- Description: The motivation for this study is that Health Resource Centres of the Eastern Cape ought to provide access to high quality, relevant and appropriate information that is evidence-based and responsive to the needs of health professionals thereby assisting health professionals accomplish their tasks. In order to provide access to quality information, the Health Resource Centres are expected to provide information services within an acceptable framework of service standards. This study seeks to explore the implementation of standards in the Health Resource Centres of the Eastern Cape. The study was carried out in two phases namely a literature review and a survey. The study used the quantitative method of collecting data by means of a cross-sectional survey. A self administered questionnaire was used to collect data. The questionnaire was piloted in the Queenstown Health Resource Centre, after which appropriate changes were made before the commencement of data collection. The study was conducted in the three other Health Resource Centres of the Eastern Cape, namely Umtata Health Resource Centre, East London Health Resource Centre and Port Elizabeth Health Resource Centre. Health Resource Centre managers completed the questionnaires. The overall findings of this study show that the three Health Resource Centres uphold service standards. The results show that the Health Resource Centres were compliant with the service standards relating to both services and management areas. The Health Resource Centres were more compliant with standards relating to service areas than they were to standards relating to management areas. The results of the study furthermore demonstrate that the Umtata Health Resource Centre was most compliant regarding service areas (86,20%) compared to the East London Health Resource Centre (82,75%) and the Port Elizabeth Health Resource Centre (72,41%). In regard to management areas, the results show that the Umtata Health Resource Centre and East London Health Resource were more compliant than the Port Elizabeth Health Resource Centre. However certain aspects of their service such as availability of space, health and safety, staff performance and development, quality leadership and design and financial management need further attention. The study suggests that further research is required to objectively verify implementation of standards, to solicit health professionals’ opinions and experiences about the services provided by these Health Resource Centres and to find out if there is any connection between the quality of services provided and the quality of patient care. , Thesis (MSc) -- Faculty of Health Sciences, 2015

The study population consisted of 154 participants categorized into the following groups: 57 HIV negative participants (A), 40 HIV positive not on treatment participants and 57 HIV positive on treatment participants. Enzyme immunoassay kit was used for the quantitative determination of ET-1 and Nitrate/nitrite colorimetric assay kit was used for the determination of NO. Anthropometric measurements, body composition were determined. Hemodynamic measurements were also taken into account. Results: Resting metabolism, waist circumference (WC) and hip circumference had low mean levels in both HIV positives groups compared to HIV negative group. On lipid profiles visceral fat (VF), whole fat (WF) had low mean levels but skeletal muscle fat (SMF) showed the highest mean levels in both HIV positive groups. All the blood pressures between HIV groups were on a normal range scale. Mean values of endothelin and nitric oxide are increased in HIV positive not on ART and HIV (+) on ART compared with the HIV negative group. Conclusion: NO, ET-1, ART and HIV itself were associated with the pathogenesis of endothelial dysfunction in persons with HIV infection. Elevated endothelial markers namely ET-1 and NO can lead to improvement of endothelium dependent relaxation to some extent but not completely. Although these markers have deleterious effect on the endothelium but can also serve as up-regulator of hypertension. The experiences of employees utilizing an employee assistance programme in a psychiatric hospital

- Description: Employer’s assistance to employees experiencing personal problems originated in the 19th century. The term Employee Assistance Programme (EAP) was however formulated in the 1970’s in the United States and, initially, only focused on alcohol dependence rehabilitation. EAPs have since seen a paradigm shift in their focus as they now deal with the full range of problems experienced by employees such as family life or relationship issues, work related stresses, financial pressures, depression or anxiety, alcohol and drug abuse. The researcher observed that some employees in the psychiatric institution, where they are employed as both professionals and non-professionals, were experiencing personal problems and very little if anything was done to provide assistance to them. It also seemed as if very few of them made use of the voluntary EAP service made available by the institution. The fact that a number of employees have problems can have serious negative consequences in that it causes a high rate of absenteeism and the institution’s core business, which is to provide care to its users, is compromised. The researcher undertook this study because EAP services fall within the realm of institutional development. This study could therefore make an invaluable contribution to the transformation discourse which has been taking place in the South African health systems in general and psychiatric institutions in particular. The purpose of this research is to determine employees’ experience of utilizing an EAP in a psychiatric hospital. The researcher is personally interested in employees’ experiences of utilizing the EAP in order to provide recommendations that will assist and strengthen the policy/guidelines for the Eastern Cape Department of Health on the use of EAPs. The workplace has an obligation to provide EAP services to employees so as to help them meet their contractual obligations in a holistic and healthy manner. The research goals are to explore the experiences of employees who have utilized an EAP. The findings will be used to make recommendations regarding the utilization of the EAP policy/guidelines that are currently used to assist the employees. The research methodology will be qualitative, descriptive, exploratory and contextual. The research population and sampling for this study will consist of the employees who have made use of an EAP. Participants will be selected using a purposive sampling approach. Data gathering will be done using semi-structured interviews, at a venue convenient to the participants. Open-ended questions will be asked to enable participants to express their perceptions on the topic. The data will be analyzed using Tesch’s method of data analysis. The identified themes will be used to describe employees’ experience of utilizing an EAP. Trustworthiness will be ensured by using Guba’s model of trustworthiness. The ethical principles of beneficence, self-determination and justice will be ensured by asking for each participant’s consent, by not coercing individuals to participate in the study and by ensuring permission from the Department of Health and from the University’s research committee to conduct the study.

A critical analysis of service delivery system in the health institutions: a case study of Queenstown Private Hospital in Chris Hani District 2013

- Description: Service delivery challenges have been reported between from the health care industry more especially in the Eastern Cape Province this is due to a number of factors such as job satisfaction, productivity, absenteeism and turnover among healthcare employees and as such it affects employees’ organizational commitment and the quality of healthcare services. The aim of the study was to determine the factors influencing job satisfaction among healthcare professionals at Queenstown Private Hospital in relation to the service delivery. The study was conducted among 30 participants. Self-administered questionnaires were used to collect data from the participants. Data was then analysed using statistical tools such as pie charts and graphs. The results showed a high level of job satisfaction result in optimum service delivery in the service industry, more especially in the Queenstown private hospital. Almost 90% of participants were satisfied with their jobs, and there was a high level association between job satisfaction and socio-demographic characteristics. Variables such as opportunity to develop, responsibility, patient care and staff relations were found to be significantly influencing job satisfaction and there was a significant positive medium association between job satisfaction and opportunity to develop,responsibility, patient care and staff relations for both clinical and clinical support staff and consequently the employee performance in their jobs, which resulted in the improved delivery of health care in the hospital at all the times. Satisfaction with one’s job can affect not only motivation at work but also career decisions, relationship with others and personal health. Job satisfaction is also an essential part of ensuring high quality care. Dissatisfied healthcare providers give poor quality, less efficient care.

However community health workers (CHW) focussed on the preventive aspect of care. Limitations and recommendations based on the findings of the study are presented.

- Description: This paper is an investigation into the role of the Nelson Mandela Bay Metropolitan Municipality (NMBMM) in the up-keep and management of open spaces, in Zwide Township. The study examines the manner in which the legislative framework for waste management is being implemented as prescribed in legislative directives. The Constitution of the Republic of South Africa Act, 1996 (Act 108 of 1996), envisions the transformation of the local government system. Subsequently, policy frameworks and principles have been developed to support the new vision of local government. The Batho Pele Principles and the white paper were passed in March 1998. Both documents spelt out the implementation of the principle and the framework in which the local government system should operate as set out in the developmental local government concept. The developmental local government system’s core ethos lies in working with local citizenry to find ways of meeting their needs, thereby improving their quality of life. It also makes provision for public participation. Ward councillors and ward committees are an indispensable backbone of community participation. It is assumed in this study that a number of environmental, social, economic and health challenges are associated with waste disposal in open spaces. Such hazards range from health risks to the abuse of open spaces by antisocial individuals and groups. The situation is exacerbated by poor implementation of constitutional and legislative directives regarding waste management and disposal to ensure a humane and environmentally friendly atmosphere. The research assumes that the problem cannot be overcome by the NMBMM alone. Well-orchestrated community awareness education programmes such as projects like “trash is cash “and innovative ways of managing waste, including waste recycling, need to be drawn upon. The strategic placement of waste stations and the timeous collection of waste could improve the situation. The observation is that the level of service delivery varies within residential areas and in socioeconomic strata. The previously disadvantaged areas seem to have borne the brunt in terms of poor waste management services until now. The municipality has been accustomed to a situation whereby it removes the waste on an ad hoc basis in selected areas in the townships. The situation is exacerbated by little foresight into the ever growing population, specifically amongst the lower socioeconomic sector of the population. As a result, the ecology and environment is impacted in a negative way. Amidst the challenges of dumping in open spaces, a sense of determination appears within the community to want to prevent the situation; to illustrate: There is an organized group of youths who have cleaned up open spaces at along Qeqe Street in Zwide. They developed a car wash bay as a venture to generate an income. The Green Township Movement is another scheme which is mobilising the community, street by street, to keep their neighbourhood environmentally clean and green. Potentially, the Waste Management Directorate could collaborate with these groupings to halt waste dumping in open spaces. In so doing they could contribute to establishing an environmentally friendly neighbourhood. The NMBMM needs therefore to take advantage of the situation and reengineer its waste management strategy, policies and directives and augment the initiatives that the community have taken upon themselves. The study will endeavour to ultimately advise on viable strategies in an attempt to unravel barriers that have been identified, while simultaneously addressing the challenges to improving the quality of life in the township. This will be done by analysing a legislative framework and thereafter replicating the best practice used locally, nationally and internationally.. It also seeks to associate with individuals within local government in addition to groups that are like minded in combating the concern. The existing environmental regulations and the present economic situation are sound starting points. Together they present an opportunity to change the prevailing attitudes towards recycling. Finally, a number of conclusions that were arrived at during the study will be followed by recommendations. These will be based on the literature review and observations.

But, unfortunately hardly anyone has put forth strategies for how faculties should decolonise the law. A number of jurists have underscored the necessity to draw on customary laws and traditional values. Still, the #RhodesMustFall movement has, for the most part, been loud on the outcomes, but quiet on the methodologies. Joining the conversation on the decolonisation of epistemologies, this article contributes to the ongoing efforts to sanitise the law by proposing to revive African oral storytelling cultures as a way to analyse the questions of law facing society. To live up to this task, this article adopts decolonial theory and, through stylised examples, illustrates how lawyers and social scientists in Africa can utilise storytelling to contextualise, (de)construct, and comprehend those questions. This article assumes that lawyers can use African storytelling alongside the prevailing doctrinal method. That method, relaying the coloniality of law and captured by the acronym IRAC (issue(s), rules, application, and conclusion), trains students to approach conflict in society through a highly abstract and decontextualised problem-solving model. Lately, some (Western) social scientists have (re)discovered the practicality of storytelling in presenting analysis and research. However, in African oral traditions, stories worked differently from the manner in which those scientists employ them. African storytelling played a leading role, not only in conveying collective wisdom and social memory from one generation to the next, but also as a medium through which communities transmit the values that hold them together. Contribution: This article adds to the scholarship on storytelling and narratology by showing how educators can utilise stories to analyse legal questions. That rich scholarship in the humanities and the social sciences has so far not taken seriously the possibility of using stories to analyse research problems. Instead, scholars focus on storytelling mainly as a way of presenting science, not as an analytical tool. This article bridges that gap and demonstrates the analytical value of storytelling. Nobody can really afford legal services: the price of justice in Namibia

- Description: Nobody (except for the privileged few) can afford legal services in Namibia. In the light of this dawning awareness, how should the government and other stakeholders design the legal profession so that the greatest number of Namibians can access legal services and, ultimately, justice while preserving the profession's financial viability? The predominantly economic nature of this question means that its solutions lie less in the field of law than in the field of economics. Thus, this article adopts a methodology that reflects that insight.As a primary purpose, this article works towards solving the high cost of legal services in Namibia. It utilises a literature-review methodology that searches the scholarship on the legal profession for practical, down-to-earth solutions put forward in other countries to take the edge off the prohibitive cost of legal services. The article mainly finds that, if structured as a compulsory salary deduction, legal insurance promises the greatest positive impact on costs. And it concludes that the optimal solutions should consist of measures aimed at heightening competition in the legal profession and measures that broaden cost-sharing in providing legal assistance to the public. The article argues that competition can be effectively increased by lubricating the flow of information about prices and services, and by having more public entities bear the burden of expanding the system of legal assistance.

- Description: Tinashe Kondo’s book, Law and investment in Africa, narrates the efforts of a country to regain the trust [and the love] of foreign investors after several decades of argument and hostility. Encapsulated in the “Zimbabwe is open for business” slogan, these efforts show “how a country can move to regain credibility and commit to global rules despite its recent history”. This review of Kondo’s book concerns the manner in which readers can take advantage of this immensely useful publication. Particularly, this review looks into the book in order to advise law academics on possible strategies to integrate the book into their curricula in Zimbabwe and elsewhere on the continent.

Encapsulated in the “Zimbabwe is open for business” slogan, these efforts show “how a country can move to regain credibility and commit to global rules despite its recent history”. This review of Kondo’s book concerns the manner in which readers can take advantage of this immensely useful publication. Particularly, this review looks into the book in order to advise law academics on possible strategies to integrate the book into their curricula in Zimbabwe and elsewhere on the continent.

As the use of corporal punishment and other punitive measures to deal with misbehaving learners is now illegal, alternative positive disciplinary measures have been put in place. The prohibition of negative disciplinary measures has left teachers feeling powerless and frustrated, not knowing how to manage learner behaviour, despite the fact that they are the viable agents tasked with ensuring that positive disciplinary measures are implemented in schools. This study sought to examine how best a code of conduct for learners can be used to enhance positive discipline in schools. To that end, the study offers insights into how positive disciplinary measures may be used, in dealing with learner indiscipline. This is a qualitative study, underpinned by the interpretivist paradigm. The study employed a phenomenological design as a strategy for data collection, to examine how a code of conduct for learners can be used to enhance positive discipline in selected township schools. As this is a qualitative study concerned more with the depth than the breadth of information, the researcher deemed it necessary to focus on two schools, to obtain deep insight into the participants’ lived experiences. Two schools, in Pinetown in Durban, participated in the study. Interviews, observations and document reviews were used as data-collection instruments. In each school, interviews were conducted with the school principal, teacher representatives serving on the school governing board, disciplinary committee members, and members of the representative council for learners. Disciplinary hearings and disciplinary committee meetings were observed, and documents of relevance to the study were reviewed. The findings, as reported on here, revealed that the code of conduct is the most important strategy that schools can use to enhance positive discipline. Other strategies in enhancing positive discipline include the use of a research-based positive classroom management approach; positive reinforcement; integrating community support services; modelling good behaviour; parental involvement; preventive, supportive and corrective discipline; detention; communication (incorporating professionalism and cooperation); the creation of an environment conducive to teaching and learning; and the withdrawal or withholding of privileges. The findings further revealed that positive discipline is an alternative to negative disciplinary measures, such as corporal punishment in schools. Teachers are expected to comply with, and adhere to, disciplinary policies, and to assist learners in unlearning bad behaviours and developing the necessary life skills, values, and attitudes. The participants’ understanding of the use of a code of conduct for positive discipline successfully assisted them, as teachers, in dealing with misbehaving learners, and, in turn, in developing learners’ positive self-control and self-esteem, helping them to become responsible citizens, and courageous and respectful learners, not only in the school environment, but also as members of society at large. The research findings also revealed that many participants believed using a code of conduct (positive discipline) to enhance positive behaviour was a waste of time, and ineffective. As the findings indicate, learners were found to become impervious or immune to positive disciplinary measures put in place to assist them with behavioural problems. The findings also revealed that the ineffectiveness of such a code in enhancing positive discipline could be attributed to the fact that the teachers themselves were not, to a certain degree, fully trained with regard to positive disciplinary measures. A lack of parental support and teacher professionalism, the continued use of (the prohibited) corporal punishment, poor communication, a lack of stakeholder involvement in formulating codes of conduct, a lack of positive modelling and power struggles were found to impede the use of a code of conduct to enhance positive discipline in schools. Based on the research findings, the study recommends that schools ensure that there is a sufficiently detailed code of conduct to assist teachers in addressing learners’ bad behaviour. There should also be advocacy from the Department of Basic Education, for support programmes to be put in place to assist teachers with alternative ways of enhancing positive discipline in the classroom. Awareness of how teachers are to be upskilled as regards positive disciplinary strategies, active parental involvement, and increased support for teachers, are amongst the recommendations. Ultimately, the researcher concluded that the code of conduct was a strategy that schools can use to enhance positive discipline. - Description: Various allegations have been levelled against certain local authorities in South Africa. These allegations include poor governance, maladministration, corruption and poor service delivery. Some of the South African municipalities are unable to deliver sufficient services to the people due to financial instability. On the other side the fact that the municipalities have to generate their own revenue is no longer sufficient. However, government, both national and provincial has to support the municipalities in terms of their capacity to provide services. While government has to provide services to the people to ensure their welfare, people from local communities should also support the continuous provision of `these services by paying for municipal rates and services. These may include services such as water, refuse removal and electricity as well as property taxes. The main issue is that these services are not readily available, for instance water has to be purified. The situation at Mnquma Local Municipality as indicated in the financial and other reports is such that there is a very slow payment of rates and services, which leads to the municipality relying mostly on government grants, and this puts a heavy strain on service delivery by the municipality. Seemingly, it has been long that rates and services have not been paid in Butterworth-even before the restructuring of the municipality (i.e. before the Mnquma Municipality came into being). However, if alternatives could be found to enhance regular payment of rates and services the municipality might improve in terms of its capacity to deliver services.
