- Description: This study examines how well the Mgwalana Traditional Authority (MTA) is performing its role of governing and developing its area and the municipal area of Nkonkobe in the Province of the Eastern Cape. The Chief of the MTA is one of the 2400 traditional leaders in South Africa who are responsible for giving leadership and development services to approximately 16 million people living in the rural areas. This study tries to find answers to two research questions: 1) What role does the Mgwalana traditional council play in governance and development? 2) Has the South African government managed to add traditional leadership to the local government structures? The study shows that the MTA is finding it difficult to do much socio-economic development because the Nkonkobe Local Municipality considers governance and development as its own role, and the traditional leadership is supposed to join only in customary and cultural activities. The research concludes that these two bodies could move out of the cross-road if they were to follow the Traditional Leadership and Governance Framework Act, 2003 (Act 41 of 2003), and if the municipality were to work with local stakeholders, including the MTA, to achieve the goals for local government laid down in section 152 of the Constitution of the Republic of South Africa, 1996.

The findings discussed in Chapter Five indicate that there are some gains that can be achieved by SADC members through free trade agreement. Recommendation from the study is that progression towards deeper integration requires the participation of the stakeholder and ownership at national level. The national and regional institutions require good governance.

Extreme poverty and diminishing natural resources threaten the future existence of the human race. Transformative, cost-effective and sustainable solutions are necessary to address the most challenging social problems. The study explores the speculation that creation of social value naturally progressed to increase economic value. Governments and philanthropic efforts have to date, failed to offer effective solutions to social problems. Independently, no sector is able to handle the scale, cost and extent of the current social issues facing humanity. In order to address this gap the study considers the business models followed by the public, private and non-profit sectors. It then introduces the concept of social entrepreneurship and explores the use of a hybrid business model as a possible solution. It is argued that transformative, cost-effective and sustainable solutions to the most critical social problems within South Africa can only be generated once these different sectors collaborate to leverage public and private resources. The method used in approaching the study was: Identifying the need for new forms of social value creation and identifying specific ventures emerging to address these needs; Recognising the key factors enabling social entrepreneurs to accomplish ambitious task, create large social impact and influence economic value; Establishing the most predominant social problems threatening the future sustainability of society and economy in South Africa; Identifying the most strategic business model able to create transformation, sustainability and deliver both economic and social value; Establishing the guidelines, support and resources needed to strengthen social entrepreneurial behaviour and social entrepreneurial initiatives within South Africa. The objective of the study was firstly achieved through an analysis of literature related to the topic of social entrepreneurship. The literature study explored the origins of traditional entrepreneurship and entrepreneurial characteristics. It then went on to discover the concept of social entrepreneurship and made a clear definition between the different types of social entrepreneurship, separating the social entrepreneurial venture from charity and corporate social responsibility. The literature study looked further into the characteristics of a social entrepreneur, the need for new forms of social value creation, the opportunities that exist and the impact created by social entrepreneurship. The second part of the analysis strictly focussed on social entrepreneurship in South Africa and the role each sector plays in addressing social issues. The most critical social issues in South Africa were identified with emphasise on the change needed. The methodology used was the case study method. A single-case study was conducted with the Freeplay Energy Group, presenting a successful social entrepreneurial venture, serving as a good business model example for the South African environment. A qualitative approach was followed with the objective of testing theory. Therapist metamorphosis : beginner and experienced psychotherapists' journeys of professional therapeutic development

- Description: This research aimed to trace the development of psychologists as therapists within a South African context. Two distinct career levels were explored in relation to a competency model, a skills development model, and a developmental phase model of psychotherapists' professional development. Through purposive sampling five intern psychologists and six registered psychologists with at least seven years post-qualification client contact were selected according to the inclusion criteria of the study. Through semi-structured interviews, couched in the social constructionist position, the participants' experiences were thematically analysed. In addition, the researcher's own personal journey of developing as a psychotherapist was reflected upon. The current research study found that a number of aspects fostered the development of psychotherapists. Across the two career levels the life experiences of participants particularly featured events that were personally wounding or placed the participant in the helper role. The theoretical orientation(s) of participants were voiced as influential in their development, yet the ability to adjust their theoretical orientation to clients' needs was of overriding importance. Participants emphasised forming a strong therapeutic relationship with clients as the centrepiece of psychotherapy and depicted the therapeutic process using diverse metaphors. No key differences in use of metaphors emerged between intern and established psychologists. Catalysts for professional growth included personal therapy, "unforgettable cases", group supervision and, in the case of established psychologists, continuing professional development workshops. xiii Shifts in competency were recognised by intern psychologists as they gained more experience, namely, dissolution of naivety, a decrease in anxiety regarding their clinical work, a greater flexibility in the therapeutic process, a decreased sense of inappropriate responsibility for clients' progress, and an ongoing process of negotiating the interface of their personal and professional lives. Established psychologists spoke of having gained more confidence through their years of practice and yet experienced moments of anxiety which they found fostered humility. Limitations of the study and potential future research directions were outlined.

Towards expediting land claims: a case study of Fairview, Port Elizabeth

- Description: In 1994, South Africa’s political dispensation changed when the African National Congress (ANC) came into power. For most people, that meant that their aspirations and wishes would be fulfilled. The main objective of the new government was to redress past imbalances. The land question was one item on their agenda. In South Africa, land ownership has long been a source of conflict. The South African history of dispossession and forced removals and racially–skewed distribution of land resources has left Africans with a complex and difficult legacy (Christopher,1987).The issue of land had been an emotional issue affecting many people in South Africa. The struggle for land and access to land in South African history gave rise to many conflicts and loss of lives. The restitution of land rights in South Africa has been a highly contentious and emotive issue. The pain, anger and frustration of those affected by the implementation of racially based discriminatory measures of the past, cannot be denied. Confronting and redressing the anguish of the past has proven to be central to the process of reconciliation within a transformed political dispensation in South Africa (South African White Paper on Land, 1991a). The Constitution of South Africa and The Restitution of Land Rights Act (Act No. 22 of 1994) have firmly established the rights to claim restitution in accordance with the provision of justice and equity for all South Africans. During such a long process, it has been noticed in the suburb of Fairview, Port Elizabeth that some claimants ultimately received their land and compensation, some died before they received absolutely nothing and some old, poor and illiterate claimants are still struggling to claim their land or compensation. Fairview was formerly known as Baakens River Farm in 1810. It was situated far from the city centre and formed part of the Walmer Municipality. Initially, it was owned by John James Besny. In 1826 the farmer was bought by John Parkin and he later sold half 2 of it to Robert Newcombe before 1849. Robbert Newcombe named his half of the farm Fairview (Harradene, 2000). In 1933, Fairview became part of the Walmer Municipality. In 1967 Walmer became part of the Port Elizabeth Municipality. Fairview developed as a township of low density and became increasingly heterogeneous in nature. Davies (1971:10) claimed that the largest concentration of properties were owned and occupied by Coloured people, followed by Chinese, Blacks and Indians. The majority of the residents were Coloured. According to Sampson (1994), the plot sizes in Fairview were relatively large, either 0,8 ha or 0,2ha. Sampson also claimed that no business sites were distinguished, but businesses were established by the Chinese on residential plots. During the apartheid era, Fairview was one of the lands declared as a “Controlled Area”. The Group Areas Act also affected Fairview, even though the removal of the people in Fairview was not as pressing as it was to other suburbs due to its location at a relative distance from the city (Davies, 1970). As a result an increase in the Coloured population in Fairview was noticed between 1960 and 1970 as people faced eviction from central city areas such as South End. The people moved to Fairview with the hope that the area would be proclaimed a Coloured area. Unfortunately for those who ran to Fairview, people in Fairview were also removed from 1970s to other areas like New Brighton Location and other areas in Korsten. The last removal of people in Fairview took place in 1984 (Eastern Province Herald, 26 October 1996). After 1994, the introduction of the Restitution of Land Rights Act made provision for the establishment of a Commission on the Restitution of Land Rights and a Land Claims Court to adjudicate all claims lodged with the Commission as from 1 May 1998 (Land Info., 1996). Disputes with land owners over prices, validity of the claims and resistance to give away land, led to referral of some claims to the Land Claims Court. Although some research has been undertaken on Fairview, there is a vacuum of research into the problems faced by claimants in this area. The problems faced by claimants meant that some died while they were still busy with the process and some are still struggling to make a claim, and recently some were successful. 3 The focus of this study is to examine the process of the Fairview land claim, and as a recommendation, I wish to come up with suggestions for making the process easier for claimants.

- Description: This research study is more of an initiative towards Social Impact Assessment of copper-nickel mining in Botswana. The specific objectives of the study were centred on the assessment of the social impacts of copper-nickel mining in Botswana from the initial mining stage of exploration, surveying and mine site development to mine closure. The study was carried out under the broad hypotheses that mining influences population movement that impact on areas of mining; mining activities have both economic benefits and deleterious social impacts on the local communities found in the areas where mining is taking place; and mine closure has far reaching socio-economic, investment and developmental implications over and above the obvious interests of project owners. To achieve the broad aim as summarised above, the research study used a multi-disciplinary methodology and approach that required several kinds of expertise and sources of information. Hence it used both primary and secondary sources centred on interactive informative interviews, site visits and observations, questionnaires, census data records, mining companies’ publications, published textbooks and journal articles. The research study comprised of three different mines operated by three different mining companies in three varied socio-cultural and ethnic regions of Botswana. First was a detailed Social Impact Assessment of the initial phase of exploration, surveying and mine site development represented by Mowana mine project operated by African Copper in the rural areas of Dugwi and Mosetse. This case study yielded results showing that the social impacts of mining in the area are diverse and extensive. The findings suggest that the impacts relate not only to the possible economic benefits of foreign exchange, employment, the optimal use of available mineral resources and the possible development of Dugwi and Mosetse villages, but extends to the deleterious social impacts. The results also indicated that the social impacts have just begun in the two communities. Hence they point towards a possible disruption within the socio-cultural system of the local people if serious mitigation measures are not put in place; thus suggesting that the early stages of exploration and mine site development results in the most conflict between the mine and the local people. Second was a comprehensive Social Impact Assessment of Tati-Nickel Phoenix mining project in the peri-urban areas of Matshelagabedi and Matsiloje areas representing the mining stage of mine production and expansion. The results from this case study suggest that during vi mine production and expansion, many people were relocated. However, the overriding impression gained from the case study was Tati-Nickel Mining Company’s elaborate corporate policies that suggested good corporate governance and best practices that promote sustainable development. A notable milestone on good corporate governance and best practice that the other two case studies (mining company) could benchmark on is Tati-Nickel’s corporate social responsibility programme that has been designed to ensure that the communities within a fifty kilometre mine radius benefit from the mine. The results from the case study also distinguished the mining stage of production and expansion from the other two because it is associated with the deep entrenchment of the social impacts into the communities near to mining areas. Third was a detailed Social Impact Assessment on Bamangwato Concession Limited mine in the industrial town of Selebi-Phikwe. The case study represented the stage of mine closure. Through the findings of this case study, it became apparent that the economic dependence of Selebi-Phikwe on mining has seen the town developing into a mining town, increasing its vulnerability at mine closure. The results from the case study further suggest that mine closure will degrade the socio-economic sector of the town with ever far reaching socio-economic implications as many people lose their gainful employment, hence suggesting that a possible complete mine closure will be the most traumatic phase leading to major social conflict within the area. Thus the results suggest that at mine closure, the deleterious social impacts will overspill to other areas in Botswana with disastrous effects for the economy of the country. The results yielded through this study established in clear and passionate language that copper-nickel mining in Botswana influences population movements that lead to positive and negative impacts on the communities found in mining areas. Another major finding of the study is that copper-nickel mining activities have both economic benefits and deleterious social impacts on the local communities, hence the recommendation that the copper-nickel mining companies should embrace the concept of sustainable mining for sustainable development to avoid most of the negative impacts of their operations on the local communities.

The purpose of this note is to discuss the provisions of Age Discrimination, with specific focus on the rights of older employees, who have reached, what some might term, the ‘normal or agreed retirement age’. In the discuss which follows reference will be made to the Constitution of the Republic of South Africa1 in order to investigate the provisions of our new democratic era, and what is said therein about discrimination, and age discrimination in particular. In our new Constitutional dispensation there have also been circumstances where certain kinds of discrimination have become accepted on society, for example Affirmative Action, and an enquiry into the difference between discrimination and differentiation will therefore also be necessary. The provisions of the Employment Equity Act,2 which deal specifically with eliminating unfair discrimination in the workplace, and the Labour Relations Act,3 which deals primarily with the rights of employees, employers and trade unions, and seeks to harmonize employer-employee relations will be discussed wherein specific reference will be made to section 187(2)(b) of the LRA. A further discussion will outline the circumstances of what is meant by dismissal in the context of age based dismissals, and whether such a dismissal is infact a dismissal and whether, within the requirements of the LRA such a dismissal, or termination of employment contract, is infact fair. Furthermore, a comparative perspective of other jurisdictions will give a more complete understanding of the issue of age-based dismissals within the current context. However, to refer to legislation and foreign decisions alone, while being of important reference, is not enough and a enquiry into our own case law will be of significant importance to determine a path of direction one can expect when faced with a question of dismissals based on mandatory retirement ages, and in particular, a dismissal which has been so executed with recourse to section 187(2)(b) of the LRA. In the various cases the reasoning and rationale behind the decision making will shed light on a seemingly unresolved area of labour law, and in reading further not only in the judgments but also in various articles, one will see that there are many arguments for and against the use of a mandatory retirement age, the most important of which will be highlighted.

White rhinoceros populations in the Eastern Cape: distribution, performance and diet

- Description: White rhino populations did not occur historically in the Eastern Cape, South Africa (Skead 2007). They have, however, been introduced into a number of reserves within the Eastern Cape for reasons such as conservation, ecotourism and hunting. Based on the literature on the species, it was hypothesized that white rhinoceros would have been introduced in grass-rich habitats, as they are bulk grazers. White rhinoceros populations were further assessed in terms of population establishment by outlining their distribution and performance since introductions and this was done by extracting intercalving intervals from the literature of native populations and comparing such to the Eastern Cape intercalving intervals, extracted from data obtained from landowners. Finally, the diet of white rhinoceros was quantified, in order to identify plant species potentially at risk from white rhino herbivory using Shamwari Private Game Reserve as a study site. The distribution of white rhino in the Eastern Cape varies in terms of habitat and vegetation types. The majority (62%) of white rhino are located in grass-poor habitats and are primarily there for ecotourism purposes with only a small percentage kept for conservation purposes in the state reserves. Limited data for intercalving intervals of the white rhino in Eastern Cape are comparable to those of populations in the natural range. The ex situ conservation of white rhino in the Eastern Cape proved to be a success as population numbers have increased markedly since the first survey was conducted (Buijs 1999). The diet section of this study showed that white rhino are highly selective grazers even in a grass-limiting habitat which is dominated by browse. Twenty-five principal dietary items were identified in their diet, with only six being preferred in autumn. These are thus the plant species that could be the most vulnerable to white rhino herbivory. Supplementary food provision plays a big part of the feeding scheme of white rhino in Shamwari Private Game Reserve during the winter season, revealing the little confidence that the management has on natural resource availability to the animals at this time. These findings support the value of the Eastern Cape for ex situ conservation of white rhino, and highlight plant species potentially at risk. There is a need for further research on the population performance of these animals, and the plants identified here need to be monitored to assess white rhino impact on the vegetation

Supplementary food provision plays a big part of the feeding scheme of white rhino in Shamwari Private Game Reserve during the winter season, revealing the little confidence that the management has on natural resource availability to the animals at this time. These findings support the value of the Eastern Cape for ex situ conservation of white rhino, and highlight plant species potentially at risk. There is a need for further research on the population performance of these animals, and the plants identified here need to be monitored to assess white rhino impact on the vegetation

Wounding and healing as paradox: towards the visual articulation of synthesis

- Description: The very notion of wounding can be argued to imply a process of healing. Indeed some wounds are at the outset designed to be instruments of healing. As ten years of my professional life were spent assisting in the surgical creation of such „wounds‟ in an operating theatre it is from this memory timeframe that I initiated the process of developing visual equivalents that become reflective of both wounding and healing. The operation theatre was also an environment from which I developed increased awareness of mind or psyche as an entity conceptually comprising both conscious and unconscious components. Within this context, it can be argued that the patient‟s state of mind moves between consciousness and forms of unconsciousness induced through anaesthesia. Through research into the writings of the psychoanalyst Carl Jung, I began to develop a greater understanding of the concepts surrounding the conscious and unconscious mind in relation to the development of consciousness as well as to the integration of opposites. It is from this understanding of a dynamic process within the mind itself that I have attempted to develop visual signifiers of paradox in order to give expression to symbols that are reflective of these processes and in so doing indicate the psychological journey towards synthesis and individuation.
