- Description: Simulation is a complex task with many research applications - chiey as a research tool, to test and evaluate hypothetical scenarios. Though many simulations execute similar operations and utilise similar data, there are few simulation frameworks or toolkits that allow researchers to rapidly develop their concepts. Those that are available to researchers are limited in scope, or use old technology that is no longer useful to modern researchers. As a result of this, many researchers build their own simulations without a framework, wasting time and resources on a system that could already cater for the majority of their simulation's requirements. In this work, a system is proposed for the creation of a scalable, dynamic-resolution network simulation framework that provides scalable scope for researchers, using modern technologies and languages. This framework should allow researchers to rapidly develop a broad range of semantically-rich simulations, without the necessity of superor grid-computers or clusters. Design and implementation are discussed and alternative network simulations are compared to the proposed framework. A series of simulations, focusing on malware, is run on an implementation of this framework, and the results are compared to expectations for the outcomes of those simulations. In conclusion, a critical review of the simulator is made, considering any extensions or shortcomings that need to be addressed.

- Description: In Africa, the harvesting of fish from small reservoirs has been identified as an important food resource for small rural communities, particularly those living close to waterbodies (Kapetsky and Petr 1984, Marshall and Maes 1994, van der Knaap 1994). Development of fisheries to utilize these resources has recently been identified by the African Union as a priority investment area for poverty alleviation and regional economic development (NEPAD 2005). Chrysomya albiceps (Wiedemann) and C. marginalis (Robineau-Desvoidy) had the most widespread geographic and climatic distribution, while the forest-associated C. inclinata(Walker) was the least widespread. Chrysomya putoria (Wiedemann) and C. megacephala (Fabricius) had very similar predicted distributions that were restricted mainly to Limpopo, Mpumalanga, KwaZulu-Natal and the coast of the Eastern Cape. Chrysomya chloropyga (Wiedemann) and Calliphora croceipalpis (Jaennicke) were the only species predicted to occur at high altitudes. Blowfly distributions restricted to part of the map area were predicted better than those that were more widespread in the region, presumably because species with extremely widespread distributions in a study area occupy nearly the whole range of variation of most predictor variables, leaving little variation with which themaximumentropy modelling method can discriminate between presence and absence of the organism.

- Description: [From Introduction] Rhodes University maintained and improved its track record of research performance in 2009, a very pleasing trend given that it came directly after a large increase of accredited publication outputs in 2008 of 20.3%, and a flattening of the growth curve was expected. The increase in accredited publication units for 2009 of 6.4% (from 330.02 units to 350.99 units) is closer to the growth rate for the sector as a whole. This continued increase in research publications was achieved against the backdrop of substantial financial constraints and changes in the funding programmes of the National Research Foundation, a primary source of funding for researchers at Rhodes, which produced significant discontinuities in funding for several established researchers. Our journal output, (which accounts for 86% of our total accredited publishing output for higher education subsidy purposes) grew by 5.1% from 2008 to 2009 (from 287.82 units to 302.64 units). The previous year’s growth was 11.3% in this category. Coupled with Rhodes’s high volume of accredited journal outputs in relation to its size, a very pleasing quality measure was that 81.6% of Journal outputs (amongst the highest proportions in the sector) appeared in international accredited journals. Our output from accredited conference proceedings, (which in 2009 amounted to 7% of our total accredited publishing output) shrunk by 27.5% (from 33.22 units down to 24.07 units) from 2008 to 2009 – but from a small base where more year-on-year variance can be expected. This category had grown by 202% in the preceding year, so the 2009 reduction cannot be taken to represent a trend. The book outputs (which in 2009 amounted to 7% of our total accredited publishing output) increased by 170% – again from a very small base (from 8.89 units up to 24.28 units), where year-on-year variance is expected. This category had grown by 91% in the previous year, but had seen a negative growth of 83% in the year before that. The 2009 growth in this category is a combination of increased submissions, and an improved acceptance rate. The staff responsible for this process in the Research Office, and the researchers who made the submissions, are to be warmly congratulated. I add my warm thanks and congratulations to all of our researchers, funders, collaborators and partners who contributed to the excellent research results of 2009.

- Description: Small town economic decline has been experienced in many countries across the globe and can be explained through Geographical Economics, particularly the New Economic Geography, which suggests that agglomeration occurs as a natural outcome of high transportation and transactional costs. Yet despite the economic rationale behind their decline it is not an economic inevitability and there is evidence of towns in the United States, New Zealand and Canada that have reversed their economic fortunes. [n South Africa approximately 5 million people live in the 500 small towns and many more live in their rural hinterlands where povelty levels are extremely high within a national context. Within this context the thesis examines the current economic status and potential growth prospects of small towns in the Eastern Cape Midlands in South Africa in order to identify critical growth dri vers within small town economies. Five small towns were selected for the study via means of a purposive sample and were subjected to two regional modelling techniques, namely Shift-Share Analysis and Economic Base Theory to determine their current economic trends and past growth patterns, while a Social Accounting Matrix was utilised to identify important sectoral linkages, potential avenues for growth and evident leakages within small town economies. The sampled towns experienced negative economic growth trends between 1996 and 200 I, the primary loss in employment being accounted for by regional economic changes as opposed to national or industrial trends. The decline was more severely felt in primary/industrial sectors of the economy; evidence was found that manufacturing activities declined in all of the centres, despite the industry growing nationally. The Social Accounting Matrix highlighted strong links between the agricultural and services sectors within the national economy. Thus, considering that agriculture was identified as the primary economic driver within the region and the services sector the largest employer in all of the towns it is evident that the economic potential of the towns is to a certain extent linked to the success of agriculture in their hinterlands. Seven growth drivers, namely size, local economic development, existing markets, existing industries, infrastructure, municipal leadership and local entrepreneurs and were linked via means of a scoring framework to the sampled towns' economic potential. Whilst the results of actually determining a towns economic potential are not definitive the study does provide useful insights about the impact and potential role played by these drivers. Linked to this scoring framework and to Cook's (1971) hierarchy of places in the Eastern Cape Midlands four categories of towns were identified in the commercial falming areas and recommendations were made about appropriate developmental interventions at a municipal level, such as the need to retain local entrepreneurs and to invest in social amenities. Considering the evident need for development in rural areas the study provides critical insights into how to prioritise development strategies within small rural towns in commercial farming areas. On private lands, there is a need to find institutional, administrative and scientific responses to the alien plant problem that operate beyond the scale imposed by property boundaries (Slocombe 1998; Grumbine 1994). One such response is the development and support of institutions, such as the St Francis Conservancy, that foster cross-boundary management of landscapes (Hurley et al. 2002). This study seeks to promote collective decision-making and collaborative management by private landowners through the development of a resource allocation system for the control of alien invasive plants on the St Francis Conservancy. The conservancy is located in the south-eastern lowlands of the Cape Floristic Region, between the villages of Cape St Francis and Oyster Bay, and is comprised of the properties of multiple landowners. Mutliple Criteria Decision Analysis (MCDA) and Geographical Information Systems (GIS) techniques were integrated to provide a spatially explicit resource allocation system that considered environmental, social and economic concerns. The MCDA technique selected for use was the Analytical Hierarchy Process (AHP). This technique has a record of providing robust, defensible decisions and enabled the resource allocation decision-problem to be decomposed into a hierarchy of objectives, criteria and indicators. Stakeholders participated in the development of the resource allocation system, especially through providing input into the determination of the relative importance of criteria and indicators through the assignment of weights. Various weighting scenarios were presented and these were interpreted into an ii implementation plan. The costs and effort required to clear alien plants were estimated, and obstacles facing the implementation of the plan were identified.

- Description: This study investigates the relationship of bank customers’ behavioural patterns based on the customers past transactions, with respect to their profile characteristics. The main aim of this study is to illustrate that different categories of customers (based on demographical variables such as race, gender and age) have statistically significant differences in behaviour, with respect to how they operate their accounts. A theoretical overview on the literature of customer relationship management in the banking sector emphasises the importance of understanding customers to ensure that a business is successful. Four null-hypotheses where formulated based on a general research hypothesis. The data base provided a major South African bank is used to achieve the objectives. Extensive cleaning of the data set was necessary to ensure the validity of the results. The data set had 7860 customer keys. The large data base used contributed to the reliability of the results. The following behavioural variables were used in the study namely, transaction data, average debit and credit transaction amounts and average number of transactions per month. The main results of study indicate that different customer categories have statistically significant differences in behaviour, with respect to how customers operate their accounts. This implies that it is important for the banking sector to consider customer gender differences, age differences and race group differences in the relationship strategies which they employ in their multicultural environment. Further research in the area may be necessary before generalisation can be made on all banking customers.

- Description: This study investigates the relationship of bank customers’ behavioural patterns based on the customers past transactions, with respect to their profile characteristics. The main aim of this study is to illustrate that different categories of customers (based on demographical variables such as race, gender and age) have statistically significant differences in behaviour, with respect to how they operate their accounts. A theoretical overview on the literature of customer relationship management in the banking sector emphasises the importance of understanding customers to ensure that a business is successful. Four null-hypotheses where formulated based on a general research hypothesis. The data base provided a major South African bank is used to achieve the objectives. Extensive cleaning of the data set was necessary to ensure the validity of the results. The data set had 7860 customer keys. The large data base used contributed to the reliability of the results. The following behavioural variables were used in the study namely, transaction data, average debit and credit transaction amounts and average number of transactions per month. The main results of study indicate that different customer categories have statistically significant differences in behaviour, with respect to how customers operate their accounts. This implies that it is important for the banking sector to consider customer gender differences, age differences and race group differences in the relationship strategies which they employ in their multicultural environment. Further research in the area may be necessary before generalisation can be made on all banking customers.

The study also focused on how teachers can integrate local knowledge into the school curriculum. The setting of the research is Zizamele Senior Primary School situated in Zizamele community in Butterworth in the Eastern Cape. The study is designed in portfolio format. It consists of three separate studies: a contextual profile; a stakeholder analysis; and a small-scale action research project, which build on each other. By developing a contextual profile of the research site, and the school community and school gardens project, I was able to collect information that informed the stakeholder analysis and the action research study. Data for the contextual profile was gathered by using a variety of data gathering techniques like questionnaires and interviews. The findings were that: the study area is characterized by socio-economic issues like poverty, unemployment, drug abuse and crime. This requires that the people of the area take responsibility in addressing some of the problems by being involved and knowing where to report issues. The second study, which is the stakeholder analysis, was done to mobilize stakeholders’ contributions to the gardens project in Zizamele School, sponsored by the South African National Biodiversity Institute. Data was collected at meetings and workshops in the schools through interviews. Findings indicated that different stakeholders had various contributions to make and that they were prepared to work with the school and with each other to develop the school garden and the learning potential of the school garden. This paved the way for the small scale action research case study that would follow. The last study, the small scale action research, was undertaken in the same school, Zizamele School, and focused on investigating ways of integrating local knowledge into the curriculum and how teachers use the gardens as resource for teaching and learning, with reference to Life Orientation Learning Area. Data was collected by interviews, questionnaires and worksheets. The study involved two teachers who worked with me on the action research and Grade 5 and 6 learners, as well as some of the community stakeholders. The main finding of the action researched showed the potential for involving community members in the process of integrating local knowledge as a way of implementing aspects of the Life Orientation curriculum requirements. The three studies link with each other, and show that to start with an action research project, one needs to understand the context, and the roles of different stakeholders, and how they might contribute to the programmes in the school. Findings showed that teachers could use gardens as resource materials for teaching and learning, and that they could bring in local knowledge to the school curriculum.

- Description: Property rights are social institutions that define and delimit the range of privileges granted to individuals of specific resources, such as land and water. They are the authority to determine different forms of control over resources thus determining the use, benefits and costs resulting from resource use. That is, they clearly specify who can use the resources, who can capture the benefits from the resources, and who should incur costs of any socially harmful impact resulting from the use of a resource. In order to be efficient property rights must be clearly defined by the administering institution whether formal or informal and must be accepted, understood and respected by all the involved individuals and should be enforceable. These institutions influence the behaviour of individuals hence the impact on economic performance and development. The thesis has attempted to determine how the situation of property rights to land and water affects the development of smallholders in the Kat River Valley. Data was collected from 96 households who were selected using random sampling. To capture data, a questionnaire was administered through face-to-face interviews. Institutional analysis and ANOVA were used for descriptive analysis to describe the property rights situation, security of property rights and the impact of property rights on the development of smallholder farming. The results show that individual land rights holders have secure rights to land and water resources while communal smallholders and farmers on the invaded state land have insecure rights to land and water resources. The results from institutional analysis show that the situation of property rights negatively affects development of all smallholder farmers in the Kat River Valley. There are various institutional factors that negatively affect development of smallholder farmers in the Kat River Valley. Based on the research findings, some policy recommendations are made. These include consideration of the local context and strengthening of the protection of property rights.

Such competencies enable a clear focus on the business of construction and the management of projects, with increased efficiency and reduced costs as a benefit. The objective of the MSc (Built Environment) treatise study were to determine the current practices and performance of emerging civil engineering construction contractors operating in the Nelson Mandela Bay Metropole. The descriptive method was adopted in the empirical study. The salient findings of the study are: most of the emerging civil engineering construction contracting organisations lack construction management competencies; construction resources are inappropriately managed leading to construction failures; most of the emerging civil engineering construction contracting organisations lack adequate supervision resulting to poor workmanship; there is a shortage of skilled labour amongst emerging civil engineering construction contractors; procurement processes are inappropriate leading to under capacitated emerging civil engineering construction contracting organisations being awarded contracts; most emerging civil engineering construction contracting organisations lack the requisite aptitude for construction; there is a lack of capacity at all management levels of emerging civil engineering construction organisations in managing the business of construction and that of projects; the nine functions of organisations are not comprehensively represented, and self-ratings indicate inadequacy relative to the management function of control, and relative to certain activities of the organising function. Conclusions include that emerging civil engineering construction contracting organisations need to be comprised of technical teams that possess adequate competencies and that use the construction technology to its full use enabling their organisations to stay abreast of their competitors. Recommendations that can contribute towards improving the status quo include: formal civil engineering and construction management education, resources must be present and training should be promoted throughout the industry at all levels of management to ensure proper supervision and correct use of adequately trained labour, skilled or semi-skilled, incapacitated emerging civil engineering construction contractors should be awarded contracts through appropriately and structured procurement procedures, adequate aptitude in construction should be promoted and enhanced in order to realise conceptualisation and visualisation capabilities, comply with legislation, maintain records and communicate using state of the art technology, optimally manage the finances, have the requisite resources and undertake the work efficiently, interact with the respective publics, and market the organisation to ensure sustainability thereof.

- Description: South Africa's HIV prevalence rate is estimated to be 5.7 million and at the end of2007 a total of 45845 HIV/AIDS adult patients were taking antiretroviral therapy (ART). The global incidence of HIV/AIDS has been slowly decreasing over the years but is still widespread. This disease is still more prevalent in sub-Saharan Africa than in other parts of the world, with more than 60% people living with HIV/AIDS. Highly active antiretroviral therapy (HAART), the treatment of choice, slows the progression of the human immunovirus but demands a high adherence rate in excess of 95%. Patients who are poorly informed about antiretrovirals (ARVs) and misunderstand medicine-taking instructions or experience unexpected side effects may interrupt therapy, predisposing them to the development of resistance. Such patients need information but, given the poor literacy skills prevalent in South Africa, written information is often not fully comprehended and is often written at too high a reading level. The objectives of this research project were to design, modify and evaluate HIV / AIDS patient education materials for low-literate isiXhosa speaking adults residing in Grahamstown and to examine their impact on the understanding of various aspects of the disease and its treatment. Pictograms illustrating common side effects of ARVs (e.g. stavudine, efavirenz, lamivudine), as well as various sources 'for purchasing nonprescription medicines, storage and medicine-taking instructions were designed and evaluated both qualitatively, using group discussions, and quantitatively through individual interviews where interpretation of the pictograms was assessed. These pictograms were incorporated in a patient information leaflet (PIL) which had been specifically designed for people with limited reading skills and was a simple document containing the minimum of essential text. A previously developed PIL was modified in collaboration with the target population and two versions were produced, one incorporating pictograms illustrating side effects, the other with none. Pictograms were used in both to illustrate other medicine-taking instructions. The PILs were tested objectively to assess the readability, format, content, and general design. They were translated into isiXhosa prior to being qualitatively and quantitatively evaluated in a low-literate isiXhosa speaking population. Understanding of the PILs was assessed by asking a series of questions about the PIL content. Participant opinion of the readability and appearance of the PIL was recorded. The relationship between PIL understanding and selected demographic variables was investigated. Findings from this study illustrated that well designed pictograms assist in the location of information in written leaflets and they may enhance understanding of the information. It was further demonstrated that education influences total understanding of PIL content thus emphasizing the need for tailor-written information in accordance with the education level of the target population. A desire to receive PILs incorporating pictograms was expressed by the majority of participants. Collaboration with the intended target population is essential to design culturally acceptable, easily interpreted pictograms and to produce user-friendly, easy-to-read, comprehensible patient education materials. The rigorous, iterative design, modification and testing process described in this study is one that should be adopted in producing all health-related education materials.

A desire to receive PILs incorporating pictograms was expressed by the majority of participants. Collaboration with the intended target population is essential to design culturally acceptable, easily interpreted pictograms and to produce user-friendly, easy-to-read, comprehensible patient education materials. The rigorous, iterative design, modification and testing process described in this study is one that should be adopted in producing all health-related education materials.

The study explores changes that have occurred following the emergence of liberalisation of the radio airwaves in Lesotho from 1994, from almost a century of state owned and dominated national radio station. The central argument in this study is to establish if liberalisation of the airwaves in particular has a significant impact on the democratisation process in the country. Given the country’s limited literacy rate and historic role of broadcast media in Lesotho as a source of all major official information, private radio stations occupies a central role of mobilising and debating issues of national concern. The study, therefore, concludes that the emergence of the private radio stations in Lesotho has increased community participation in political and current affairs. The coverage of radio in the country and its pluralistic character suggest that the private radio stations will remain a crucial broadcast medium of communication in Lesotho, especially for the rural people whose access to television and print are inaccessible.

The bond yield data covers a nineteen-year period from January 1990 to July 2008, while the bond total return index data covers a nine-year period from August 2000 to July 2008. The international bond markets included in the study are Australia, Canada, Germany, Japan, the United Kingdom, and the United States. The examination of international bond market linkages across these markets has important implications for the formulation of effective portfolio diversification strategies. The empirical analysis is carried out in three phases: the preliminary analysis, the principal component analysis (PCA), and the cointegration analysis. For each analysis and for each set of data the full sample period is first analysed and subsequently a five-year rolling window approach is implemented. Accordingly, this makes it possible to capture the time-varying nature of international bond market linkages. The preliminary analysis examines the bond market trends over the sample period, provides descriptive statistics, and reports the correlation coefficients between the selected bond markets. The PCA investigates the interrelationships among the bond markets according to their common sources of movement and identifies which markets tend to move together. The cointegration analysis is carried out using the Johansen cointegration procedure and investigates whether there is long-run comovement between South Africa and the selected bond markets. Where cointegration is found, Vector Error-Correction Models (VECMs) are estimated in order to examine the long-run equilibrium relationships in addition to their short-run adjustments over time. The empirical analysis results were robust, and overall integration between SA and the selected major bond markets remained weak and sporadic. In addition, the results showed that even after accounting for exchange rate differentials, international bond market diversification remained beneficial for a South African investor; and since international bond market linkages remained weak with no observable trend, international bond market diversification will remain beneficial for some time to come for a South African investor.

Firstly was to analyze the Port Elizabeth Hospital Complex (PEHC) restructuring process from a planned changed management perspective in particular the three stage model of Lewin (1951) which include unfreezing the current equilibrium, moving to a new position and refreezing in the new position. Secondly was to analyze how unforeseen circumstances were dealt with. Thirdly was to analyse the setting of objectives and measurements of targets to monitor progress. The study is based on the restructuring that took place in the PEHC which was called “Rationalization”. The research indicates that the development and implementation of the rationalization cannot be understood from the perspective of the three stage model of Lewin (1951). The conclusion was based on the manager’s perceptions of their analysis of the restructuring in the light of the theory of the three stage model of Lewin (1951). The study has shown that: · Rationalisation began by gathering information on the shortcomings of the structure of the three hospitals, but did not understand the degree of readiness to change. · The timescales for achieving rationalization were not clearly defined. · It was driven from the top with clear objectives and no timescales. · There was no structure that prepared the employees to go through the process of rationalisation. · There was lack of capacity of middle managers to respond to the workers in an encouraging way. · Rationalisation sub-committees had limited time to meet with employees at the sectional level. · External stakeholder involvement was not mobilized to its full potential. · Rationalisation was not an open process that involved both formal and informal employees. · Budget constraints and staff shortages were not informed by the restructuring needs. · Workers did not feel secure about the current and future work practises. · There was no feeling that the change will be beneficial to their wellbeing and to the organisation’s goals and mission · There was no monitoring and evaluation put in place to track progress. · There was centralisation of even the most basic administrative functions. The study seems to imply that the restructuring in the PEHC bears no resemblance to the Lewin (1951) planned change model and therefore cannot be understood from the perspective of this model. Given the initiative to rationalize, the PEHC management can learn from the model of Lewin (1951) planned change.

Only five Ford plants globally will be producing the PUMA engine (Turkey, UK, Thailand, Argentina and South Africa – Ford Struandale Engine Plant). The Ford Struandale Engine Plant will be the only plant which will have the I4 assembly, I5 assembly and 3C (Crank, Cylinder Block, and Cylinder Head) machining and the expectations of operating in a lean environment is high. The management team at the Ford Struandale Engine Plant needs to understand what the underlying factors that are hindering the improvement of Overall Equipment Effectiveness of the plant or, in other words, they need to be informed of the total benefits of TPM. A literature review was conducted to determine what the theory reveals about Overall Equipment Effectiveness, the three factors of OEE (Availability, Performance Efficiency, and Quality), the influence of Six Big Losses on each of the factors and the role of Total Productive Maintenance in improving OEE by eliminating these Six Big Losses. A Ford literature study was conducted to reveal the current literature being applied at Ford. This was then followed by an empirical survey conducted within the Ford Struandale Engine Plant. In addition, a task team formed to analyse the current maintenance operating strategy. Finally, the findings from discussions with the task team, the empirical survey, Ford Struandale Engine Plant literature survey and a general literature survey were amalgamated to draw conclusions relating to the Ford Struandale Engine Plant. These conclusions indicate what the underlying factors are that are hindering the improvement of Overall Equipment Effectiveness of the Ford Struandale Engine Plant facilities and equipment. Then recommendations are made as to how the Ford Struandale Engine Plant can improve the Overall Equipment Effectiveness of its facilities and equipment.

As a result of my research I argue in this paper that it might be useful for writing consultants/lecturers to think of their feedback to students' writing in terms of these categories and to consider whether they have helped students to develop their writing by taking into account the features of the particular social context in which the writing takes place.

- Description: Competitive forces in the market force employers to change the way they operate their businesses. The changes that employers have to make often demand an alteration of the employees’ terms and conditions of employment. By law employers are not permitted to unilaterally effect changes to the employee’s terms and conditions of employment. They have to obtain the consent of the affected employees. This is where collective bargaining fits in. The employer has to negotiate with the employees. One way in which through the process of collective bargaining an employer can exert pressure on the employees to accept the changes is to effect a lock-out. Under the Labour Relations Act 28 of 1956 within the context of a lock-out, an employer was permitted to use conditional dismissal as a bargaining weapon. This conditional dismissal had to be coupled with an offer of reemployment should the employees accept an employer’s demand. In essence, the lock-out had a bite in the form of the conditional dismissal. This made the lock-out quite effective. The 1995 Labour Relations Act prohibits in no uncertain terms the use of a dismissal as a means of compelling employees to accept an employer’s demand in any matter of mutual interest. Within the collective bargaining context, dismissal is not a legitimate option. The employer only has the lock-out as a tool of compulsion. The definition of a lock-out in terms of this Act does not accommodate the use of dismissal. This makes the lock-out option to be less potent than it was under the 1956 Labour Relations Act. However, employers are permitted to dismiss on operational grounds, provided that they follow a fair procedure. Terms and conditions of employment greatly feature in the operational requirements of a business. If the employees’ terms and conditions of employment are not responsive to the operational requirements of the business and they are unwilling to accept changes to those terms, the employer has the right to dismiss them. The employer will not be dismissing the employees as a way of inducing them to accept the changes. He will instead be dismissing them on the basis of operational requirements. iv The question that then arises is how should a dismissal that is intended to compel employees to accept an employers demand (falling within section 187(1)(c) of the 1995 Labour Relations Act be distinguished from a dismissal that is genuinely based on operational requirements as contemplated by section 188(1)(a)(ii). Doesn’t the fact that section 187(1)(c) explicitly prohibits the use of dismissal within the context of collective bargaining give rise to some tension with section 188(1)(a)(ii) which categorically gives employers the right to dismiss on operational grounds. The decision of the Labour Appeal Court in Fry’s Metals v NUMSA has stated that there is no tension whatsoever between the two sections. The court has also ruled that the dismissals that are hit by section 187(1)(c) are those dismissals that are accompanied by an offer of reemployment. According to the court, this offer is indicative of the real purpose of the employer, namely to compel employees to accept his demand. Dismissals not accompanied by an offer of re-employment are on the other hand a true reflection of the fact that the employer is indeed dismissing the employees for operational requirements. This literal interpretation of the meaning and scope of section 187(1)(c) has the potential of opening the floodgates. Instead of resorting to the use of the lock-out to secure the agreement of employees in the collective bargaining process, employers now have a potent tool in the form of a dismissal. As long as the employer makes it abundantly clear that the dismissal is final and irrevocable, he is free from the claws of section 187(1)(c). Given the fact that the lock-out option is not always effective, employers may find it hard to resist the temptation to use the threat of permanent dismissal as a bargaining chip. It is an option that is emasculated by the fact that in an employer initiated lock-out the use of replacement labour is prohibited. The threat of not just a conditional dismissal but a permanent one may force employees to capitulate to the employer’s demand during negotiations. This would effectively render negotiations about changes to terms and conditions of employment a farce. The employer would have an upper hand. The implications of this narrow interpretation are quite far-reaching. The long held view that dismissal is not a legitimate weapon of coercion in the collective bargaining process is under serious challenge. Only conditional dismissals are illegitimate in the collective bargaining v arena. Permanent dismissals are permitted. This negates the very purpose of the collective bargaining process. This study seeks to examine the anomalies that flow from this interpretation of the meaning of section 187(1)(c). The study further investigates if this interpretation is not at odds with what the legislation really intended to achieve by enacting this clause. The study also explores ways in which the sanctity of collective bargaining could be restored. Recommendations are made to that effect.

- Description: Competitive forces in the market force employers to change the way they operate their businesses. The changes that employers have to make often demand an alteration of the employees’ terms and conditions of employment. By law employers are not permitted to unilaterally effect changes to the employee’s terms and conditions of employment. They have to obtain the consent of the affected employees. This is where collective bargaining fits in. The employer has to negotiate with the employees. One way in which through the process of collective bargaining an employer can exert pressure on the employees to accept the changes is to effect a lock-out. Under the Labour Relations Act 28 of 1956 within the context of a lock-out, an employer was permitted to use conditional dismissal as a bargaining weapon. This conditional dismissal had to be coupled with an offer of reemployment should the employees accept an employer’s demand. In essence, the lock-out had a bite in the form of the conditional dismissal. This made the lock-out quite effective. The 1995 Labour Relations Act prohibits in no uncertain terms the use of a dismissal as a means of compelling employees to accept an employer’s demand in any matter of mutual interest. Within the collective bargaining context, dismissal is not a legitimate option. The employer only has the lock-out as a tool of compulsion. The definition of a lock-out in terms of this Act does not accommodate the use of dismissal. This makes the lock-out option to be less potent than it was under the 1956 Labour Relations Act.
