Protecting and organising the apartheid and post-apartheid precarious municipal workforce: the Cape Town Municipal Workers Association and the South African Municipal Workers Union in Cape Town

- Description: The contemporary, global expansion of precarious employment poses key challenges for unions based on workers in full-time, stable employment (i.e. workers in the so-called “Standard Employment Relationship” – SER). South African unions and federations like the Congress of South African Trade Unions (COSATU), have resolved to organise these workers for decades. Most unions have, however done little to put these intentions into effect, even though precarity threatens union survival. A notable exception amongst unions in both the state and private sectors is COSATU’s South African Municipal Workers Union (SAMWU). SAMWU has a long history of consistently acting to protect and organise precarious workers. This is the puzzle with which this thesis grapples: why has SAMWU been different? This question is examined through a focus on Cape Town, the city in which the union has the deepest roots: its main, immediate predecessor, the Cape Town Municipal Workers Association (CTMWA), was founded in Cape Town in 1918. Answering the question posed above requires examining the record: how has SAMWU – and before it, the CTMWA – protected and organise precarious workers in the municipal sector over time? And further, why did CTMWA and SAMWU act this way, when many others have not? The answers lie in the distinctive character of the organisation’s trade union identity, drawing on Richard Hyman’s work, which moves beyond broad labels (business unionism, political unionism, etc.) and normative prescriptions (what unions should, ideally, do) to develop a nuanced model of what predisposes, and enables, certain union choices, actions, and responses union. The popular power resources approach (PRA) to unions helps map the resources available to unions but cannot explain why unions use power resources in specific ways. The thesis argues that the evolving union identity of the CTMWA and SAMWU predisposed it to organising workers, and that this evolving identity has been shaped by the distinctive features of the Western Cape and its political traditions, a long history of multiple municipal labour markets in Cape Town, and the specificities of that city, including the black African / Coloured division, its independent left traditions, the relative weakness of the COSATU’s allies, the African National Congress (ANC) and the South African Communist Party (SACP), in local government, and the peculiar dynamics of municipal restructuring. This thesis draws on both labour history and industrial Sociology, arguing that a dialogue between these two disciplines enriches labour studies. This thesis draws on a wide range of primary sources, both historical and contemporary, examines historical processes and change, and engages in a dialogue between historical and sociological work. It argues for the need to historicise precarity, avoiding a “year zero” approach that treats it as a novel challenge for unions, and as reducible to neo-liberalism. It insists that labour responses are shaped by place and time, and so, for the need to balance macro-level discussions of trends with local specificities. It argues that notion of a sharp rupture between the surging new wave of unionism that started in South Africa in 1973, from which COSATU emerged, and the older traditions of registered unionism has been overstated. More attention needs to be paid to the imprint of the more radical registered unions, like CTMWA, on the new unionism. Rejecting pessimistic accounts that see unions as doomed by precarity, it draws attention to long histories of relatively successful and sustained union responses, like those of CTMWA/ SAMWU. Restless imagination: material, urban space and contemporary art practices in postcolonial Harare

- Description: The use of everyday objects as art materials has evolved into a contemporary phenomenon in Africa, deeply rooted in specific contexts and possessing global relevance. Despite limited scholarly attention, existing discussions tend to revolve around individual artists or particular mediums. Many discourses are associated with either the prevailing universalist perspective that views the trend as Western avant-garde derivation or the reductionist narrative that attributes it merely to local material scarcity. There exists a critical need to investigate historical genealogies and explore the theoretical frameworks essential for comprehending this phenomenon. Through a combination of visual analysis, fieldwork and interviews, this thesis conducts an in-depth examination of the use of found materials in Zimbabwe, exploring its historiography, mechanism, impact, and visual achievements. This thesis situates the investigation in postcolonial Harare, the city that profoundly shaped the evolution of the phenomenon of using found materials. Regarding timeframe, this thesis examines contemporary Zimbabwean artists’ practices, with a special emphasis on the period following the Redefinitions movement in the early 2000s. However, it also explores the pioneering material innovations of Tapfuma Gutsa and Keston Beaton, as well as analyses the importance of the Pachipamwe workshop between the 1980s and 1990s. Among the artists, it highlights those who consistently engage with found materials and delve into their interactions with urban spaces in their practices. With the city as the analytical framework, this thesis draws on debates centring on contemporary African art and theories about materiality and urban studies. Approaching found materials as the materiality of both art and the city, it reveals a convergence of various interrelated artistic practices in Harare. The multidimensional relationships are manifested in the artistic processes, where the collection of materials, the creation of artworks, and collaboration with diverse urban groups, are intricately linked to urban spaces in Harare. By unfolding this process and emphasising the labour of artists, this thesis transcends conventional perceptions of artworks as mere visual objects, revealing the societal and spatial interactions inherent in artistic practices involving found materials. This thesis also explores the visual and semantical interactions between art and the city, centring on a curated array of artworks which is not merely a visual representation or reflection of the city but also provides critical thoughts on and dialogues with the city, as well as (re)imaginations and aspirations of the urban landscape. The relationship between art and the city is further deepened through iii artistic practices, extending beyond the creation of artworks and involving art infrastructure building in Harare. This thesis conceptualises artists’ practices of working with found material as restless imagination, a term drawn from the name of the city, which refers to “no one sleeps” in the Shona language. The restlessness embedded in its naming has characterised the city in various dimensions and across time, with the haunting colonial legacy, ongoing urban crises, ubiquitous movements and the ordinary people’s unwavering efforts for liberation and survival. Artists residing in postcolonial Harare also adopt and cultivate restlessness as a working strategy not only to cope with but also to transgress such conditions. The evolution of found materials has been unfolded through a continuous process of restless imagination and innovative manoeuvres, which are embodied in the continual re-imagination of the convention of art materials, the expressive capacities of specific materials, and a commitment to labour throughout the transformative process. This open-ended though productive process of exploration perpetuates and extends to the re-imagination and reclaiming of urban spaces, transforming them into artistic spaces that foster artistic creation and the reproduction of artists and imaginations. This thesis argues the potential framing and comprehension of Harare city as the site of restless imagination pursued, embodied and materialised by artists through their artwork and engagement with urban spaces. Contemporary Zimbabwean artists have redefined their artistic practices, interacting with the materiality of everyday urban life, urban matters, urban spaces, and urban communities, and, concurrently, the relationship between art and city, art and society. By doing so, they open up space for possibilities to refashion the restless city, negotiate urban citizenship, and recreate themselves as agentive subjects in postcolonial Harare. It could be argued that artists, as urban citizens, akin to other residents grappling with everyday life in the city, also exercise their arts of citizenship through their creative innovations in artistic expression and practices. A capabilities analysis: degree mobility and the impact of returning South African alumni on their home country’s sustainable development

- Description: The significance of sustainable development (SD) has gained increasing attention, particularly since introducing the Sustainable Development Goals (SDGs) in 2015. SDG 4 focuses on ensuring inclusive and high-quality education for all individuals, as well as the provision of equitable access to lifelong learning opportunities. In addition, SDG 4 recognises education as a fundamental element of societal progress and SD. Given the role of education in fostering economic growth, social cohesion, and individual empowerment, SDG 4 is a crucial component of global efforts to foster a more prosperous and equitable world. The primary focus of the study explained in this thesis was to address a specific aspect of Higher Education (HE) within the framework of the SDGs. While SDG 4 covers a wide range of targets, such as expanding scholarship opportunities for individuals from the Global South to study abroad, there remains a lack of comprehensive understanding of how pursuing a degree in a foreign country can influence graduates' potential contributions to sustainable development (SD) upon returning to their home countries. Moreover, despite researchers highlighting the need for attention to this topic, it has not received adequate focus thus far. Therefore, drawing upon the framework of the capability approach (CA) to sustainable development, the study explored whether returning graduates could contribute to SD in South Africa. To integrate the concepts of SD and CA, the study developed a framework for a responsible agent (RA), which was facilitated through previous studies. This framework provides a set of capabilities that are essential for supporting SD in South Africa. Based on this framework, the study comprehensively explored the experiences of postgraduate students and their potential to contribute to SD in South Africa. The study drew on survey data, semi structured interview, and document analysis to gain insights into how the structures of six selected scholarships aligned with SD objectives. However, upon analysing the eligibility criteria of these scholarships, it became evident that they already take into account certain capabilities associated with the RA in candidates. Furthermore, the analysis revealed that these scholarships tend to favour candidates who exhibit the potential to succeed in their professional endeavours. Therefore, this selection bias may exacerbate the existing inequalities within the South African education system. By disproportionately supporting candidates with advantages or resources, the scholarships may inadvertently perpetuate the disparities in educational opportunities and hinder progress toward a more equitable system. After administering questionnaires to alumni who had received these six scholarships, they were asked to voluntary participate in semi-structured interviews. Thereafter, data obtained was combined with document analysis, questionnaires, and interviews were analysed drawing on the RA framework with a narrative inquiry approach. The analysis of the data gathered during interviews with alumni revealed that certain capabilities were demonstrated and developed because of their degree mobility (pursuing degrees in different locations). However, it was also observed that some capabilities were negatively impacted by this mobility. Thus, the findings suggested a nuanced relationship between degree mobility and the development of specific capabilities amongst alumni, warranting further investigation to understand the implications of degree mobility on various capabilities. The investigation of the study revealed that the structure of the selected scholarships is not fully aligned with SD and that some capabilities can be damaged through degree mobility. - Description: External quality assessments are conducted to provide independent reasonable assurance that an internal audit activity is operating in conformance with the Institute of Internal Auditors’ (IIA) Standards, Code of Ethics, and the extent of compliance with international best practices. The assurance provided by an internal audit activity is relied on by various stakeholders in the organisation for decision-making purposes. Therefore, it is crucial for an independent external quality assessment process to be credible and trustworthy for internal audit stakeholders to know that the internal audit activity conforms with the Standards and Code of Ethics, which in turn allows the stakeholders to rely on assurances and advice provided by the internal audit activity. The objective of this study was to determine the potential existence of a conflict of interest and or bias, in fact or in appearance, when reciprocal peer reviews are performed by people working within the same district and who are familiar with each other. A qualitative research method was followed to achieve the objective of this study and answer the primary research question. A single case study approach was followed in this study using municipalities in the Overberg District to answer the primary research question, with a purposive sampling method used to select relevant participants for the study. Participants were the Audit Committee members, the Municipal Managers, and the Chief Audit Executives from the municipalities in the Overberg District. An interview guide was administered by the researcher to collect the primary research data through semi-structured interviews. The interviews were electronically recorded after permission was obtained from each participant, and each interview session was also transcribed. The primary data collected was then analysed using the In vivo coding method. Each interview transcript was manually analysed to identify key words, phrases or statements that agreed or disagreed with the IIA’s guidance pronouncements in relation to the performance of external quality assessments, with a specific focus on the use of reciprocal peer reviews. The findings of this study indicated that most participants did not perceive reciprocal peer reviews performed by persons working within the same district to be without bias and or conflict of interest, in fact or in appearance because of familiarities and close relations that exist between persons working in the same district in the same sector. The findings revealed that participants would consider the process and results of reciprocal peer reviews to be credible and trustworthy if they were conducted across the district or even across the provincial borders. The findings further showed that participants perceived a full external assessment to be the most reliable and trustworthy method to be used because of the external assessors or assessment teams having the necessary training, knowledge, and experience to perform external quality assessments which give the credibility and trustworthiness that is required for the external quality assessment process.. , Thesis (MCOM) -- Faculty of Faculty of Business and Economics Science, School of Applied Accounting, 2022

- Description: External quality assessments are conducted to provide independent reasonable assurance that an internal audit activity is operating in conformance with the Institute of Internal Auditors’ (IIA) Standards, Code of Ethics, and the extent of compliance with international best practices. The assurance provided by an internal audit activity is relied on by various stakeholders in the organisation for decision-making purposes. Therefore, it is crucial for an independent external quality assessment process to be credible and trustworthy for internal audit stakeholders to know that the internal audit activity conforms with the Standards and Code of Ethics, which in turn allows the stakeholders to rely on assurances and advice provided by the internal audit activity. The objective of this study was to determine the potential existence of a conflict of interest and or bias, in fact or in appearance, when reciprocal peer reviews are performed by people working within the same district and who are familiar with each other. A qualitative research method was followed to achieve the objective of this study and answer the primary research question. A single case study approach was followed in this study using municipalities in the Overberg District to answer the primary research question, with a purposive sampling method used to select relevant participants for the study. Participants were the Audit Committee members, the Municipal Managers, and the Chief Audit Executives from the municipalities in the Overberg District. An interview guide was administered by the researcher to collect the primary research data through semi-structured interviews. The interviews were electronically recorded after permission was obtained from each participant, and each interview session was also transcribed. The primary data collected was then analysed using the In vivo coding method. Each interview transcript was manually analysed to identify key words, phrases or statements that agreed or disagreed with the IIA’s guidance pronouncements in relation to the performance of external quality assessments, with a specific focus on the use of reciprocal peer reviews. The findings of this study indicated that most participants did not perceive reciprocal peer reviews performed by persons working within the same district to be without bias and or conflict of interest, in fact or in appearance because of familiarities and close relations that exist between persons working in the same district in the same sector. The findings revealed that participants would consider the process and results of reciprocal peer reviews to be credible and trustworthy if they were conducted across the district or even across the provincial borders. The findings further showed that participants perceived a full external assessment to be the most reliable and trustworthy method to be used because of the external assessors or assessment teams having the necessary training, knowledge, and experience to perform external quality assessments which give the credibility and trustworthiness that is required for the external quality assessment process.. , Thesis (MCOM) -- Faculty of Faculty of Business and Economics Science, School of Applied Accounting, 2022

The species is popular in rural and urban areas due to its lower price compared to commercial pharmaceuticals and because of its long-standing spiritual and symbolic significance. Consequently, W. salutaris is threatened in Malawi, South Africa and Swaziland and is believed to be extincted in the wild in Zimbabwe. In Mozambique, where the tree is confined to the southern part of the country, it is considered vulnerable due to high local demand and cross-border export. Although there is limited research, further work is urgently needed to provide the basis for options and strategies to achieve desired outcomes. This study aimed to explore different approaches for the conservation of W. salutaris in the Lebombo Mountains (LM), the Tembe River (TR) and the Futi Corridor (FC) areas, in southern Mozambique. For this, potential distribution, socio cultural factors that influenced sustainable management of the species, demography, harvest impact, genetic diversity and population differentiation were considered. The kuenm package in R, 2 846 occurrence and 11 environmental data were used to model the potential current and future distribution in 2050 and 2070 using four general circulation models (CESM1(BGC), ACCESS1.3, FIO-ESM and IPSL-CM5A-MR) under representative concentration pathways (RCPs) 4.5 and 8.5. The extent of occurrence (EOO) and habitat suitability (HS) were also determined. Stratified random semi-structured interviews with 182 heads of households were carried out to explore cultural and socio incentives of use, compared knowledge distribution, determine local management practices and explore local ecological knowledge related to the species in the three study areas. In addition, 17 focus group discussion were conducted to clarify issues raised during household interviews. One hundred and twenty four quadrants were used to determine the abundance and population structure. The Simpson index of dominance, permutation index and quotient between consecutive classes were used to assess population stability, and an eight point scale was used to evaluate the extent of bark damages. Genomic deoxyribonucleic acid (gDNA) (n=48) was used to assessed genetic diversity and population structure through the newly developed single sequence repeats (SSR) molecular markers. Model selected was statistical significant for prediction of potential distribution of W. salutaris in southern Mozambique (partial ROC =0.00, omission rate = 0.04 and delta AICc = 0.00). The current environmental conditions mostly explained by climatic predictor, indicated in general, the potential distribution on areas of occurrence observed during the field work in southern Mozambique. Future project suggested an increase of climatic suitable areas in all the general circulation models in both conservative and pessimistic climatic scenarios (RCPs 4.5 and 8.5, respectively) in 2050 and 2070, and consequently the increase of HS and the EOO. Results of this work suggests W. salutaris would not extinct at least in the coming 50 years due to climate change but other threats such as overexploitation of the species need to be addressed. With increase of climatic suitable areas, conservation and management of this species could focus on reintroduction and cultivation for recovery of the species, with the help of time. W. salutaris was used for medicinal purposes to treat 12 health problems, with the bark being the most commonly used part (92% of informants). Knowledge of the species uses differed significantly between the three study areas but not with respondent gender or age. Informants also mentioned a considerable number of alternative species of W. salutaris (37 species in LM, 33 species in TR and 17 species in FC). Local ecological knowledge on the ecological niche of the species also varied substantial in the three areas with both types of knowledge generally higher in the Tembe River area. Local management practises were revealed mostly on harvesting through vertical bark stripping cited by 100% of informants in TR, 61.6% FC and 51.7 LM (71% of all informants). Yet most (64.3% of all informants, corresponding to 98.4% in TR, 51.7% in Fc and 41.7% LM) used non-traditional harvesting tools (machete) bark removal. For sustainable use of the species, consideration should be given to combined conservation strategies such as the use of alternative species with the same application, substitution of bark by leaves, and increases in alternative sources of plant material through cultivation. The densities of alive stems were not statistically different in the three areas but was higher in LM (mean of 4500.3±9209.8 stems/ha). Equally the mean densities of recruits (diameter ≤2 cm) were not considerable different but was higher in the FC (3296.8±9116.7 stems/ha). The regression analyses for the three study area revealed negative slopes, indicating more recruits and fewer individuals in larger classes. The Simpson indexes of dominance, permutation indexes and quotients between the consecutive size classes suggested some levels of population instability in the three areas. Harvesting took place in the eight point scale, all size classes were harvested but preference was higher on intermediate (15.1-20 cm) or larger (>20 cm) size classes in all the study areas but gatherers avoided harvesting bark from recruits. Although the mean densities of harvested stem was not significant this work indicated higher levels of stem destruction in FC. Harvested dead stems ware significant in the three areas and FC had the higher of (39.5±85.9 stems/ha) compared to 7.6±19.1 and 2.1±4.3 in TR and LM, respectively. Equally, the density of physiologically stressed stems differed substantially in the three areas with higher in FC 20.5± 75.5 stems/ha compared to 18.7±82.9 stems/ha in TR and 3.8±11.8 stems/ha in LM. This results suggests implementation of protection measures such as the inclusion of the species in the national CITES list to regulated cross-border trade and strengthening of the law enforcement. Genetic diversity, structure and gene flow in the exiting populations of southern Mozambique revealed that despite fragmentation and overexploitation, this species maintains a relatively high level of genetic diversity supporting the existence of random mating. Two genetic groups were found corresponding to the northern (LM and TR) and southern (FC) areas. The study suggests that, if local extinctions occurred in Mozambique, the pepper-bark tree persisted in sufficient numbers to retain a large proportion of genetic diversity. Application of environmental magnetism to trace sediment sources contributing to Kruger National Park reservoirs

- Description: Sediment source fingerprinting using environmental magnetism has successfully differentiated between sediment sources in different regions of South Africa. The method was applied in the natural landscape of the Kruger National Park to trace sediment sources delivered to four reservoirs (Hartbeesfontein, Marheya, Nhlanganzwani, Silolweni) whose contributing catchments were underlain by a range of igneous, metamorphic, and sedimentary rocks. This research attempted to evaluate the impact of vegetation, lithology, and particle size controls on the ability of magnetic signatures to discriminate between lithology-defined potential sources. Potential source samples were collected from each lithology present in all catchments, except for the Lugmag catchment where the lithology was uniform, but the vegetation type varied significantly between woodland and grassland. One sediment core was taken in each of the four catchment reservoirs where there was more than one lithology present in order to unmix and apportion contributing sediment sources. Sampling time in the field was often restricted to short periods, dependent on anti-poaching activities and movement of free-roaming wildlife across the Park. This occasionally led to the sub-optimal collection of enough source samples to capture source signature variability. Mineral magnetic parameters were unable to discriminate between vegetation-defined sediment sources in the Lugmag catchment (homogenous underlying lithology) but were able to discriminate between lithology-defined sediment sources (to varying degrees) in the other four catchments. The contributions of each lithology-defined sediment source were estimated using a straightforward statistical protocol frequently used in published literature that included a Mann-Whitney U or Kruskal-Wallis H test, mass conservation test, discriminant function analysis, and an (un)mixing model. A contribution from each lithology source to reservoir sediment was estimated. Connectivity was a significant factor in understanding erosion in each of the catchments. Both longitudinal (e.g., drainage density) and lateral connectivity (e.g., floodplain - river) were important. Travel distance of eroded sediment to reservoirs was also an essential element in two of the four catchments. There are no defined floodplains, so channel bank soils are very similar to the catchment soils. Therefore, channel bank storage potential would be similar to the storage potential within the catchment. Vegetation played a crucial role in protecting soils, by reducing ii erosion potential as well as trapping and storing sediment, thereby interrupting lateral connectivity. Underlying geology and soils are determining factors of vegetation type and density. A published study estimated catchment area-specific sediment yields for different KNP catchments, including the Hartbeesfontein, Marheya, Nhlanganzwani and Silolweni catchments. The published data was used in combination with the (un)mixing model source contribution estimates of this thesis to determine specific sediment yields by lithology, i.e., for each catchment source. The polymodal particle size characteristics of the sample material led to an investigation into particle size controls on the ability of magnetic signatures to discriminate between potential sources. Due to time constraints, only the Hartbeesfontein and Marheya catchments were tested for grain size differences. For each catchment, one bulk sample was created for each lithology source. This bulk sample was divided into 10 subsamples. The samples were then fractionated into four particle size fraction groups: coarse (250 – 500 μm), medium (125 – 250 μm), fine (63 – 125 μm), and very fine (<63 μm). Reservoir samples were also bulked to create 10 down-core samples for each reservoir, and the samples were also fractionated into the four fraction groups. The same statistical protocol was applied to the fractionated samples and contribution estimates were obtained by lithology for each particle size fraction group. The goodness of fit and uncertainty of the (un)mixing model varied in each catchment, with the two measures of accuracy often showing an inverse relationship. The fractionated modelling estimated the same primary source in the two catchments as in the unfractionated modelling. However, additional information on the secondary and tertiary sources was obtained. Connectivity remained a significant factor in interpreting the results of the fractionated analysis. This study adopted an interpretivist research paradigm, given the study’s primary aim of gaining an in-depth understanding of employee retention as experienced by employees in the selected municipalities, together with the key influencing factors of employee retention. The qualitative research approach used a case study methodology within the Sarah Baartman District Municipality, with two category B3 and B4 municipalities selected for the study. The retention factors framework for existing employees by Munsamy and Bosch-Venter (2009) was used as the supporting theoretical structure. Respondents were selected through purposive sampling, and 16 in-depth semi-structured interviews were used to collect qualitative data. Through various content analysis techniques employed, this study identified seven employee retention factors (affiliation, career, work content, direct financial factors, external forces, work–life balance and indirect financial factors) with their associated themes. Affiliation, career and work content were identified as the three key factors which influence employee retention. Management style (relationship and interaction between employees and manager), organisational commitment and work environment were the main themes giving meaning to the affiliation factor. Training, personal growth and advancement emerged as themes related to the career factor. The work content factor was defined in terms of meaningfulness, challenges and autonomy themes. Direct and indirect financial factors, external forces, and work–life balance also emerged as factors that play a role in the retention of employees within a municipal context. Base salary and incentives were the associated themes underlying the direct financial factor. However, base salary has short-term effects on retention. Political climate and organisational reputation, municipal category and organisational structure were interrelated external forces. Flexible work arrangements, access to family, and childcare facilities give meaning to the work–life balance, while the only indirect financial factor to arise was benefits. Although some of the retention factors are clearly more influential than others, key employees attach most importance to a combination of employee retention factors that cater to their holistic needs and desires and generational differences. Therefore, the recommendations need to be implemented simultaneously. Having managers who engage employees in decisions-making and offer guidance and support, together with work environments where the physical and behavioural aspects are attended to, encourages employees to feel valued and appreciated. Municipalities should effectively communicate their mandate of ensuring adequate service delivery, which will allow employees to align their personal values to municipal objectives. Offering on-the-job training, access to career developmental programmes, evaluating job characteristics to include challenging and stimulating work and additional incentives as financial support will foster a conducive working environment for employees. Overall, municipalities face unique challenges depending on a variety of external elements such as political influence and climate. They operate in a challenging environment where they are also accountable to the community. - Description: The success of municipalities largely depends on the quality (skills, knowledge and experience) of individuals employed at those institutions. As key role players in the delivery of services, municipalities struggle to retain a high calibre of employees who essentially form the backbone of the public sector due to their skills, knowledge and experiences. There is a need for municipalities to create and foster an environment that encourages existing employees to remain employed. Utilizing a positivist perspective, the current research used a closed questionnaire to 321 employees from three commercial banks in Lesotho. The response rate was 98 percent (309 responses). To analyse data, the Statistical Package for Social Sciences (SPSS) was used. In particular, this research used exploratory factor analysis, Pearson correlation, and analysis of variance (ANOVA), analysis of moment structures (AMOS) as well as structural equation modelling to address the hypothesised relationships. Overall, the results of this study found that there is no association between psychological empowerment and employee intention to stay in the organisation. Over the past 15 years the expressions of xenophobia have been accompanied by increased deaths, more discrimination, increase of stereotyping of people of African descent and increased violence towards non-nationals, especially in the poorer parts of South Africa. Many of such xenophobic expressions have gone unnoticed and where they have been noticed, they have received little attention, leading to the exacerbation of the problem. The researcher of this study dwelt on a socio-legal analysis of xenophobia in South Africa. Appreciating the legal connotations and the expressions of xenophobia in South African society is a major concern of this study. To fulfill the objectives of this study, the researcher explores the extent and expression of xenophobia, in addition to analyzing and assessing the efficacy of legislative and other measures aimed to protect non-nationals in South Africa. The study investigates the role of state organizations, government and civil society and evaluates the impact of xenophobia on the enjoyment of human rights by non-nationals. A central objective of this study was to suggest alternative ways of explaining and understanding xenophobia and the responses to it. Empirical research was conducted to explore the extent of xenophobia in South Africa and how and why it is manifested in the way it is. Through in-depth face-to-face interviews it was revealed that the extent and manifestation of xenophobia differs in relation to particular communities, economic set ups and social settings; with poor communities being the most vulnerable to violent xenophobic attacks. Further, it was interesting to note that people have no firm understanding of what xenophobia entails as a social, legal, political and economical phenomenon. Again, it became evident that xenophobia still manifests in a country founded on values of equality, dignity and justice. Moreover, it was established that there is a weak link between law, human action and human behavior. It also became evident that education and sensitization need to be employed if xenophobic perceptions and behaviors are to be sufficiently dealt with. Recommendations were provided upon completion of the study. These included developing the law consciously, thus ensuring that the law has public legitimacy; effective law enforcement and prosecution; human rights education and training (especially in government departments, civil society organizations and institutions of learning); use of media and other communication channels to advocate for non discrimination, equality and respect for human rights, values and integration.
