Description: This workshop is designed to give you a reliable introduction the Employment Equity Act. It is based on hard information and on ACTIVITIES or discussion exercises that will help you to understand how the Act works, who it covers, and what the implications are for trade unionists. Each of the Activities is complemented with information that will help you to understand the Act in more detail. Sections have been added to help you find further information, and to understand the terms that are used in the Act itself. In a two day programme, you are not going to be an 'expert' on the Employment Equity Act, but we hope that you will feel more confident about using the Act, especially in ensuring that it is used to address a wide range of discriminatory practices at the workplace. As with most legislation, the more that you begin to use it, the more its strengths and weaknesses will emerge. It is very important that any weaknesses in the practical application of the Act are reported through your Union to the Federation. This will help the Federation to campaign for improvements in the legislation, and to close any loopholes that allow employers to avoid their responsibilities.

Description: Women in both the trade union movement and the formal work environment face obstacles which inhibit the progress of their concerns. Despite a range of gender resolutions passed at trade union congresses and the equality clauses inherent in the constitution and labour legislation, issues of particular concern to women are not mainstreamed in trade union negotiations. In instances where issues such as maternity benefits are fully integrated, women workers may still face difficult choices when it comes to ensuring that rights and labour laws are adhered to in the workplace. Many women workers often find that their position at work has been changed while they have been off on maternity leave, or they have been included in a retrenchment negotiation while away. An important question to ask in building a framework of gender indicators for collective bargaining, are what are the obstacles in trade unions which inhibit women’s active participation in collective bargaining?

Description: We the Trade Union representatives here present firmly commit ourselves to a unified democratic South Africa, free of oppression and economic exploitation. We believe that this could only be achieved under the leadership of a united working class. Our history has taught us that to achieve this goal we will have to carry out the following tasks : Organise the unorganised and build effective trade unions based on the democratic organisation of workers in the factories, mines, shops, farms and other workplaces. Organise national industrial trade unions, financed and controlled by their worker members through democratically committees. Unify these industrial unions into a national worker controlled federation. Combat the divisions amongst the workers of South Africa and unite them into a strong and confident working class. Encourage democratic worker organisation and leadership in all spheres of our society together with other progressive sectors of the community. Reinforce and encourage progressive international worker contact and solidarity so as to assist one another in our struggle. We call on all those who identify with this commitment to join us and the workers whom we represent, as comrades in the struggle ahead. We call on all trade unions to strive to unite their members in their ranks without discrimination and prejudice, and therefore resolve that this federation shall determinedly seek to further and protect the interests of all workers and that its guiding motto shall be the universal slogan of working class solidarity: "An injury to one is an injury to all".

Description: THE Central Executive Committee of COSATU took a decision in 1986 that active discussion and study of the South African economy was a priority. This decision was prompted by the very serious problems of unemployment, retrenchment, inflation and poverty that we now face. It was also prompted by an understanding that organised workers must be able to propose and fight for solutions to these problems. In addition sanctions are now becoming a reality. The need to thoroughly understand the economy is even more urgent. One of the biggest problems for any person trying to understand the South African economy is the question: Through whose eyes do we study it? We can look at the economy through the eyes of the capitalists or we can look at it through the eyes of workers. Depending on which set of eyes we use, we’ll see a very different picture. The newspapers, radio, TV and education system all look at the economy through the eyes of the capitalist. They talk of economic laws* which are efficient and benefit everyone. And when the economy goes into a recession* or into a crisis* they argue that the economic laws are being interfered with. They want people to think that the economy is something controlled by laws that workers cannot change. In this booklet on the South African economy we will look at the economy through the eyes of workers. We will see how politics and economics have combined to the benefit of the capitalists. In doing this we will undertake a study of the political economy * of South Africa. The aim of this booklet is to provide a starting point for a study of the South African political economy. We will be looking back into our history to understand the very close link between politics and economics. The purpose of such a political economy study is to allow us to better understand just how serious the present crisis is. Being clearer on this will also allow us to begin discussing the real and effective solutions to the crisis. This is important because many of the solutions being proposed at present will benefit capitalism but will lead to small changes for the mass of the people.

Description: COSATU, along with other alliance partners, was very instrumental in the creation of national gender machinery that was put in place by the democratic state after 1994. COSATU was part of a very important meeting held in 1995 to discuss national gender machinery which was held at the World Trade Centre. This meeting concluded on a Commission for Gender Equality, the Office of the Status of Women and the mainstreaming of gender in society. The South African women’s conference held in Amsterdam from 13-18 January 1990 and tagged, “Malibongwe Women’s Conference” was a pivotal point in South African women’s history. This conference was able to discuss the preferred role of women in South African politics and society. The conference analysed the challenges faced by women and proposed a number of resolutions to address with women’s emancipation as well as gender equality. These focused on working women; education, health, culture, family, women’s unity, natal violence and repression. “The subsequent programme of action gave the notion of a struggle for ‘non-sexism’ greater prominence, and recognised that national liberation did ‘not automatically guarantee the emancipation of women.’” This was a pioneered the discussions on the establishment of national gender machinery in line with global democratic practice and the mainstreaming of gender across society and its institutions in order to avoid the “ghettoisation” or marginalization of women and women’s issues in South African society. These discussions were initiated by the Women’s National Coalition (WNC). As the negotiations for South Africa’s transition to democracy started two to three years before democracy, women found themselves marginalized once again. They quickly formed the Women National Coalition which was able to push for women’s inclusion in the negotiations processes as well s to fight for women’sissues to find their way onto the negotiations’ agenda. The Women National Coalition was able to do this very effectively as it had established a “Negotiations Monitoring Team which provided reports and information to Women National Coalition member organisations”. Through this coalition, a “Women’s Charter for Effective Equality” was developed built on the back of the “Women’s Charter” that was developed in 1954 by the Federation of South African Women (FEDSAW). The coalition continued to exist and to provide leadership and to draw on the resolutions of the Amsterdam Women’s Conference. This ensured that an even broader consultation took place amongst women back home in South Africa to strengthen the Amsterdam resolutions and to put a plan in place for the implementation of new WNC resolutions, hence the constitution was able to include women’s concerns including the inclusion of a Commission for Gender Equality amongst the institutions referred to in Chapter 9 of the South African constitution. The Presidency was also given the mandate of being in charge of the gender programme and in this office the Office of the Status of Women was located.

Statement on employment Equity Bill and the Apartheid Wage gap

Description: The Portfolio Committee on Labour considered amendments to the Employment Equity Bill which were tabled in parliament by the Department of Labour today. Amongst these were amendments in response to COSATU's proposals for closing the apartheid wage gap. COSATU has serious reservations, however, about the tabled amendments on this issue, and believes that the amendments proposed today by the ANC should be supported as they address these defects. Finalisation of the clauses relating to the wage gap has been postponed to next week, when the Bill will be voted on by the Committee. COSATU has consistently maintained the view, both in our submissions to the committee last month, and at NEDLAC, that the Employment Equity Bill must address the issue of the apartheid wage gap, if it is to have meaning for the millions of ordinary workers, who are the worst victims of apartheid discrimination, and who will not be able to reach the upper echelons of the workforce, despite the affirmative action provisions of the legislation. We have supported the philosophy of the legislation that employment equity must benefit everybody, and not just an elite few. We have taken the view that the legislation must address the critical legacy of massive income inequalities, which was a deliberate policy under apartheid, in order to make this philosophical approach a reality, and that in this respect the Draft Bill was seriously defective. We proposed a series of concrete amendments to remedy this defect, within the broad philosophical approach and architecture of the Bill. We also proposed an integrated strategy to address these differentials, which combines measures in the Employment Equity legislation with other legislation and processes. A number of organisations have supported us in this view. Further a concept document tabled by the Department of Labour in the parliamentary committee broadly endorsed this approach.

Description: We welcome you to this Summit to discuss VAT. By yesterday afternoon, 22 organisations had indicated that they would be attending. COSATU is very gratified that so many organisations have felt the need to come together to discuss this pressing problem. COSATU has called this summit out of deep concern about the implications of VAT especially for workers and members of lower income groups, that is the vast majority of South Africans. We believe that unless we can reach consensus on this tax, we will be facing a disaster of national proportions. There will be a decline in the standard of living for all, and for those not protected against cost of living increases, starvation will stare them in the face. The Inkathagate scandal and the fact that the majority of the people in South Africa are taxed without representation, already angers our people. If tax changes are introduced without the widest possible consultation and consent, heightened conflict could jeapordise the transition process in its current delicate phase. The government should not underestimate the volatile character of unpopular taxes- this is a lesson which Maggie Thatcher had to learn the hard way! It will only be through the unity of organisations from all walks of life, that we will be able to successfully achieve modifications to the tax system. That is why we called this meeting. We sincerely hope that from this meeting, we will be able to develop a common approach.
