- Description: Over the past decade the South African forestry industry has gradually experienced the ramifications of labour scarcity, increases in labour costs, the effect of HIV and AIDS and increasing timber demand. Consequently, this has led to an increase in the mechanisation rate, especially in timber harvesting operations. Due to the labour challenges in South Africa, mechanised forestry equipment has increasingly been required to operate in complex forest conditions, such as coppiced compartments, where they have not operated before. It therefore occurs that harvesters are either used in certain coppiced compartments with uncertain productivity expectations, or the harvesters are not used in these compartments due to a lack of productivity knowledge. The influence that certain factors have on harvester productivity and stump volume loss – factors such as coppice regeneration practices and stem form – is poorly understood and has not been quantified. No scientific research exists regarding the effects of coppice compartments on the productivity of a harvester and the amount of stump volume waste. This research aimed at determining the influence of tree volume, tree form, stem felled first and distance between stems on the productivity of an excavator based harvester in coppiced double, coppiced single and planted Eucalyptus grandis pulpwood compartments. Furthermore, the research determined whether there was any stump volume waste, and quantified how much of it was due to excessive stump heights by the harvester. Through regression analysis, productivity equations were derived to make productivity predictions in both coppiced and planted compartments. All stumps were evaluated for waste and the average stump volume waste in coppiced double, coppiced single and planted trees was determined. The research results showed that planted trees had the highest productivity across all tree sizes, followed by coppiced single trees and then coppiced double stems. When harvesting a 0.2 m3 tree, the mean harvester productivity was 8.7 m3 per PMH in coppiced double trees, 13.8 m3 per PMH in coppiced single trees and 16.1 m3 per PMH in planted trees. In coppiced double stems the productivity was not significantly influence by the distance between stems. However, the productivity was significantly influenced by the stem felled first. The regression results showed that if the smaller stem was felled first, the productivity would increase if the larger stem’s volume was less than 0.18 m3; however where the larger stem was greater than 0.18 m3, the relationship was reversed. In addition, the productivity for both coppiced single trees and coppiced double stems were significantly influenced by stem form. The poorly formed trees had low productivity compared to the trees with good form. The stump volume findings showed that coppiced double stems had the highest average stump volume waste per stump, with 0.00307 m3 waste, followed by coppiced single trees (0.001954 m3) and planted trees (0.001650 m3). The average stump volume waste per stump with waste for the planted trees was negligible. This research provides forestry companies and harvesting contractors with information on the effect of tree volume, tree form and stem felled first on harvester productivity in E. grandis coppiced double, coppiced single and planted compartments. This information will assist in making equipment and system selection decisions and improve operational management and control. In addition, they will also be aware of stump volume losses that will occur in the three scenarios.

A comparison of the Botswana and South African labour dispute: resolution systems

- Description: The purpose of this study was to compare the dispute resolution systems of Botswana and South Africa. As far as the South Africa dispute resolution system is concerned extensive literature on the system was carried out to describe its functioning. As for the Botswana dispute resolution system there was not much written about it in the literature, so in order to find out more about this system semi-structured interviews with labour relations experts which include mediators, arbitrators, lecturers, labour lawyers, trade unionists, employers and government officials held. The framework of comparison was developed to compare the elements of dispute resolution systems against each other and secondly to compare each system against the criteria of performance to the system. The two labour relations systems were compared in terms of elements of the system and the performance of the two systems. In the comparisons of the elements of the systems it was found out that in both systems the nature of disputes was collective and individual disputes both of which can be referred to the initial process of mediation or conciliation. However, in Botswana collective disputes can only be referred to arbitration if they remain unresolved in mediation while in South Africa only collective disputes on essential services go to arbitration while others lead to a strike or lockout if unresolved at conciliation. As for coverage both systems have incorporated public service sector employees in the systems after being excluded from the system for a very long time. The only difference is that in Botswana the Police force is not included while in South Africa they are included in the system. Differences in the avenues of disputes in the two countries were noted, in Botswana the rights/individual disputes go to either arbitration or Industrial Court if unresolved at mediation, inter-est/collective disputes can only go to arbitration while in South Africa the route of disputes is specified in the legislation. As for the human resources of the two countries it was found that the South African system has more qualified, trained and sufficiently experienced staff than the Botswana system. As for the processes it was found that for South Africa the initial process is conciliation while in Botswana it is mediation but these two processes were similar in many ways, from mediation/conciliation the next step in both systems is arbitration and just like the conciliation/mediation, arbitration in both countries was found to be similar except that in South Africa it is a public hearing. The two systems were also compared in terms of their performances and the research has established that between the two systems the South African system proved to be more superior on three of the criteria; efficiency, accessibility and legitimacy than the Botswana system. Therefore, the research proposes a number of recommendations for Botswana to implement namely; establishment of a legislated mixed process of mediation-arbitration, making the dispute resolution system independent from government, recruitment of high qualified and experienced staff for mediation and arbitration, accreditation to private agencies, effective case management system and proper routing of disputes.

- Description: The main objective of the present study was to determine the relative role and importance of worsted suiting fabric fibre blend vis-à-vis fabric structural parameters, on the comfort related properties of 12 clothing ensembles, each comprising a different man’s suit, but the same wool/nylon underwear and cotton shirt. To achieve the objective, the comfort related properties, namely thermal resistance (Rt) and water vapour resistance (Ret) and water vapour permeability index (Im), of the clothing ensembles, as determined by means of WalterTM, a thermal sweating fabric manikin, were subjected to multi-linear and multi-quadratic analysis, as dependent variables, with the various suiting fabric parameters, namely weight, thickness, density, porosity, air permeability and wool content, as independent variables. It was found that the multi-quadratic regression analysis was able to best explain the observed differences in the clothing ensemble comfort related properties, in terms of the differences in suiting fabric properties. The regression analyses were used to isolate and quantify the effects of the various fabric and fibre content variables on the above mentioned comfort related properties of the various clothing ensembles. This study indicated that the suiting fabric structural properties (notably air permeability), had a more significant influence than either fibre blend or suiting fabric, as measured on WalterTM, a thermal sweating fabric manikin.

- Description: The consolidation of 22 years of democracy and 20 years of the Constitution of the Republic of South Africa entrenched the need to eradicate social and economic inequalities, particularly those that stem from our history of colonialism, apartheid and patriarchy, which brought pain and suffering to the great majority of our people, in particular Black people. Therefore, the passing of the Constitution of the Republic of South Africa (Constitution)1 20 years ago, marked a turning point in our history by giving expression firstly, to the Freedom Charter and secondly, by upholding the values of human dignity, equality, freedom and social justice in a united, non-racial and nonsexist society where every South African may flourish. However, despite the fact that the Bill of Rights in the Constitution provides that everyone is equal before the law and that equality includes the full and equal enjoyment of all rights and freedom, discriminatory practices, in particular, pay inequalities, are still rife in our country. It is against this backdrop that the historical background of the employment discrimination law in South Africa, which over a period of time, contributed significantly to the high levels of inequalities in pay experienced by the previously disadvantaged groups, such as Black people, women and people with disabilities becomes critical. This aspect points to the importance of understanding the context within which the principle of “Equal Pay for Work of Equal Value” has been and should be implemented in South Africa compared to Canada. Therefore, drawing from the review of the legislation and the implementation processes of the principle of equal pay for work of equal value, the following best practices/ lessons learned were identified: 108 of 1996. The Canadian Ontario Pay Equity Act states that the value of job classes be based on factors such as skill, effort, responsibility and working conditions. This Act also requires the employer to take proactive steps to institute a jobevaluation scheme, and the participation of the social partners and the affected workers is crucial. It is submitted that there are similarities in these requirements with those contained in the Employment Equity Regulations, 2014, which implies that the South African legislative framework draws on this best practice. The Ontario Employment Standards Act allows the comparison to be drawn with the establishment of the same employer in the same municipality, as well as with establishments to which a worker can be transferred. In this regard, it is observed that the new provisions on equal pay in section 6(4) of the Employment Equity Amendment Act, 2013, limits only the comparison with the employees of the “same employer” without elaborating further into the same municipality or with establishments to which a worker can be transferred. Under Ontario Pay Equity Act, even if there is no precise comparator in the establishment doing work of equal value, the employer must ensure that the worker’s pay is proportionate to others doing work of proportionate value. In the context of South African legislation, a comparison on the basis of proportionate value is not catered for. The meaning of “work of equal value” refers to the work that is the same (identical or interchangeable), substantially the same (sufficiently similar), or of equal value (accorded the same value) when compared to an appropriate comparator. In justifying equal pay, the Ontario statute provides that formal seniority systems and performance-related pay can justify unequal pay only if they do not discriminate on the grounds of gender. This is similar to the South African statute, in particular, regulation 7 of the Employment Equity Regulations, 2014, which include seniority and performance as some of the factors that may justify unequal pay only if they do not unfairly discriminate on one or combination of the listed grounds, and on any other arbitrary ground as prescribed by section 6(1) of the EEA as amended. As per the Ontario legislation, the employer cannot reduce the rate of remuneration in order to comply with the principle of equal pay for work of equal value. Similarly, in the South African legislation, in particular, regulation 7 of the Employment Equity Regulations, 2014, it prevents levelling down of pay in instances of demotions and in transfer of contracts (section 197 of the LRA). There is a requirement in terms of the Ontario Pay Equity Act, that employers must establish and maintain pay equity in their establishment in consultation with the bargaining agent (trade unions); and after the agreement, post a Pay Equity Plan in its workplace. In terms of South African legislation, the EEA does not have a requirement for a Pay Equity Plan, however, designated employers (those required to comply with Chapter III of the EEA) are required in terms of sections 19(1) and 20 of the EEA to conduct a review of their workplace policies, practices and procedures, inclusive of remuneration and benefits; and develop and implement affirmative-action measures to address any unfair discrimination practices by including these measures in their Employment Equity Plans. Furthermore, in terms of section 27 of the EEA, designated employers are then required to submit their annual Income Differential Statements to the Employment Conditions Commission (ECC) on the remuneration and benefits received in each occupational level of that employer’s workforce. In relation to dealing with pay-equity disputes, the Ontario Pay Equity Act, establishes a Pay Equity Commission, which consists of a Pay Equity Office, inclusive of Review Officers and the Hearings Tribunal that are mandated to specifically enforce the equal-pay-for-work-of-equal-value principle. Contrary, in South Africa, the legislation does not cater for the establishment of a Pay Equity Commission with exclusive mandate to deal with pay-equity cases. In this regard, the various courts and the CCMA which are mandated to deal with equal-pay disputes are also mandated to deal with other labour disputes emanating from other labour legislation, e.g. the LRA, BCEA, EEA, UIA, OHSA, COIDA, etc. The Review Officers in the Pay Equity Office in Ontario are mandated to monitor the implementation and maintenance of the Pay Equity Plans as per section 34 of the Pay Equity Act in Ontario. In South Africa, the EEA makes provision for DG Review process in terms of section 43, where the DG of Labour can subject any organization for a review to assess its compliance with the requirements of the EEA as whole, and not specifically to assess the implementation of the principle of equal pay for work of equal value. Notably, assessment of income differentials to promote equal pay may form part of the DG review process. In light of the above best practices / lessons learned, the following recommendations are made to inform the improvement plans of the implementation of the principle of equal pay for work of equal value in the South African labour market: Conducting of continuous advocacy campaigns to raise awareness and educate all stakeholders, i.e. employers, employees and trade unions on the principle of equal pay for work of equal value. Development of further policy guidelines in relation to equal pay consultations within the workplace between the employer and the employees, including where applicable registered trade unions. A policy directive on the “equal-pay consultation” will promote not only transparency around pay and benefit structures, but will encourage proactive measures from employers to develop pay/remuneration policies, including establishing remuneration committees; conducting job evaluations; implementing job-grading systems and performance-evaluation systems to promote the implementation of the principle of equal pay for work of equal value. 2 SS 115(4) and 158(1)(j) of 66 of 1995. Minimum wage-setting bodies should have the duty to apply the principle of equal pay for work of equal value in the setting of minimum wages. Collective bargaining structures such as bargaining councils should have a duty to apply and enforce the principle of equal pay for work of equal value in the wage-negotiation process and conclusion of collective agreements. Given the importance of collective bargaining in wage-setting in South Africa, there should be a duty on the social partners to include the principle of equal pay for work of equal value in all collective agreements. Industry-wide comparisons should be utilized, particularly in sectors in which collective bargaining operates at a sectoral level. Alternatively, the “Proxy” method as developed in Ontario, should be considered. Proportionate pay, as developed in Ontario, should be considered in cases where there is no comparator doing work of equal value, employed by the same employer. Possible legislative amendments to section 27 of the EEA to include a new provision, requiring employers to develop and implement a Pay Equity Plan outlining how they intend complying with the principle of equal pay for work of equal value. Then an annual progress report must be submitted to the Director General of Labour on how the Pay Equity Plan has been implemented instead of the current submission of an Income Differential Statement to the ECC. Finally, compliance with the principle of equal pay for work of equal value is required as a condition for accessing State Contracts under section 53 of the EEA when this section is promulgated in the near future. It can be deduced from the review process that the principle of equal pay for work of equal is a complex and specialized area. However, it was also clear that in both South Africa and Canada, the issue of equal pay is seen, not only as a workplace issue, but as an important Constitutional fundamental human-right imperative to the achievement of equality in a society as a whole.

- Description: History and Background: The history of statutory labour dispute resolution of South Africa dates back to 1909, when the Transvaal Disputes Prevention Act of 1909 was promulgated which applied only to the Transvaal. The Industrial Conciliation Act of 1924 established industrial councils and ad hoc conciliation boards and excluded black workers from the statutory definition of employee and this resulted in a dual industrial relations system that existed up to 1979. The history of statutory labour dispute resolution of Swaziland dates back to 1980 when the first Industrial Relations Act of 1980 was promulgated which established the first Industrial Court. Research Findings: The dispute resolution systems of South Africa and Swaziland contain both similarities and differences. Lessons for Swaziland include combining general and specific dispute resolution procedures, providing the right of a referring party to apply for condonation for late referral of a dispute, using conciliation-arbitration, making arbitration proceedings public hearings, influence of parties on the appointment of arbitrators, court adjudication, pre-dismissal arbitration, court adjudication by judges only, establishment of a constitutional court, full protection of protected strikes/ lockouts from interdicts, legalization of sympathy strikes, and removal of strikes/ lockout ballot. Lessons for South Africa include plural representation of parties at conciliation and arbitration, re-direction of some disputes by the Labour Court to the Commission for arbitration, reporting of labour disputes direct to the Head of State for determination.

- Description: The African continent is endowed with vast natural resources of minerals, such as cobalt, diamonds, gold, bauxite, iron, platinum, silver, uranium and mineral oil. Oil is unequally distributed in the continent, with some countries, such as Cameroon, Chad, Congo Brazzaville, Equatorial Guinea, Gabon and South Africa, being particularly well endowed. These natural resources can help accelerate development on the continent, especially in Gabon and South Africa if used strategically. This dissertation gives an overview of the international instruments, which play a key role in petroleum legislation and development. At the global level, the international legal instruments related to the permanent sovereignty over natural resources (PSNR), such as the 1962 Resolution 1803 (XVII) on Permanent Sovereignty over Natural Resources indicates that States have the rights to exploit freely national resources and wealth, use and dispose their natural resources for the realisation of their economic development in accordance with their national interest. The PSNR must be exercised in line with indigenous peoples’ rights and the respect of rules concerning the expropriation. At the African level, with regard to the right to the State to exploit freely natural resources, the African (Banjul) Charter on Human and Peoples’ Rights of 1981 has similar provisions as the Resolution 1803. The African (Banjul) Charter specifies that no peoples can be deprived of the right to dispose their natural resources. The African Commission on Human and Peoples’ Rights is tasked to interpret the African (Banjul) Charter. The Resolution on Human Rights-Based Approach to Natural Resources and Governance has also indicated principles in relation to the governance of natural resources. At the regional level, the Constitutive Treaty of the Central African Economic and Monetary Community (CAEMC) of 1994 and the Southern African Development Community (SADC) Treaty of 1992 do not provide explicit provisions relative to the PSNR and the management of natural resources. Therefore, it is important to examine if at the national level, the domestic instruments of both States deal with the PSNR.

- Description: The dynamic social and economic conditions in Namibia warranted a periodic review of labour legislation. Given these needs, uhe then Ministry of Labour, undertook a project in 1998, to assess the effectiveness of the first post kndependence Labour Act, 1992 (Act No 6 of 1992) a trirartite task force was established which recommended the amendment of the 1992 Act. This led to the enactment of the Labour Act, 2004 which introduced a new system of dispute prevention and resolution. However, the 2004 Act could not be put into effect in its entirety, because of its technical flaws and the fact that the Namibian Employers Federation (NEF) took issue with some of the provisions of the Act, such as leave provisions. In 2005, the Ministry of Labour and Social Welfare with its social partners undertook a complete technical review of the entire 2004 Act. As a result, In 2007, the new Labour Bill 2007 was tabled in Parliament, which eventually adopted it as the Labour Act, 2007 (Act No 11 of 2007) which became operational on the 1st November 2008. The new Labour Act, 2007 (Act No 11 of 2007) brings in sweeping changes to the familiar terrain of labour law and industrial relations practice in Namibia. The new Act, has done aware with the District Labour Court system, in its place comes the Labour Commissioner. The rudimentary dispute- settlement mechanisms of the old (first ) Labour Act, 1992 ( Act No 6 of 1992) have made way for the more sophisticated, yet speedier and more economical system of alternative dispute resolution through arbitration and conciliation by the Labour Commissioner. The Labour Act, 2007, requires parties to the labour dispute to seek conciliation before either taking industrial action or seeking adjudicative solutions to the dispute. Not only does the Labour Act, establish or makes provision for the appointment of the Labour Commissioner to provide for dispute resolution, it also permits parties to establish their own process for dispute resolution through a private arbitration route. Faced with this daunting array of untested rules and institutions, I have approached the writing of this work with some trepidation. My aim is to provide a thoroughgoing commentary on the provisions relating to dispute resolution. In the absence of much authoritative interpretation, I had to rely heavily on past practices and foreign South African precedents to identify the construction that judges and arbitrators are likely to arrive at. The present treatise provides a, comprehensive and integrated commentary for all involvement in the resolution of labour disputes in Namibia; it further provides rules and procedures which govern statutory disputes resolution through the Labour Commissioner. I sincerely hope that this paper, will prove useful to all those involved in labour law and industrial relations practice, as well as to teachers and students of this subject.

- Description: “An estuary is a partially or fully enclosed body of watera) which is open to the sea permanently or periodically; b) within which the sea water can be diluted, to an extent that is measurable, with freshwater drained from inland” (National Water Act, 1998). Estuaries are ecologically important because they are habitats for birds, fish and plants and they are valuable because they provide human beings with food (fish) and recreational pleasure in the form of unique views, bird watching and opportunities for swimming and boating. It is in this context that they may be said to provide economic goods and services for current and future generations. The provision of these services is dependent on the inflow of freshwater into estuaries. The problem with estuarine freshwater demand is that estuaries are the ‘last in line’, literally and perhaps in the typical prioritisation of human wants by government. Clearly it is imperative that the value of freshwater inflows into estuaries be determined and these values incorporated into catchment management decision making. South African estuaries have in the past mainly been managed on a piecemeal basissometimes in the interest of fishermen, sometimes property development owners and sometimes other local interest groups. This situation changed with the National Water Act of 1998. One of its objectives was to address the mismanagement and inadequate research about water inflow impacts on estuaries (Allanson and Baird, 1999). The global warming phenomenon is going to negatively affect estuaries and put more pressure on the availability of freshwater inflows into estuaries, as well as the availability of drinking water. The majority of South African estuaries are temporally open/closed and experiencing reduced functioning due to reductions of freshwater inflow to them. Given the overwhelming evidence available on the significance of freshwater inflow to estuary functionality, it is clear that an important component of catchment management is the allocation of river water into estuaries. Economic guidance comes in the form of comparisons of value. There are seven estuaries for which values were generated, the Heuningnes, Kleinmond, Klein, Palmiet, Cefane, Kwelera and Haga- Haga. All of the seven estuaries fall in areas characterized by warm temperate climates and low rainfall levels. Estuary services, like many other environmental services, are not traded in the markets. For this reason, in order to estimate their value, reference must be made to proxy markets, and methods of valuation have to be employed that can use proxy market information - like the contingent valuation method (CVM), the travel cost method (TCM) and the hedonic pricing method (HPM). For the purpose of this research the CVM was preferred because it is best suited to including passive or nonuse values. The CVM estimated values are compared with other values generated using the TCM. The information required to make the CVs was gathered through surveys in at the seven selected estuaries from December 2005 to April 2006. From this information sample mean and median Willingness to Pay (WTP) values for freshwater were calculated, socio economic profiles were generated, the importance that respondents attached to various activities in the estuary was deduced, and, Tobit and Ordinary Least Squares (OLS) statistics models were used to predict household WTP. The Total WTP (TWTP) for each estuary was obtained by multiplying the median WTP by the total number of households that use the estuary. The median WTP is preferred to the mean WTP because of a skewed bid distribution of WTP among the users. The value per m3 of freshwater was obtained by dividing the TWTP by the total forecast reduction in water inflows into the estuary.

- Description: This study was initiated in an attempt to investigate dithiocarbamic acid accelerated sulfur vulcanisation. This was, however, found impossible due to the innate instability of dithiocarbamic acids. The focus of the study was then shifted toward thiuram disulfide accelerated sulfur vulcanisation, with emphasis being placed on a rate comparison. Three groups of accelerators were investigated, namely the aromatic, linear aliphatic and cyclic aliphatic thiuram disulfide adducts. The analysis methods that were employed were conventional rubber (cis-1,4-polyisoprene) techniques coupled to model (squalene) compound investigations. The data that was collected consisted of rheometrical torque vs. time data in the rubber system while the data obtained in the model compound study consisted of sulfur and accelerator concentration data as determined by means of high performance liquid chromatography (HPLC). The aromatic accelerators were synthesised in our labs by means of an addition reaction between the aromatic amine and CS2 in basic medium and subsequent oxidation with K3Fe(CN)6, all in a 1:1 molar ratio. The reaction yield was low due to the instability of the dithiocarbamate intermediates and a sluggish oxidation reaction. In the rate constant determination a first order mathematical approach was used for the rubber system as crosslinking is considered to roughly obey first order kinetics. The model compound data was also found to more accurately fit the first order rate law, with an initial slopes method also being applied to the system to determine secondary rate constants and relative rates for the system. The determination of vulcanisation rate constants in the cis-1,4-polyisoprene system was a success, while the rate data determined by means of the squalene model was more related to the rate of accelerator and sulfur consumption as opposed to the rate of crosslinking as is the case with the rubber rate data. The sulfur first order rate data mirrored the rate data derived from the rubber system more closely than the corresponding accelerator rate data, the relative rate data determined by means of initial slopes method, proved that the homolytic cleavage of thiuram disulfides and the subsequent formation of accelerator polysulfides were not limiting steps. This is seen in the similar relative rate data derived from both the raw sulfur and accelerator data in systems that exhibit vastly different vulcanisation rates. Squalene was deemed a suitable model for the cis-1,4-polyisoprene system, although one should consider the extent of charring and solution effects in the individual systems to account for possible incongruities that may be observed between the rubber and simulated system. The lack of agreement between the rubber and model compound rate constant data lies in the fact that the rate of crosslinking is not simplistically related to the rate at which accelerator and sulfur is consumed, this being especially true for the rate at which the accelerator is consumed. Thus the discussion over the acceleratory rates in the various accelerator systems was limited to observations made in the rubber system, with the model compound data was used exclusively to elucidate mechanistic processes. It was discovered that the groups of accelerators examined, namely linear, cyclic and aromatic thiuram disulfide adducts, produced vastly varied rate data. The aromatic thiuram disulfide adducts had only a slight acceleratory effect on the rate of vulcanisation as compared to the unaccelerated sulfur system. The morpholine adduct had a moderately larger rate of acceleration followed by tetramethyl and tetrethylthiuram disulfide, with N’N-dicyclopentamethylenethiuram disulfide having the fastest rate of acceleration.

- Description: The performance of Xhosa mbongis (no correct English equivalent is available for the Xhosa bard / praise singer) is an interesting art form presentation by some individuals found in the Xhosa community. What is of interest is the fact that such artists are known to be the voices of their communities, heralding socio-cultural and historical norms and achievements. In the olden days, such figures were commonly found in the royal circles of headmen, chiefs and kings. Nowadays, urbanization has brought them into the township where they are gradually assuming different roles of not only focusing on the royal houses, but also in all community leaders as well as non-leaders of the community. Initially they used to earn their reputation through the kings or councils stages / platforms, but these days they also acquire such reputation through media and in any socio-political gatherings. They used to win awards and presents while nowadays they charge appearance fees. It is being changed into a profession albeit without any sort of academic accreditation. In the Nelson Mandela Metropolitan township, a number of such mbongis have mushroomed much against the likings of some purists cultural practitioners. The purists accuse them of being drunk with greed. Perhaps the accusation is justified and perhaps not. What is most notable is the fact that mbongis recite whenever they are asked to do so, something which is not acceptable to purists who believe that an imbongi is called forth to perform when the spirits instruct him or her to stand up and bonga. Whatever the case may be, many of such mbongis appear mostly in funerals, of known and unknown figures and so to many people, they make mockery of such a solemn talent. It is against this background that the researcher felt the need to look into this literary art-form as being presently performed by a township imbongi. The first chapter will deal with introduction, aim of study and method of research. The second chapter will provide a review of oral poetry and a poet in Xhosa writings, the nature of traditional imbongi his or her role in traditional and modern society. The third chapter will give the analysis of content, form and style of two recited poems by two different imbongis. The fourth chapter will provide a brief conclusion on how we view modern traditional imbongis and oral poetry

- Description: Whole Body Vibration (WBV) training is a new addition to the field of Exercise and Sports Science and has been developed for the use in strength and conditioning exercises. With the introduction of this new mode of exercise, the study focused on comparing the strength gaining effect of WBV training versus conventional resistance training. The study was conducted in a descriptive, exploratory manner utilizing a quasi-experimental approach with a three group comparison pre-test-post-test design consisting of an experimental-, comparison- and control group. Convenience and snowball sampling were used to select 43 male and female healthy, sedentary volunteer participants. The research focused on reviewing the contribution that each mode of training offers to increase strength in the upper leg and underlines the important physiological adaptations that the human body undergoes to bring about an increase in muscle strength. Both the whole body vibration and land-based resistance groups trained three times a week over an eight week intervention period. Exercises were performed with progressive increments in the frequency, amplitude and duration for the WBV- and in workload, number of sets and repetitions for the conventional resistance training program. The control group remained sedentary throughout the duration of the study. The dependent variables of peak torque flexion and extension of the knee joint in both legs were analyzed using descriptive and inferential statistics. Analysis of covariance (ANCOVA) was done to determine intra-group differences. Post-hoc analysis in the form of Scheffé’s test was done to determine and compare inter-group differences. Practical significance was indicated by means of Partial eta2 The analysis of the results revealed significant strength increases in both conventional resistance training and WBV for most of the dependent variables, except for peak torque extension, where the WBV group did not increase significantly. Based on these results, it can be concluded that both modes of conventional resistance and whole body vibration increased selected dependent variables for upper leg strength in previously inactive individuals.

A comprehensive evaluation framework for system modernization : a case study using data services

- Description: Modernization is a solution to migrate cumbersome existing systems to a new architecture for improved longevity of business processes. Three modernization approaches exist. White-box and black-box modernization are distinct from one another. Grey-box modernization is a hybrid of the white-box and black-box approaches. Modernization can be utilised to create data services for a Service Oriented Architecture. Since it is unclear which modernization approach is more suitable for the development of data services, a comprehensive evaluation framework is proposed to evaluate which of the white- or black-box approaches is more suitable. The comprehensive framework consists of three evaluation components. Firstly, developer effort to modernize existing code is measured by acknowledged software metrics. Secondly, the quality of the data services is measured against identified Quality of Service criteria for data services in particular. Thirdly, the effectiveness of the modernized data services is measured through usability evaluations. By inspection of the combination of application of each of the evaluation components, a recommended approach is identified for the modernization of data services. The comprehensive framework was successfully employed to compare the white-box and black-box modernization approaches applied to a case study. Results indicated that had only a single evaluation component been used, inconclusive results of the more suitable approach may have been obtained. The findings of this research contribute a comprehensive evaluation framework which can be applied to compare modernization approaches and measure modernization success.

- Description: The restructuring of higher education through incorporations and mergers has attracted a lot of attention over the past few years in South Africa. These incorporations and mergers have displaced institutions of higher education and positioned them in new organisational homes, thus subjecting faculties, schools and departments to a process of relocation, new knowledge acquisition, identity change and meaning-making processes. The merger has resulted in three types of universities; i.e. traditional universities, comprehensive universities and universities of technology. The introduction of the comprehensive university as a new institutional type has brought with it questions about the idea of the university and the purpose of higher education in general. Mergers in particular have initiated conversations about sense-making and meaning during change. Amidst all this, people within the merging institution have been confronted with a new organisation with which they have to identify. At universities in particular, questions about academic identity and organisational identity have become unavoidable. The boundaries that gave definition to a university have been (re)moved. The structure of the university, as it was known, has changed. Hence, in the newly merged NMMU, academics are in the process of internalising and giving meaning to the new organisational values and norms of a comprehensive university. Needless to say, the challenges facing the newly merged NMMU are cultural, structural and geographic. Bringing together different institutional and personal cultures involves a human dimension that needs to be nurtured by trying to form a coherent and cohesive organisation that is created from culturally diverse and uncomplementary institutions. Another challenge is bringing together different organisational structures, systems and programmes that are informed by different institutional cultures. Furthermore, the challenge of having multiple campuses that are geographically separated exacerbates the situation. Along with all these challenges, the NMMU has the task of constructing an integrated institutional identity through organisational forms and programme models that will embody the multiple functions that are typical of a comprehensive university. The aim of the current study was to explore how the meanings that academics assign to the notion of a comprehensive university are instrumental in constructing an organisational identity; describing in detail how at the NMMU academics make meaning of the comprehensive university and how that meaning-making process influences the construction of an organisational identity; and formulating recommendations based on the qualitative findings and quantitative results of the research. In an effort to achieve the aim alluded to above, this study employed the mixed methods approach that used a sequential, exploratory, transformative design. The complexity of the study was such that it required to be investigated through qualitative and quantitative analytical methods in order to confirm, triangulate and obtain a holistic picture of the situation under investigation. The sample for the qualitative interviews consisted of thirteen purposefully selected academics from all levels at the NMMU. The interviews were transcribed and coded into themes, categories and sub-categories. These themes were then developed and translated into statements for the questionnaire that was administered randomly to all NMMU academics. A total of 108 academics responded to the questionnaire. The responses to the questionnaire were analysed using the SPSS programme. The findings and results of the study revealed that there was a fairly common understanding of the term comprehensive university among academics. However, the details about its procedures appeared to be the privileged ownership of management. This situation mitigated the necessity for a sense-making process that would allow for negotiation, modification and alteration of already held assumptions. A pertinent concern amongst academics was the neglect of the ‘human factor’ during the change process. The management style also came under scrutiny, especially in terms of the facilitation and mediation of change. There was a consensus on the call for cohesion and unity that was believed to be one of the main features that would make the construction of the NMMU organisational identity possible. The vision, mission and values of the NMMU were believed to be central to the creation of cohesion and unity, which would subsequently result in the birth of an organisational culture that could inform the organisational identity of the NMMU. Strategies to actualise and realise the organisational identity were proposed by participants. Notwithstanding, the impact of the merger was identified as having a major influence in shaping the organisational identity of the NMMU.

- Description: Current trends in technology have led to a need for creativity and innovation in the design of contemporary digital products and systems. This has resulted in design thinking and creative design process having a higher profile in digital design practice. In turn, this has impacted computing education, by creating a need for computing students to develop creativity and design thinking skills. Creative design is taught using design studio teaching methods, which require a culture, environment and activities that are different to the teaching methods used in traditional computing education. Some computing academics have implemented courses using aspects of studio teaching methods, but no clear guidelines for a computing academic without creative design experience to fully apply studio teaching methods in courses could be found. The reason for the change in the role of design in the digital domain and how it affected the needs of computing students was investigated and a comparison of typical design studio and computing teaching methods was conducted using a learning systems model adapted for this specific purpose. This led to an identification of areas that required further investigation, or gaps in the knowledge of how to adapt design studio methods for use within a traditional computing education environment. These gaps were used as the basis for identifying a set of research questions for an empirical study. An exploratory case study was conducted at the Nelson Mandela Metropolitan University to answer the research questions. Three computing academics implemented studio teaching methods within three separate modules, following provisional guidelines devised from the preliminary research. Feedback was collected from the lecturers and the students registered for the modules regarding their experiences. It was found that it would be possible for computing academics to implement aspects of a design studio approach within the existing computing environment. An explicit teaching method, termed the computing studio teaching method, was developed from the results of the case study. This teaching method aims to provide computing academics with little or no creative design experience with explicit methods for implementing modified design studio teaching methods in order to promote creativity and design thinking within traditional computing modules. This teaching method will be tested, validated and refined in future research.

- Description: Information and Communication Technology for Development (ICT4D) is an emerging research area that is concerned with the beneficial applications of Information and Communications Technology (ICT) to achieve developmental goals. ICT4D is thus concerned with designing and developing innovative technologies for resource-constrained environments for applications in key areas of social development such as health, agriculture and education. The ICT4D initiatives, therefore, are driving three main tasks, namely developing the required infrastructure (connectivity, electricity and computing devices) sustainably, building the required ICT human capacity, and providing access to digital content and services. Each of these three main thrusts necessitates innovation. This study addresses the evident lack of delivery mechanisms to facilitate access to digital content and services to end-users through the technologies that these end-users already possess. This lack of innovative delivery mechanisms is both an impediment to achieving equitable access to digital content and service and an opportunity to innovate. Therefore, drawing from the theoretical background of ICT4D, this study develops a set of technical and socio-technical requirements that the missing delivery mechanisms should satisfy. The study also explores the Service Delivery Platform (SDP) concept as a technically viable basis for the required delivery mechanisms. The study then develops a conceptual model of an Access-Technology-Agnostic Delivery Mechanism as a possible delivery mechanism that facilitates equitable access to digital content and services within an ICT4D context. The relevance of the conceptual model is established and, through a prototype implementation, the technical feasibility and utility of the conceptual model is demonstrated. The conceptual model is demonstrated through a proof of concept implementation using standards-based open source technologies. The proof of concept clearly demonstrates that the access-technology-agnostic delivery of digital content and services is achievable, thus making the same service accessible through different access technologies. In developing the Access-Technology-Agnostic Delivery Mechanism, this study contributes through innovation to providing access to digital content and services in an access-technology-agnostic manner.

- Description: Conflict is an inherent part of any service relationship, and is one of the important methods of effective organisational functioning. Depending on its management, it has both constructive and negative outcomes. The most extreme outcome of conflict in an industrial relationship is a strike. The South African Public Service strike of 2007 was the most protracted and united strike in the history of South Africa. In order to provide an insight into this strike, this treatise explores the following key aspects: • To present a short background of collective bargaining in the public sector through time. • To provide a short background to the public sector strike in 2007. • To develop a conflict model for analytic purposes based on a literature review and to use the conflict model to analyse the strike. A study of the strike was deemed essential because of its current nature and it being charged with political undertones. Moreover, conflict in the employment relationship has had an important influence on theories of industrial relations. The South African labour relations system is pluralist in nature, with a focus on the formal institutions of industrial relations. The focus should be on the motives and actions of parties in the employment relationship. Hence, one should look beyond conventional explanations in understanding conflict.

- Description: This study considers the nature of South African municipal water service delivery, and how marketing strategies can provide a framework for better management of this service. It reflects on the elements that guide municipal decision making and evaluates user preferences for levels of the municipal “water service mix” by employing conjoint analysis. Particular attention is paid to consumer willingness to pay for improvements in the “water service mix”. The study argues that the values municipal consumers attach to the variables of the water service mix need to be better incorporated into decision making regarding water service delivery, and that conjoint analysis is an informative method to assist in generating this information. The study outlines a water service marketing challenge and methods of research followed to deal with it (Chapter One) and the nature of the laws and institutions governing water service provision in South Africa (Chapter Two). The task of providing water services is delegated to Water Service Providers (municipalities). The key variables of the water service mix from the consumers perspective include; quality of the water, rate of flow from tap, interruption of water flow, sewerage disposal, assurance of supply, and water service tariffs (Chapter Three). The study covers the areas of Amathole, Kouga and Nelson Mandela Bay Municipalities' (Chapter Five). The method of marketing analysis applied is conjoint analysis, alternatively known as choice experiment analysis. An overview of the method is provided and its application to three samples of one hundred residents at each of the study sites is described in Chapter Four. The responses of the three hundred residents provide the basis for the results. Respondents were requested to make a series of choices between alternative water service mixes consisting of six variables differentiated by three levels (Chapter Three). In making these choices they implicitly compared and weighed up the relative worth of the selected variables against each other. The findings of the analysis were diverse (Chapter Six); two of the three estimated models did not yield significant results. An interpretation of these results showed that the respondents of the Kouga municipality were willing to pay R65.05 more (per 10 xii Kilolitres of water) than their current monthly tariff for a marginal improvement in water quality, R57.29 more (per 10 Kilolitres of water) per month for a marginal improvement in sewerage disposal and R21.90 (per 10 Kilolitres) per month for marginal improvements in assurance of water supply. Findings showed that willingness to pay for reduced interruptions and improved flow rates was lower and not as highly valued as the abovementioned variables. Most of these findings were consistent with similar international and national studies showing their reliability. Although there has been significant improvement in extending the reach of the network since 1994, the standards of water service provision in South African municipalities do not appear to have improved. The results of this study mirror a number of concerns that have been expressed about the standards of service, particularly sanitation (in publications like the Green Drop Report). Municipal service delivery in these areas would appear to be constrained by a number of issues including a lack of public involvement, legislation, limited financial resources and institutional capabilities. However, it is a service that is too vitally important to be allowed to deteriorate. Marketing analyses can make a valuable contribution to allocating and managing the scarce resources to best satisfy the consumers of water services (Chapter Seven). When consumer orientation is formally introduced as the main objective into the thinking of the service provider, it becomes untenable to offer poor service delivery. But that is exactly what many municipalities appear to be doing. There is a need to get back to the basics – where the consumer is king. This analysis concludes that consumers want, above all else, assurance of water supply, a high quality of water, and safe environmentally sensitive disposal of waste water. It is recommended that municipalities not lose sight of the fact that price is an important part of the marketing mix. From the paying consumers perspective, when the government incorporate too many other considerations into pricing of water services they are, in effect, disengaging price from the marketing mix by not being sensitive to consumer needs. This approach shows a weak marketing strategy, and may result in dissatisfied consumers who may become unwilling to pay for their water services – an outcome that the researcher would discourage.

- Description: Business sustainability is a fundamental concern amongst business leaders and it is imperative that business defines an environmentally and socially sustainable path to financial prosperity. This focus on sustainable business practices has been caused by the perceived contribution of businesses to undesirable conditions such as environmental and social degradation including global warming and the global financial crises. This study suggests that a leadership style that differs from leadership that is currently causing business unsustainability is needed in order to achieve the goal of sustainable business practices. This study therefore proposes a new kind of leadership, called conscious leadership. The main contribution of the study is to increase the achievement of sustainable business practices by investigating the importance of conscious leadership in achieving this objective. Convenience sampling was used to select senior managers and directors from mainly JSE listed companies. This resulted in a total of 371 usable questionnaires (317 from listed companies and 54 from unlisted companies) being received. A quantitative approach was adopted to investigate whether conscious leadership would be related to increased sustainability competencies and more effective sustainability-related corporate governance and whether these in turn would increase sustainability behaviours which would generate sustainable business practices as measured by financial, social and environmental performance. Regression analyses were conducted to investigate the hypothesised relationships among these variables. Pearson correlations and descriptive statistics were also calculated. The empirical results showed that respondents in this study regarded conscious leadership, not as a separate construct, but as a way they governed their businesses. The empirical results showed that corporate governance and systems thinking competency had a strong interactive relationship and should therefore be cultivated within business firms. Corporate governance (including conscious leadership) and systems-thinking competency were positive influencers of employee relations, equal opportunities and workforce diversity. The empirical results however showed that corporate governance (including conscious leadership) had a negative influence on profitability. The present study cannot argue for the discouragement of corporate governance (including conscious leadership), as measured in this study, because reduced corporate governance would decrease healthy employee relations and the latter would decrease the achievement of equal opportunities and workforce diversity in these firms. A decrease in healthy employee relations would decrease profitability. The most important finding of this study is that senior managers and directors of big business firms, mostly JSE-listed companies, regarded conscious leadership as an important part of corporate governance. Corporate governance that includes conscious leadership must be developed to higher levels in business firms, so that the negative and not-significant relationships to profitability as viewed by lower and high conscious leaders respectively can be changed to positive relationships.

- Description: Using qualitative content analysis, this research study explored the Gauteng Provincial Government (GPG) social media use, with specific reference to Facebook, as a communication tool to engage with stakeholders. The study looked at how Facebook is used to promote two-way communication between the government and citizens, based on the principles of the Excellence Theory, which advocates for communication models developed by Grunt and Hunt (1984). The diagonal principles by Kent and Taylor (1998) used as a strategic framework to facilitate relationship building with the public and the organisations, were also explored. The results indicated that the majority of the departments are active on Facebook, however not at a satisfactory level. The majority of the departments failed to use all the six dialogic principles to leverage two-way communication, in particular creation of the dialogue loop which facilitates the building of ongoing relationships and feedback. Some of the departments have not fully taken the opportunity to increase the engagement and dialogue through posting photos on Facebook walls. The numbers of videos posted were extremely low. The majority of the departments utilised the social media platform, Facebook, as a one-way communication, such as publishing of media statements, announcements, media conferences and interviews among others. Most of the departments use Facebook for information dissemination especially on events and campaigns. The poor use of Facebook can be attributed to the challenges such as a lack of resources, especially a budget, lack of skills on effective use of social media, the continuous use of one-way communication by the government and a lack of budget among others. The findings correlate to the previous studies that found a lack of proper engagement, dialogue and interactivity on government’s Facebook pages.

- Description: Online information access on mobile devices is increasing as a result of the growth in the use of Internet-enabled handheld (or pocket-size) devices. The combined influence of recent enabling technologies such as Web 2.0, mobile app stores and improved wireless networks have driven the increase in online applications that allow users to access various types of information on mobile devices regardless of time and location. Examples of such applications (usually shortened to app) include: social media, such as FacebookTM App and TwitterTM App, banking applications such as (Standard Bank South Africa)TM Mobile Banking App and First National Bank (FNB) BankingTM App, and news application such as news 24TM App and BBCTM News App. Online businesses involved in buying, selling and business transaction processing activities via the Internet have exploited the opportunity to extend electronic commerce (e-commerce) initiatives into mobile commerce (m-commerce). Online businesses that interact with end user customers implement business to consumer (B2C) m-commerce applications that enable customers to access and browse product catalogue information on mobile devices, anytime, anywhere. Customers accessing electronic product catalogue information on a mobile device face a number of challenges such as a long list of products presented on a small screen and a longer information download time. These challenges mainly originate from the limiting and dynamic nature of the mobile apps operating environment, for example, dynamic location, bandwidth fluctuations and, diverse and limited device features, collectively referred to as context. The goal of this research was to design and implement a context-aware model that can be incorporated into an m-commerce application in order to improve the presentation of product catalogue information on m-commerce storefronts. The motivation for selecting product catalogue is prompted by literature which indicates that improved presentation of information in m-commerce (and e-commerce) applications has a positive impact on usability of the websites. Usable m-commerce (and e-commerce) websites improve efficiency in consumer behaviour that impacts sales, profits and business growth. The context-aware model aimed at collecting context information within the user environment and utilising it to determine optimal retrieval and presentation of product catalogue in m-commerce. An integrated logical context sensor and Mathematical algorithms were implemented in the context-aware model. The integrated logical context sensor was responsible for the collection of different types of predetermined context information such as device specification or capabilities, connection bandwidth, location and time of the day as well as the user profile. The algorithms transformed the collected context information into usable formats and enabled optimal retrieval and presentation of product catalogue data on a specific mobile device. Open-source implementation tools were utilised to implement components of the model including: HTML5, PhP, JavaScript and MySQL database. The context-aware model was incorporated into an existing m-commerce application. Two user evaluation studies were conducted during the course of the research. The first evaluation was to evaluate the accuracy of information collected by the context sensor component of the model. This survey was conducted with a sample of 30 users from different countries across the world. In-between the context sensor and main evaluation surveys, a pilot study was conducted with a sample of 19 users with great experience in mobile application development and use from SAP Next Business and Technology, Africa. Finally an overall user evaluation study was conducted with a sample of 30 users from a remote area called Kgautswane in Limpopo Province, South Africa. The results obtained indicate that the context-aware model was able to determine accurate context information in real-time and effectively determine how much product information should be retrieved and how the information should be presented on a mobile device interface. Two main contributions emerged from the research, first the research contributed to the field of mobile Human Computer Interaction. During the research, techniques of evaluating and improving usability of mobile applications were demonstrated. Secondly, the research made a significant contribution to the upcoming field of context-aware computing. The research brought clarity with regard to context-aware computing which is lacking in existing, current research despite the field’s proven impact of improving usability of applications. Researchers can utilise contributions made in this research to develop further techniques and usable context-aware solutions.
