Occupational health and safety and industrial relations in the South African construction industry : case studies of selected construction firms in Grahamstown

- Description: The construction industry is one of the most dangerous industries in the world, with many workplace fatalities every day. The existence of legislation that governs Occupational Health and Safety (OHS) is an intervention to ensure that all governments, employers and employees play their part in establishing and implementing policies that will help secure healthy and safe working environments. The study is qualitative and with the help of an interview guide, semistructured interviews were used to collect the data. The respondents were selected using purposive and snowball sampling methods. Ten managers from ten (five small, five large) construction firms, two employees from each firm, and the OHS inspector from the Department of Labour in Grahamstown were interviewed. Having explored management’s practices, communication methods, training and distribution of information, employee representation and participation, and industrial relations, several conclusions were reached. During the study it was found that there are a number of obstacles that are hampering effective OHS in the construction industry. Some of these include; management’s lack of commitment to a participatory approach in OHS decision-making, limited resources to invest adequately in OHS, and the lack of sufficient trade union involvement. In addition, we know very little about OHS in the construction industry, and the mere existence of OHS legislation does not help reduce the risks associated with construction work, especially when there is a shortage of skilled personnel to enforce the legislation and regulations.

- Description: The following dissertation sets out to investigate the decline of agriculture in Mission location at Butterworth, Transkei, using the Rehabilitation Scheme as a benchmark. The scheme was introduced in 1945 to combat soil erosion and improve agriculture in the African reserve areas, as the South African government claimed. The dissertation argues that this claim by the government served to mask the real intentions behind the scheme namely, to regiment the migrant labour system by depriving as many Africans as possible of productive land so that they were unable to fully subsist by means of agriculture. This is further shown by analysing the impact of the Rehabilitation scheme in Mission location in which a substantial number of people lost arable land as a result of the implementation of the scheme in 1945. These people were consequently denied the wherewithal to subsist by agriculture. Moreover, the efforts of the government resulted to a modernisation of agriculture by making it more cash-based- for example through the introduction of fencing, the need for tractors as a result of a decline in stock numbers (in part as a result of stock culling). Most people could hardly afford this type of agriculture and were consequently forced off the land. The dissertation concludes that indeed the decline of agriculture in Mission location can be linked to the changing agricultural and land-holding practices brought about by the government- especially the introduction of the Rehabilitation scheme.

In an effort to achieve high production outputs while saving on operational costs, employers have been seen incorporating more non-standard labour. In the agro-processing industry, non-standard labour has been in the form of seasonal workers which has been a matter of concern to state structures tasked with ensuring company compliance with labour regulations, especially as it relates to the protection of workers within the industry. Many of these workers are offered little protection, sub-standard working conditions, irregular working hours, having little or no benefits, lacking skills and often facing a lack of trade union representation (Fourie, 2008:111). The introduction of section 198B of Labour Relations Act (LRA) has been designed to address the rights of non-standard workers and to provide protection against exploitative practices within various industries (Griessel, 2015:1). The thesis focuses its attention on the role of social reproduction and the labour process in perpetuating domination and inequalities within the workplace. Further, the thesis examines the challenges of non-standard labour and the difficulties of regulating it in practice. It also discusses the livelihood strategies adopted by seasonal workers when not employed, in this case, by Carara Agro Processing Services. - Description: The COVID-19 pandemic has exposed the fragility of economies in times of a global crisis while simultaneously increasing inequalities between and within countries. The pandemic responses have varied between countries with some being extremely proactive and others being quite reluctant to respond. Though it is largely a health crisis, its impact has far reaching effects that have been felt in many sectors of society including education. Billions of scholars at varying levels were forced out of school abruptly globally and unfortunately some have not been able to return to schools. The differential impact of COVID-19 in education is evident not only at a global level, but national level as well. The primary focus of this research is the impact of COVID-19 on the teaching practices applied in Zimbabwean schools. Zimbabwe, a developing nation in the southern region of Africa, has a long history of a thriving education sector recognised internationally. However, in the wake of the pandemic, the research attempts to understand the experiences of teachers in private and government schools in the hope of showing the dilapidation and unevenness of the sector, across the private-public divide. COVID-19 comes at a time when the country’s economy and healthcare system continue to exhibit signs of struggle and collapse. The research made use of qualitative research methods and in-depth interviews with teachers from public and schools around the town of Marondera. This however has been undermined for a number of reasons, such as state incapacities and the state’s neo-liberal overreliance on the market to remedy past injustices. At the same time households, as critical sites of social reproduction in poor urban black communities and under conditions of extreme vulnerability, engage in a range of productive and non-productive activities often in a desperate bid to construct and maintain a semblance of livelihood sustainability. The thesis seeks to critically understand the relationship between state housing programmes and the diverse livelihood activities of poor urban black households in South Africa in the context of an ongoing systemic crisis of social reproduction which exists in these urban communities. This is pursued with specific reference to eZamokuhle Township in Amersfoort, Mpumalanga Province. The thesis is framed conceptually in terms of the notion of social reproduction. In doing so, it brings together two sets of literature which are often disconnected. On the one hand, there is South African literature which critically analyses the post-apartheid state’s housing programmes including the many challenges which exist in this regard. On the other hand, there is literature which considers the urban livelihoods of poor black communities in contemporary South Africa and often from within some kind of livelihoods perspective. The thesis is innovative in bringing these two sets of literature together in terms of the overarching notion of social reproduction and providing, therefore, a more holistic and integrated understanding of the multi-dimensional character of social reproduction. The depth of the crisis of social reproduction in eZamokuhle is explicated and examined in this way but in a manner which articulates the lived experiences and agency of eZamokhule households despite vulnerability constraints and challenges.

- Description: As a result of apartheid’s history, the current South African government was initially faced with two major challenges in the development of sustainable human settlement in urban areas: delivering the quantity of houses needed to reduce the massive housing backlog (notably in black townships) and overcoming the problem of racially-based spatial separation inherited from the apartheid era. To rectify the legacies of apartheid, the state has sought to pursue a massive housing programme in urban areas for poor urban blacks. In doing so, though, it has worked within the confines of the racially-segregated South African city and has adopted a macro-economic policy with a pronounced neo-liberal thrust. This thesis examines the South African state’s housing programme with reference to questions about social sustainability and specifically sustainable human settlements. It does so by highlighting social capital and the different forms it takes, notably bonding, binding and linking capitals. This is pursued through a case study of a small area of a black township in Grahamstown called Hlalani. The case focuses on the lived experiences of Hlalani residents and their intra-household and inter-household relations as well as their linkages with local state structures. It is concluded that social capital is weak and incipient in Hlalani and that Hlalani could not, by any definition or measurement of the term, be labeled as a sustainable human settlement.

- Description: The purpose of this study is to explore the role of NGOs in land reform and post-settlement support in the Albany district of the Eastern Cape using a qualitative case study of Masifunde. To discover this role, civil society, land beneficiaries, Department of Agriculture and Department of Rural Development and Land Reform were proved to have interwoven relationships. The interactions and relationships between these entities underpinned their perceptions of each other. This study is set against the backdrop of a weakening land reform program due to frequent policy changes. Evidence presented showed how out of sync land reform is with its original mandate whilst civil society organisations have remained firmly rooted by theirs. The inability to have twin perspectives on this matter diverges the direction civil society and institutions involved in land reform take on. This separation in direction demonstrates the need for engagement between government and civil society in an attempt to assist in areas government is unable to reach or address. This thesis contends that there is definitely a role that NGOs do play and need to take on when it is evident that relevant actors are unable to deliver. Themes emerging from interviews necessitate civil society and government departments to combine their resources so as to maximise the impact for desired outcomes. These are views of both civil society and government, demonstrating that NGOs indeed do play a role in land reform and post-settlement support and need to continuously do so in an attempt to cushion the blows of uneven implementation of land reform policies.

- Description: The purpose of this study is to explore the role of NGOs in land reform and post-settlement support in the Albany district of the Eastern Cape using a qualitative case study of Masifunde. To discover this role, civil society, land beneficiaries, Department of Agriculture and Department of Rural Development and Land Reform were proved to have interwoven relationships. The interactions and relationships between these entities underpinned their perceptions of each other. This study is set against the backdrop of a weakening land reform program due to frequent policy changes. Evidence presented showed how out of sync land reform is with its original mandate whilst civil society organisations have remained firmly rooted by theirs. The inability to have twin perspectives on this matter diverges the direction civil society and institutions involved in land reform take on. This separation in direction demonstrates the need for engagement between government and civil society in an attempt to assist in areas government is unable to reach or address. It examines the ways in which organisations navigate different internal, sectoral and contextual intricacies while operating under the command of their chosen developmental mandates. This description is drawn from a sociological analysis of the internal workings of education NGOs, their external affiliations as well as the negotiations which underpin their operations and survival. Collectively, the careful illustration of these underpinnings outlines both the role that NGOs play in the performance and retention of learners in the Grahamstown-east township of Joza and also their position in the town’s basic education sector. Private and non-governmental interveners have, particularly from the closing decades of the 20th century, been conceptually and operationally deployed as panaceas of the socio-economic scarcities which continue to pervade much of the ‘developing’ world. Their involvement in the socio-economic missions of populations living in the Global South has grown both laterally and in the depth of how development is understood and defined, carried out and also measured. NGOs, as widely acclaimed institutional arms of global development imperatives, therefore assume prominent positions in framing policy and implementation models, prescribing performance benchmarks and pronouncing non-compliance. Likewise, education NGOs have obtained normative prescription status in global education policy and practice largely on the back of the Education for All (EFA) objectives, the Millennium Development Goals (MDGs) and the neo-liberal logics which have championed state retreat in favour of private sector ascendance in globalised development. This, in conjunction with the persistent struggles of educational transformation in the Global South, has given NGOs little trouble in legitimising their prominent presence in education and other sectors of socio-economic relief in these parts of the world. Little illusion remains however, in many commentary circles, of the role of NGOs in advancing development ideals, the honesty of their altruistic intents, their ideological leanings as well as their efficacy in carrying out their mandates. As such, the logics which have been used to dethrone developing state structures in order to expand the space for private intervention along with the prevailing and deepening markers of educational underperformance, have been central features of the criticisms levelled against NGOs. This thesis intervenes in these ongoing reflections by describing the role of NGOs in educational outcomes, particularly learner performance and retention in Joza. This analysis demonstrates the organisational, sector-level and broader community forces which influence not only the form which non-state interventions take on and the daily preoccupations of their carriers but broadly, the position they occupy in the town’s overall educational profile. By way of locating NGOs within Grahamstown’s educational landscape, this thesis first demonstrates, the conflicted nature of NGO operations from an international, sectoral, national, local and organisational level. The discussion then illustrates how the preoccupations of NGOs are scattered between the different communities which they occupy within these levels. Their reliance on these players demands that organisations be tactical in guarding both their survival and, at times, the conflicting allegiances which grant them different forms of legitimacy. Internal struggles which characterise this imbalance of forces results in a trade-off which often favours organisational preservation mechanisms over systemic educational overhaul. As such, while non-state interveners can be lauded for extending educational support to those who would otherwise not have such, the gains of NGO intervention are often absorbed by internal urgencies for organisational legitimacy and preservation. This, in a context which possesses a unique set of socio-economic and educational deficits that require, at the very least, radical and unbridled mediation, means that pre-existing inequalities in educational inputs and outcomes along with the resultant inequities in youth socio-economic prospects, can find refuge in the very sector whose support and intervention is sought out and justified for such. This thesis lays out the nuances of these tensions and contradictions and offers this case as a point of reference for further considerations of the persistent markers of underperformance which characterise developing communities that enjoy high concentrations of non-state educational intervention.

The area of study, the Chris Ham District Municipality (CHDM), is a Water Services Authority, responsible for ensuring access to water services (water and sanitation) by all communities within its jurisdiction. There are eight local municipalities within the CHDM. The objective of this study is to determine whether systems are in place in local government to promote participation by communities in service delivery projects and whether these systems are being utilised efficiently by the role-players concerned. The role-players in this research are people who are involved in community development programmes of the municipality (municipal staff in the relevant departments of the municipalities under study, the social facilitators, civil society organisations, ward committees, ward councillors, traditional authorities as well as the representatives of communities (Project Steering Committees) who are beneficiaries of the projects under study). The projects that are under study were selected from a readily available list of CHDM capital projects that appear in the 2003/2004 financial year funding plan and are running. The findings of the study at both levels (local and district) show that the municipal environment is not conducive to promoting community participation. This is linked to factors such as the structural arrangements, whereby the offices relevant for promoting community participation are not fully occupied, which provided evidence that community participation is not prioritised. There is lack of coordination of programmes within the local government spheres as well within departments of the DM and strategies for community participation have been found to be non-effective. At project level lack of community participation is linked to the utilisation of ward committees as the only mechanism for community participation regardless of its un-equal and party biased representation. This study therefore concludes that although the systems to promote community participation are in place, they are not effective.

The grant system is meant to provide recipients, who comprise mainly people from poor black households, with the capacity to reduce levels of poverty in their households. The grant with the largest number of recipients is the child support grant, and it is given to the caregiver of a child eligible to receive the grant. Though the value of the monthly grant is minimal, the prevailing literature suggests that it does contribute in some way to enhancing the welfare of the recipients. This thesis focuses on child support grant recipients in the town of Queenstown in the Eastern Cape, and particularly those recipients for whom the grant is the crucial source of income. The main objective of the thesis is to understand and analyse the lives and livelihoods of child support grant recipients (all women) in Queenstown, South Africa. In this regard, the vast majority of caregivers of grant children are women and they often rely exclusively on the grant in taking care of themselves and the children. The thesis does not seek to determine any direct causal relationship between the child grant and poverty reduction, as much of the existing literature seeks to do. It focuses instead on the lives of the grant recipients, including the many challenges they face, as well as how they use the grant to pursue livelihoods in a manner which may at least inhibit the prospects of entering into deeper levels of poverty. The thesis demonstrates that, despite their deprived conditions of material existence, the female caregivers in Queenstown display significant agency in caring for their grant children.

- Description: Recent studies have shown that graduates from historically White universities (HWUs) experience better labour market outcomes than graduates from historically Black universities (HBUs). This is a result of the legacy of apartheid which promoted racial inequality in all spheres of South African society, more especially in higher education and the labour market. Post-1994, government dedicated large amounts for the restructuring of the higher education sector of South Africa in order to level out the playing field. However, graduates from HWUs still experience better labour market success than graduates from HBUs. That said, there is limited information about the labour market outcomes and experiences of graduates from a former White university (especially graduates from Rhodes University). Therefore, the central aim of this dissertation is to show that graduates from a historically White university (Rhodes University) experience varying and unequal outcomes in the South African labour market on account of (among other factors) their chosen fields of study, race and sex. This study is informed by the heterodox labour market approach, which is partly inspired by the critical realist account of the labour market. As a result, this theoretical framework allowed the researcher to use the Labour Market Segmentation (LMS) theory as a tool to inform this analysis. The study has adopted a quantitative survey design and has incorporated some of the key methodological lessons learned from the collection of international graduate tracer studies. The findings from this study indicated that ‘field of study’ is a strong determiner of the outcomes of Rhodes graduates in the labour market. This was visible in the persistence of a skills bias towards commerce and science graduates. Evidently, even when we controlled for race and sex, graduates from the commerce and science faculties experience better labour market outcomes than humanities graduates. This is a result of a skills biased South African economy, which has a higher demand for certain skills over others. However, the findings from this study also show evidence of pre-labour market discrimination and inequality (based on race and sex) in the supply-side institutions such as the family, schooling and university. The findings also show continuities and discontinuities of labour market discrimination (based on race and sex) in the outcomes of Rhodes graduates in the South African labour market. More importantly, this dissertation indicates that Rhodes graduates experience varying outcomes in the labour market as a result of (among other factors) their chosen fields of study, race and sex.

This thesis aims to transcend the tendency to attribute poor service delivery to a sole cause (e.g. corruption) by explaining the effects of strategic planning and oversight on several municipal service delivery processes. Therefore, this thesis introduces the Municipal Public Resource Management (MPRM) model as a strategic management tool to explain the relationship between strategic planning, the practical implementation of municipal services, and oversight processes. Specifically, thesis triangulates legislative mandates, documents published by Inxuba Yethemba Municipality (IYM) and responses from semi-structured interviews conducted with three municipal officials and three Municipal Public Accounts Committee (MPAC) councillors to uncover descriptions and explanations of service delivery processes in IYM. In the past 26 years, South Africa has seen an increase in academic research establishing causal links between boys, men, masculinities and a number of social ills such as the HIV/AIDs epidemic, violence against women, substance abuse, homophobia, gender-based violence and a lower pass rate amongst boys. This in turn inspired an increase in interventions seeking to involve boys and men in order to identify and address their role in combating gender based violence. These various forms of social deviances that have been linked to masculinity have indicated that young men's masculinity is in crisis and as a result needs great attention in order to address the social issues linked to them. Institutions of higher learning have proven to be microcosms of the larger society. Universities have become highly sexualised spaces; coercive sexual practices in heterosexual relationships are a norm, young women don't feel safe and have lost confidence in universities addressing their concerns. With the emergence of the #RUreferencelist in 2016, the spotlight fell on Rhodes University; young women challenged the rape culture and sexual assaults on campus. In 2016, staff members who are well-informed and educated on issues of gender, sexuality and rape initiated discussions with students in their residences; these discussions were later to be called the Consent Talks. This research makes use of Pierre Bourdieu’s critical theory in understanding how young men negotiate their masculinity within the field of higher education, at Rhodes University. Bourdieu’s three main concepts, field, habitus and capital are used to describe how young men negotiate their masculinity and how the field of gender intersects with the field of higher education. A qualitative paradigm has been employed. The study has collected data through the use of in-depth interviews to get a richer insight into the participants’ perspectives. There were 15 interviews conducted in total for this study, 14 were with first year male students, and one with a senior official of the University. The data was analysed through a qualitative thematic analysis. The findings of the research reveal that some of the participants were exposed to patriarchal and dominant forms of masculinity when growing up. However, most of the participants revealed they were also exposed to alternative masculinities. These were either taught or learnt at home, from family members, circumcision school, church or peers in society. Both the dominant and alternative masculinities were revealed in the discourses of what it means to be a man and in how the young men performed their masculinities. Furthermore, one of the major themes that emerged was that most of the young men in the study were raised by single mothers with mothers playing a significant role in encouraging healthy masculinities. The findings went on to reveal that families (mothers, fathers, older siblings and culture) play a role in socialising and shaping healthy masculinities. The acceptance or rejection of either dominant or alternative masculinities was influenced by an exposure to an environment that either encouraged or shunned either dominant or alternative masculinities. The findings further unveils that different societies are strongly identified with their own definitions of what it means to be a man and are not open to other definitions of masculinity. Moreover, most of the participants accepted the content of what was taught in the Consent Talks; however sought healthy participation, interaction and inclusion of female students. Lastly, the study has also revealed that knowledge of the consequences of breaking (the law) university’s policy does affect some change of behaviour in potential perpetrators.

Structures and struggles of rural local government in South Africa: the case of traditional authorities in the Eastern Cape

- Description: This thesis is about the political implications of the constitutional recognition of the hereditary institution of traditional leadership in post-1994 South Africa for the democratization process in the rural areas of the former Bantustans. The thesis is organized around three related conceptual, historical and political questions. The conceptual question deals with the meaning of democracy in rural areas under the jurisdiction of traditional authorities. The historical question traces how the institution and traditional authorities have survived to the present post-colonial period. Lastly, this study investigates the political issue of why an ANC-led government came to recognize the institution. The focus of the thesis is the sphere of rural local government in the Xhalanga district, where these issues are best illustrated. The thesis argues that the institution of traditional leadership and its officials survived precisely because they were incorporated into the colonial and apartheid administrative structures in the project of indirect rule. Traditional authorities were central to the apartheid policy of retribalisation, which was essentially a form of control of Africans in the Bantustans. Rural residents engaged in fierce struggles against the imposition of rural local government structures such as the District Council and Tribal Authorities. In so far as traditional authorities were part of government structures, they could not avoid being targets in these struggles. In explaining the recognition of the institution of traditional leadership, the thesis focuses on the policies of the ANC, the majority party in the Government of National Unity, towards traditional authorities. Organisationally weak on the rural grounds, the ANC operated through what they considered to be “good/progressive/comrade chiefs”. The ANC had hoped that these traditional authorities would accept a non-political ceremonial role. However, traditional authorities have rejected this ceremonial role. Their refusal, coupled with the ANC’s ambivalence in resolving the tension imply, the study concludes, that the (political) citizenship rights of rural people are partial: they are neither citizens nor subjects.

The World Health Organisation’s (2016-2017) recommendations for Pre-exposure Prophylaxis has been accepted and rolled-out nationwide by the South African Department of Health. This is to maintain the HIV-negative status of not only the general public, but specifically students at higher institutions of learning. PrEP has been integrated with other HIV prevention methods through the Higher Education and Training HIV/AIDS programme. Semi-structured in-depth interviews were conducted with five female and four male students, and six health care staff members at Rhodes University. Data was thematically analysed, and the findings show that there is a lack of knowledge of both the HIV policy and Pre-Exposure Prophylaxis among the participating students. However, the staff members are knowledgeable due to the fact that they work in health care.

In South Africa, sectoral determination 7 was specifically developed to protect domestic workers’ rights and provide them with the means to negotiate with and hold employers to account. However, research over the past years has demonstrated that, while some areas of domestic labour have improved, many workers are still locked in exploitative labour relationships. This research shows that it may seem as if there are significant changes in this sector since the introduction of the sectoral determination, but paternalistic orientations, one-of-the-family myths, and food distribution suggest otherwise. The research concluded that continuities of exploitative and discriminatory practices are still prominent in the employment relationship when viewed through the lens of paternalistic care, food distribution, and the ‘one-of-the-family’ myth.

The participants were also asked about the general development of the farm since ownership was transferred to the community in 2001. The study revealed disappointing results in the state of the farm, and the lack of development that has taken place. This was evident in the functioning of the CPA, and the high unemployment which was prevalent on the farm. There were elements of dependency which resulted from the mentorship of the agribusiness, as well as a lack of state support in the general operations of the farm.

The methodology which was used in carrying out the research was descriptive research design and purposive sampling was used in which a sample of 21 respondents who are leaners were picked and 5 teachers who teach CSE were chosen. The interview schedule was used to collect data from the sample which was drawn. The data gathered was analysed using concepts and themes as well as observer impression. The findings of this research are that there is a framework that informs the teaching of CSE in schools whose aim is to curb school drop outs by reducing teen pregnancies and high infection rates of STIs and HIV/AIDS. The framework seeks to empower knowledge on the adolescents in relation to gender norms, rights in relationships and sexuality. The major findings of the research are that culture has an influence on the teachers and leaners. Of particular discovery is the use of symbols through charts which display human private parts. This is construed by the teachers and learners to be against their cultural beliefs. Furthermore, language that this subject uses is culturally seen to be too strong and vulgar , to both teachers and leaners. This study found out that open discussion in class of the topic on sexuality does not sit well with the leaners as it is against their cultural orientation. The interview schedule was used to collect data from the sample which was drawn. The data gathered was analysed using concepts and themes as well as observer impression. The findings of this research are that there is a framework that informs the teaching of CSE in schools whose aim is to curb school drop outs by reducing teen pregnancies and high infection rates of STIs and HIV/AIDS. The framework seeks to empower knowledge on the adolescents in relation to gender norms, rights in relationships and sexuality. The major findings of the research are that culture has an influence on the teachers and leaners. Of particular discovery is the use of symbols through charts which display human private parts. This is construed by the teachers and learners to be against their cultural beliefs. Furthermore, language that this subject uses is culturally seen to be too strong and vulgar , to both teachers and leaners. This study found out that open discussion in class of the topic on sexuality does not sit well with the leaners as it is against their cultural orientation. The research also found out that there are lessons in CSE that are beneficial to the learners such as , how to prevent contracting of STIs and HIV/AIDS and prevention of unwanted pregnancies. , Thesis (MA) -- Faculty of Humanities, Sociology, 2022
