. However there has been concern at the impact that the exclusion of men has contributed, therefore it is important to find ways in which to make men more involved.

- Description: Gender-based violence more especially sexual violence towards women is one of the biggest social issus affecting South Africa including higher institutions of learning, universities in this context. In recent years, we have seen students in universities protesting sexual violence demanding universities to improve their ways of dealing with this violence. The motivation behind this thesis is the notion that sexual violence is a women’s issue and how most men in our communities and universities do not involve themselves in campaigns that are designed to end sexual violence towards women. There is an assumption that women should be the ones fighting against sexual violence because it affects them when in fact sexual violence affects everyone and more importantly, is mostly perpetuated by men. Therefore, the main purpose of this thesis was to sociologically analyze the involvement of men in campaigns against sexual violence towards women and the aftermath of the #RUReferenceList protest that took place at Rhodes University in 2016. This protest started immediately after a list of students who were said to be alleged sexual perpetrators was published online. Attached to this primary objective, the sub-goals that informed the entire study were to investigate how the involvement of men in the #RUReferenceList protest has contributed to challenging rape culture at Rhodes University. Also, to investigate if there are any ongoing campaigns and/or projects that includes men and that are still addressing the issue of sexual violence towards women. There is however, a dearth of research on the involvement of men in campaigns against sexual violence in South Africa. Therefore, it was difficult finding existing literature that touches on the involvement of men in campaigns against sexual violence towards women particularly in the context of universities. This thesis was conducted within the premises of Rhodes University through a qualitative research approach in a form of in-depth interviews. Five participants were selected through purposive sampling which included the Chair of the Gender Action Forum, one former student representative council member, a sub-warden from a male residence and two students. The findings of this research are not the full representation of the entire university but opinions and perspective of the participants that were interviewed. Their opinions and perspectives have a potential of contributing to the factors and reasons as to why majority of men have not engaged themselves in issues of gender-based violence or involved themselves in campaigns against sexual violence towards women.

- Description: In 1998 the Department of Labour promulgated the Employment Equity Act, which aimed at ensuring that the designated groups were represented in the workplace at all levels. The designated groups that were to be given preference for appointments were women, disabled and Black people. The Department of Public Service and Administration issued a directive to all government Departments to ensure the achievement of 50/50 gender representation at Senior Management levels by 31 March 2009. However, the Provincial Treasury in the Eastern Cape did not achieve this target and is still lagging behind. There are barriers in the workplace, which pose challenges to the progression of women to management levels. These barriers are commonly referred to as ‘glass ceiling’ by some scholars.This study used a qualitative approach in gathering data. The study employed non- probability, which adopted the purposive sampling approach. Questionnaires were administered to middle management and Senior Managers were interviewed to gather empirical data. Questionnaires were administered to sixty Middle Managers, both males and female, and interviews were conducted with seven senior managers. The reason for targeting Middle Managers was that they are at a level that is next in line in the hierarchy to advance to senior management positions.The purpose of this study was to investigate factors inhibiting the advancement of women to senior management positions in the Provincial Treasury in the Province of the Eastern Cape. The problem identified was that there were numbers of females at middle management who had the required qualifications and experience, but were not considered when appointments were made to fill in vacant senior management posts. The other problem that was identified was that often senior management positions were filled by candidates who were not from within the Department. The performance of female internal candidates is not recognised, which may be indicative of the flaws with the performance management system. It emerged from the empirical survey that preference is given to men compared to their female counterparts. The study revealed that there were factors that contributed to non-advancement of females to senior management such as the existence of stereotypes and perceptions. The stereotypical beliefs view men as hard workers than their female counterparts. It was also revealed that women suffered from low self-esteem that impacted negatively on their confidence levels. This subsequently discouraged women to apply for advertised vacancies as they doubted their own capabilities. It also emerged that the Department did not empower newly appointed persons through the mentoring and coaching programmes. This study also revealed that no training was offered to newly appointed persons.

- Description: This thesis explores, from a feminist perspective, some implications on the status of women in selected dance forms, and addresses the perceptions of women as 'inferior' and 'subordinate'. One of the intentions behind the work was, indeed, to challenge prevailing perceptions and create an awareness of sexism, capitalism and patriarchy, especially for the uncritical and uninformed who have become its victims. Part 1 offers an analysis of the premises upon which social, political and economic inequality are founded and consolidated, with specific reference to sexual inequality and sexual prejudice. Utilising a Marxist-feminist and semiotic approach, the machinations of the traditional mass media are linked to negative imaging of the female body in support of the sexist, patriarchal, capitalist male manipulator, who benefits from women's subordinate social status. Part 2 addresses the issue of sexual politics, and the implications for dance research and performance. The researcher offers a descriptive analysis of four specific dance forms, which serve to highlight the socialisation and educational processes that shape our perceptions and instruct our lives. A set of questionnaires was sent to fourteen autonomous dance institutions, including those attached to national performing arts councils. The thesis concludes with a summary of the results of the questionnaires that were distributed amongst female dancers, dance students and choreographers. The researcher questions our culture's preoccupation with the female body image, and posits the urgent need for an assessment of this situation, and an education which will create a better understanding and a more harmonious climate for development.

Patriarchy and the participation of women in Zimbabwean national politics: a study of selected women Politicians in Matabeleland Region

- Description: The research sought to analyse how patriarchal perceptions have affected women in Zimbabwean national politics with specific focus on women politicians in Matabeleland region. The researcher observed that women politicians in this region seem to face multiple oppressions and yet seem to have been excluded in previous studies. The mixed method approach was adopted for the research. Questionnaires were used for the quantitative method, while key informant interviews and focus group discussions were utilised for the qualitative method. Findings from the survey revealed stereotypical perceptions such as that men are better leaders than women, women are not capable of holding decision making positions and the perception that politics is not safe for women. The findings from the key informants indicate that women politicians in Matabeleland face quite a number of challenges emanating from these patriarchal perceptions. The challenges include violence, humiliation and cultural stigmatization. Although women have attempted to resist patriarchy, it seems that the resistance has not been enough to eliminate the patriarchal mentality and the oppressions that accompany it. The research adopts a combination of feminist and intersectionality theory as a framework for analysis of the problem under investigation. The research potentially contributes to academic discourse by advancing literature on the multi-faceted aspects of patriarchy. The study recommends psychological and financial empowerment of women, electoral reforms and criminalization of offenders. The implementation of proper reforms and corrective measures envisage the long-awaited new dawn among women whom since time memorial, have been suppressed by deep-seated societal and patriarchal beliefs.

- Description: Many everyday stories and experiences of African women remain underrepresented and undocumented. For example, the omission of Fingo Village women’s names from official deeds records silenced their voices. African women faced gender and racial discrimination that denied them fundamental human rights and limited their participation in urban life. Title deed records constitute one type of public record where African women’s names were omitted for centuries by the colonial and apartheid governments. Under apartheid, African women occupied the social status of minors; hence, the government denied them urban land rights. This African feminist study enlists narratives of a sample of seven African female heads of households residing in Fingo Village who are also property owners. Fingo Village is an atypical environment where African people had a rare legal advantage of owning title deeds dating back to 1855. This study employed an interdisciplinary approach by mixing oral history methodology and applied theatre methods to record, interpret and present Fingo Village women’s narratives of family property inheritance and the significance of title deed documentation in the suburb. The multiple technique approach created opportunities for authentic dialogue between the researcher and the participants beyond the inherent limitations of public history oral interviews. The traditional oral history interview and the participatory theatre methods helped uncover unconventional practices in family property relations. Though customary transfers of family homes to custodians were prevalent, title deed registration of family property was also acknowledged as a vital practice that empowered women legally. The researcher used participatory theatre techniques inspired by playback, image and forum theatre to enhance the researcher and participants’ relationship. These methods encouraged the researcher and respondents’ shared authority as they embarked on an extended participatory research project. In this regard, through dialogical and performance-based activities, the participants and the researcher became co-creators of untold Fingo Village stories. Moreover, the theatre techniques became interpretation and analysis tools that ensured that the participants’ untold stories were well represented. The first phase of the research involved engaging with the literature about the title deeds history of Fingo Village and conducting oral history interviews that served as data. In the second phase, the interviews were analysed and packaged in a documentary format. The third phase was a playback theatre inspired session in a 10-minute performance based on themes from the participants’ filmed interviews. Additionally, the performance was a catalyst for forum theatre activities that allowed the participants to interact with the performer and suggest solutions to the dilemma posed by the performer regarding family property use. The participants were decision-makers and family property relations experts within this imagined context. In the fourth phase, the image theatre adaptation and memory work activities were essential tools. The tools aided the visuals and information from an existing Fingo Village exhibition as additional resources that prompted dialogue and discussions. The exhibition encouraged participants to share their personal experiences and memories of the Group Areas Act (GAA) era. The findings showed that the GAA era saw many families revert to communal tenure practices as a strategy to evade forced sales; as such, this gave rise to undocumented family property transfers. Additionally, the findings revealed that though customary practices are often patriarchal, there are circumstances favouring women as the preferred family property custodian. These are embedded in the social status of women who are traditional healers, firstborn daughters, and those from families with just daughters. This study contributes to the growing literature that advocates for positive representation of African women’s stories by using active research methodologies that strengthen partnerships and shared authority between the researcher and the public. This methodology could inspire other researchers to explore theatre techniques to create more profound and meaningful engagements with their participants. These methods encouraged the researcher and respondents’ shared authority as they embarked on an extended participatory research project. In this regard, through dialogical and performance-based activities, the participants and the researcher became co-creators of untold Fingo Village stories. Moreover, the theatre techniques became interpretation and analysis tools that ensured that the participants’ untold stories were well represented. The first phase of the research involved engaging with the literature about the title deeds history of Fingo Village and conducting oral history interviews that served as data. In the second phase, the interviews were analysed and packaged in a documentary format. The third phase was a playback theatre inspired session in a 10-minute performance based on themes from the participants’ filmed interviews. Additionally, the performance was a catalyst for forum theatre activities that allowed the participants to interact with the performer and suggest solutions to the dilemma posed by the performer regarding family property use. The participants were decision-makers and family property relations experts within this imagined context. In the fourth phase, the image theatre adaptation and memory work activities were essential tools. The tools aided the visuals and information from an existing Fingo Village exhibition as additional resources that prompted dialogue and discussions. The exhibition encouraged participants to share their personal experiences and memories of the Group Areas Act (GAA) era. The findings showed that the GAA era saw many families revert to communal tenure practices as a strategy to evade forced sales; as such, this gave rise to undocumented family property transfers. Additionally, the findings revealed that though customary practices are often patriarchal, there are circumstances favouring women as the preferred family property custodian. These are embedded in the social status of women who are traditional healers, firstborn daughters, and those from families with just daughters. This study contributes to the growing literature that advocates for positive representation of African women’s stories by using active research methodologies that strengthen partnerships and shared authority between the researcher and the public. This methodology could inspire other researchers to explore theatre techniques to create more profound and meaningful engagements with their participants. Women have made great strides in sport in recent years in South Africa. However, at times we find that there is unfair media coverage. The unfair coverage of women’s sport displays gender based attitudes which systematically disadvantage women’s position in society. Women’s participation in sport has grown dramatically but despite this growth coverage of women in sport remains inferior. This research study investigated the marginalization of women in soccer in the Gelvandale area, Port Elizabeth. The objective of this study is to investigate if women are being marginalised in Gelvandale where soccer is concern as well as determining the meaning of gender inequality from an anthropological perspective within the context of soccer in the Gelvandale area. Further, to contribute within the anthropology of soccer in South Africa particularly in the Eastern Cape Province and to come up with recommendations that will contribute towards improvement of soccer in Gelvandale and beyond.

Within this thesis I explore and analyse the creative processes and performance strategies used in two dance theatres works: Acty Tang’s Chaste (2007) and my own work entitled Displayed and Framed (2008) and how these strategies support the staging of alternative sexualities. I argue that the staging of alternative sexualities calls for an alternative approach to the performance strategies utilised in the production of space, the representations of the body and the use of text in both works. Each work offers a particular exploration of gender and sexuality in the attempt to represent alternative identities, alternative bodies and alternative sexualities. In this thesis I identify the endeavour to stage ‘otherness’ as a feminist endeavour and thus identify the performance strategies utilised in each work as feminist performance strategies. Through my analysis I wish to highlight the ways in which a feminist approach can contribute to and enrich both the staging of and understanding of alternative sexualities. In both Chaste (2007) and Displayed and Framed (2008), the choreographers of each work are also performers in their own work in an endeavour to explore and represent their own identity. The analysis of my own work requires that I play the multiple roles of choreographer, performer and researcher. In this analysis I provide accounts of my own experiences, processes and struggles of creating Displayed and Framed (2008) which are analysed in conjunction with my readings of Chaste (2007) and Tang’s personal experiences in creating the work. Thus this thesis explores the value of reflection and self reflectivity in the processes of creating performance.

Similarities and differences between these performers and their respective societies are highlighted through the use of an ethnographic methodology. A distinction is drawn between the more traditional performers such as Thiam Anchou and D.L.P. Yali-Manisi, and the more modern performers such as M’Bana Diop, Bongani Sitole and Zolani Mkiva. The rich use of genealogy and history in the more traditional performances is highlighted. In comparing the work of the more contemporary, urban poets such as M’bana Diop of Senegal and Zolani Mkiva from Southern Africa, similarities are found in their performances on post-independence leaders such as Senghor and Mandela. Political pressures which have been brought to bear on the performer are also discussed. This article explores the continuity between the past and the present in relation to aspects such as the following: how performers gain recognition, their continued survival, their relationship with politics and religion, the orality- literacy debate, and the stylistic techniques used by these performers. - Description: Due to the continual constant battle women have to face in order to progress in the workplace, it has become necessary to assess the degree of transformational change within the workplace within South Africa to try to establish just what these barriers are and how it can be overcome. To examine the main problem, three sub-problems were identified. The first sub-problem that had been identified dealt with what the women’s rights in the new South Africa. It was investigated by evaluating the situation in the New South Africa and what has changed from the past. Is there more gender equality or not. The second sub-problem looked at the barriers that women face in the workplace. It is evident that sexual harassment, male chauvinism, trying to balance work and family as well as organisational structure and culture were among the top barriers that are a hindrance to women’s advancement in the workplace. Finally, the third sub-problem investigated what the glass ceiling effect is and the effect that this has on women in the workplace. The investigation evaluated, and emphasised the difficulties that women face in order to progress in the hierarchy of not only management but other occupations as well. Results have shown that most females and males believe that the glass ceiling is prevalent in the workplace. Most people believe that women can however break through the glass ceiling but now there is a new phenomenon, “The Glass Cliff” which allows women to break through the glass ceiling but only of organisations that are already in trouble.
